In response to numerous requests for more information on the defunct Safe House Pilot Project that was to address the growing numbers of displaced and homeless LGBTQ Youth in New Kingston in 2007/8/9, a review of the relevance of the project as a solution, the possible avoidance of present issues with some of its previous residents if it were kept open.

Huge turnout for for Bishop Ricketts and his two sons

Bishop Stephen Ricketts and his two sons, Chevorn and Sejue Ricketts, who were among six persons who died on July 16 when their motor vehicle plunged into the Rio Cobre, were laid to rest in a grand revival thanksgiving ceremony in Commodore, St Catherine, day before yesterday.

"A only Princess Diana did go home inna dem yah fashion and style yah, so it must be that the Lord has found some favour in this man make him can go home inna them fashion ya," Archbishop Dr Sulanch Lewis, one of the officiating ministers, said.

The Mount Maria Zion True Fellowship Church, where the service was held, could not host the amount of persons who turned up to bid farewell to the bishop and his sons. Many resorted to standing on the outside, where the streets were lined with dozens of vehicles. Multiple police officers were in attendance to ensure crowd control.

Inside the crammed church, the three caskets were propped up on a wooden alter, surrounded by multiple coloured candles. The benches were removed, allowing the revivalist worshippers room to dance and chant, while circling around the caskets.

Much of the ceremony, which started at 9 a.m. was dedicated to dancing and chanting in tongues around the caskets with the occasional ringing of bells. There were many sporadic instances of persons getting into 'spirit', where they moved about the packed church, seemingly uncontrollably.

At various intervals, the ritual was paused to give persons an opportunity to give their tributes to the deceased. In his tribute, Peter Abrahams, councillor for the Bog Walk division, told the congregation that Bishop Ricketts was his good friend, and a true Labourite.

"Steve is a honest, decent individual. I happened to come in contact with him a couple years ago, doing business in Bog Walk. We were there talking and that's when I realised he was a true Labourite," Abrahams said.

"I remember the last time when Andrew Holness was touring the area, there was a congregation over by the shop next door, not even me could calm down the people because Andrew Holness was late. Steve was the only man to step out of this church, and come over to the bar, and calm the people of the Linstead area. Jamaica, I know, is saddened by this sudden death," he recalled.

Archbishop Lewis, who is from New York, also gave tribute, calling the bishop a good friend, who always spoke the truth. "Before him tell you the truth, him woulda take a little drink. Him always tell me people say things, and I told him people will always talk about us because we are celebrities, and Steve a first- class celebrity so them haffi chat," he said.

Lewis might have been alluding to the fact that tongues have long been wagging about the bishop's character, as many persons had regarded his lifestyle as less than holy. But many of Ricketts family members and some community residents came out in support of him, denying the rumours. The family members claimed that things that were being said in the social and traditional media were very hurtful to them and only served to further taint the bishop's esteem character.

Principal in 'biting matter' chased from school

In a followup to a previous post on a bizarre biting alleged outdoor sex matter involving two men in Bayside St Catherine earlier in April by Rodney's Arms; news has come he is facing a backlash from parents at his school.

According to the Star News:

The grounds of a Corporate Area school was reduced to a hostile environment last Thursday after a principal, who was on sick leave, visited the premises seeking to continue his duties amid controversy surrounding his absence.

THE STAR understands that students, parents, and some teachers were vehemently opposed to his return to the institution, citing unrest among the school population as well as backlash from community members who were very familiar with what led to his absence.

Our news team was told that the police had to be called in to protect the administrator and escort him to his vehicle, as the crowd that gathered hurled insults at him and threatened to get violent.

To make matters worse, THE STAR gathered that the principal showed up at the school before the end of his six-week sick leave, obviously still feeling the effects of his injuries and was allegedly sporting a urine drainage bag.

The principal in question reportedly lost his manhood after it was allegedly bitten off in a bizarre incident that took place in Portmore, St Catherine, last month.

Following the incident, the police had to rescue the administrator after he was found along the roadway outside a popular restaurant and lounge located in Portmore, bleeding profusely from his private area.

A parent, who was at the school last week when high drama unfolded, told our news team that the principal is no longer welcomed there.

She said, "I attended this school, and now my children are here, and this type of embarrassment is distracting. The students are frightened and they don't trust him. They tell him they don't want him and dem run him weh. The police had to be called in and one of the officer cranked up him gun to scare away the children."

A male parent who also spoke to our news team said he would remove his son from the institution if the principal in question continued working at the school.

"Mi a move my son and send him go another school 'cause a learn mi send my pickney go school fi learn, and pickney look up to principal. Mi nuh want nuh principal trick my child," he said.

Bryon Buckley, director, corporate communication at the Ministry of Education, confirmed that the ministry is aware of the disturbance which occurred at the school.

"A team from the ministry went there and spoke to the staff and the principal. He (the principal) was advised by the ministry not to be on the compound so as to quell things," Buckley told THE STAR.

When asked by THE STAR if the principal in question would continue his tenure, Buckley said that was a school board issue and not for the ministry to decide.

The St Andrew North police also confirmed that police were called to the institution to control the situation which had unfolded.

President of the Jamaica Principal Association, David Wilson, could not be reached for a comment.

Sadly this is what can occur even as no names were mentioned in most of the reports but of course the proverbial grapevine carried this one onwards. I can only sympathize with him in terms of the scary experience with a mad crowd at your door and you alone to face it. My own incident twenty years ago flashed before me as I read the report.

As we were leaving the airport station under police escort the crowd that gathered demanding we (myself and three co-accused) be released to them to do what they want with us.

I hope some clear resolution can come from this one.

Seven Year Gross Indecency Case continues in Home Circuit Court

Dwight Pusey a man who has accused of gross indecency twice involving other males as 'victims' had his bail extended in the home circuit court today. The matter has been languishing for some time now.

Doc Freed of Sexual Assault Charge

A medical doctor, who went on trial with two other men for an alleged sexual assault on a 23-year-old man, has been freed in the Gun Court.

Dr Dwight Pusey, Paul Wright and Richard Wedderburn, were freed after Supreme Court Judge Marjorie Cole-Smith upheld a no-case submission made by the men's lawyers.

The allegations are that on June 25, last year, the complainant was forced into an apartment near Eltham, Spanish Town, St Catherine, and sexually assaulted by four men.

The complainant said that a gun was used during the incident He said one of the men took a gun and hit him in the head.

After the ordeal, the complainant made a report to the police and the three accused were arrested and charged with buggery, indecent assault and grievous bodily harm.

The complainant said he knew the three accused before the incident, but he did not know the fourth man. In his testimony, the complainant said the men used lubrication on him before he was buggered.

After the Crown closed its case, defence lawyer Anthony Pearson, who represented Dr Pusey, submitted that there were too many discrepancies in the Crown's case. He said medical evidence did not support the complainant's evidence that he was lubricated and buggered. Pearson said no reasonable jury properly directed could convict on that evidence.

Defence lawyers Vincent Wellesley, Marjorie Shaw Currie and Deneve Barnett who represented the other two men adopted the submissions.

The judge upheld the submissions and freed the men. Dr Pusey has another case pending in the Home Circuit Court.

He is accused of gross indecency and the case has been set for trial on September 17. Dr Pusey's bail was revoked in April because of the allegations. He is now on $150,000 bail with a surety.

A new mention date for the current matter has been set but not appearing in the criminal listings as yet of the Gross indecency for us to understand its relation to buggery in the sexual offences law.

What Jamaican Law says about Homosexuality:

Contrary to popular belief, it is not actually illegal to be homosexual in Jamaica. Being a homosexual does not contravene any of the existing laws; however, the law makes certain ‘homosexual acts’ illegal, and these laws are used to persecute gay men. They state that “acts of gross indecency” and buggery [anal sex] are illegal. 


Although buggery refers to anal sex between a man and another man, a woman or an animal, in practice the law is predominately enforced against two men. Lesbians are also discriminated against in the wider society, however no laws target lesbians or lesbian conduct.

Offences Against the Person Act

This act prohibits “acts of gross indecency” between men, in public or in private. (This is a very general term which can be interpreted to mean any kind of physical intimacy)

Article 76 (Unnatural Crime)

“Whosoever shall be convicted of the abominable crime of buggery [anal intercourse] committed either with mankind or with any animal, shall be liable to be imprisoned and kept to hard labour for a term not exceeding ten years.”

Article 77 (Attempt)

“Whosoever shall attempt to commit the said abominable crime, or shall be guilty of any assault with intent to commit the same, or of any indecent assault upon any male person, shall be guilty of a misdemeanour, and being convicted thereof shall be liable to be imprisoned for a term not exceeding seven years, with or without hard labour.”

Article 78 (Proof of Carnal Knowledge)

“Whenever upon the trial of any offence punishable under this Act, it may be necessary to prove carnal knowledge, it shall not be necessary to prove the actual emission of seed in order to constitute a carnal knowledge, but the carnal knowledge shall be deemed complete upon proof of penetration only.”

Article 79 (Outrages on Decency)

“Any male person who, in public or private, commits, or is a party to the commission of, or procures or attempts to procure the commission by any male person of, any act of gross indecency with another male person, shall be guilty of a misdemeanor, and being convicted thereof shall be liable at the discretion of the court to be imprisoned for a term not exceeding 2 years, with or without hard labour.”

Sadly our courts despite very slow improvements in terms of men who are accused of compromising positions with other men are indeed very slow to end matters, I can attest to it in my own buggery case in 1996 (no minor was involved). It took three years at the resident magistrate level to have the matter adjourned sine die (can be revived within seven years if new evidence is found). During those waiting periods persons are reviled, forcibly evicted, victims of homo-negative comments or planned attacks, embarrassed and even threatened.

President of the People’s National Party (PNP) and Opposition Leader Portia Simpson Miller is promising to review the country’s buggery law if she is returned as prime minister of Jamaica.

The pronouncement came last night as she faced Prime Minister and leader of the Jamaica Labour Party (JLP) Andrew Holness in the third and final political debate convened by the Jamaica Debates Commission.It also comes amidst the intensification of discussions on the matter.
“We should have a look at the buggery law,” said Simpson Miller in response to a question on gay rights.

She also challenged a previous pronouncement by former prime minister Bruce Golding who told a BBC TV interviewer some years ago that no gays could serve in his Cabinet.Simpson Miller said she was not in favour of such a position and suggested that persons should be selected for Cabinet duties on the basis of their capacity to deliver.

Responding to the same question, Holness articulated the need for Jamaica to achieve minimum standards governing human rights and suggested that such steps were being taken through measures such as the passage of the Bill of Rights.He added that any change to the existing legislation should be made on the basis of due consideration to the views of the people.

“We are an open society and the issues that are difficult and uncomfortable to discuss, as the society progresses, these issues are being discussed. People are entitled to their opinions but as leader of the country I have to respect everybody’s opinion (and) make sure that the institutions of freedom are well in place so that the debate can continue,” said Holness.

Let us also remember importantly that this is her personal position and not of the rest of the party and it doesn't appear under the justice theme of the PNP's manifesto.

Executive Director of JFLAG Dane Lewis said the Prime Minister missed an opportunity to make a bold declaration on securing rights for all Jamaicans, he continued on a telephone interview that "We're very encouraged by the bold statement from a Jamaican politician the opposition leader Miss Portia Simpson Miller, I am very disappointed that the Prime Minister with an opportunity to make as bold a statement chose the lower road. It is going to take a conscience vote it's gonna take the leaders of this country to make some bold steps to recognise the rights of all Jamaicans." He also said he trusts the sincerity of the opposition leader, he doesn't think it's a ploy to win the votes of the gay community days before an election.  He said too that it was not about threats on withholding aid by UK and US governments who have now tied aid to LGBT rights.       





The church community in the form of their representative today Dr. Lentworth Anglin, Convenor of the Umbrella Croup of Churches said on CVM News "We consider homosexuality, lesbianism, same sex marriage to be anti scripture and therefore we oppose that kind of behaviour, we are not necessarily dictating to individuals how they should live, we're just stating a position, we are not trying to necessarily trying to deprive persons of opportunity for service to the nation but we are just simply presenting our position."


Meanwhile Desmond Mckenzie of the Jamaica Labour Party JLP on the campaign trail said "I think the debate on this is not for now but it is a debate that should go on but there are moral issues here that as a country that has more church per capita than anywhere else in the world that is something that should not escape our minds right now."

Could this be a trap? if we enter all the way to a conscience vote on the proposed path by the opposition leader that the members of parliament vote and leads to an echoing of the majority sentiment then it would be a done deal in my view. Then we as a nation could rebutt to the nations who are redirecting aid that is now pinned to the rights condition of the LGBT community that the matter was voted on and the decision made. Then there maybe no room for agitations for any other rights based issues for LGBT people including gay marriage although we never asked for such prior to now. I disagree with the JFLAG folks I think this has a lot to do with the pressure from the UK and the US also she maybe wants to sure up a lead in this tight race by appealing to her large LGBT following that has always been a feature since the seventies. I am still skeptical about this announcement by the opposition leader, there is method to madness and politicians do not make blanket statements like that without some reason ahead, although as indicated above it is her personal opinion outside of the rest of the PNP which still has in its midst former Attorney General A. J Nicholson who penned the No Plans to Legalise Gay Marriage document in 2006 and vigorously debated on the opposing side to buggery etc in the Sexual Offences Bill.  Let us also not forget the PNP sided with the JLP on the invented gay marriage ploy so executed in parliament to deny us rights in the Charter of Rights Bill in 2009.

PNP Has Given No Commitment To Repealing The Buggery Act

Kingston, December 22, 2011: The People’s National Party notes that following Tuesday’s leadership debate, some persons have been suggesting that PNP President Portia Simpson Miller, has given a commitment to “repealing” the Buggery Act. The PNP uses this opportunity to state clearly that Mrs. Simpson Miller gave no such commitment.
The PNP President said it was time that the Act be “reviewed” and all members of the House of Representatives provided with an opportunity to vote on the matter based on their conscience.
It would be expected that in such a vote, Members of Parliament on both sides of the House, would take into consideration the views of their constituents.The PNP President remains committed to her pledge to make appointments to a Cabinet led by her on the basis of competence.

Vaz Says Constituents Stand Firm Against Homosexuality

Jamaica Labour Party (JLP) candidate for West Portland, Daryl Vaz, on Wednesday night told a party mass rally in St Mary that his constituents have already told him to say no to the repealing of the buggery law.

Addressing thousands of Labourites in the seaside town of Annotto Bay, Vaz poured scorn on comments by People's National Party (PNP) President Portia Simpson Miller during the national leadership debate with JLP Leader Andrew Holness on Tuesday.

Simpson Miller, in her rebuttal to a question of whether homosexuals would be excluded from the Cabinet, said the issue was one of human rights, and her party would not reject anyone based on their sexual orientation. She said should the PNP be returned to power, Parliament would initiate discussion on the buggery law in Jamaica with a conscience vote on whether it should be repealed.

But Vaz claimed the people of his West Portland constituency had already spoken on the matter.

"We don't buy number two inna Cash Pot," said Vaz, in a reference to thepopular game of chance in which the number two is used by some persons to refer to homosexuals.

According to Vaz, while he was willing to participate in any debate on gay rights, his response is a foregone conclusion.

"God made Adam and Eve and not Adam and Steve," Vaz said as Labourites cheered and shouted anti-gay slurs.

The issue of homosexuality has been on the JLP election platform even before it was raised as a question in the debate Tuesday night.

In Gordon Town, St Andrew, last Sunday, JLP deputy leader and the party's candidate for Western Kingston, Desmond McKenzie, declared "fire bun", following strains from the popular dancehall song which has a line "dem a par inna chi chi man car".

Also, at a recent meeting in St Elizabeth, persons on the JLP platform made reference to their love for "boonoonoonus" women, a claim that sparked a backlash from women's groups.

Former JLP leader and then Prime Minister Bruce Golding had declared an in interview on the BBC that no gay men would be allowed to serve in his Cabinet.

On Tuesday, Holness, did not articulate a clear position when questioned on the issue but implied that he would not fly in the face of popular opinion opposed to gay rights.

In recent months, several countries, which are aid donors to Jamaica, have suggested that they might change their position if more was not done to protect the rights of homosexuals.

What say you? as we watch the developments unfold. Bear this in mind as well, after digging my archives I found the presentation by Mrs Simpson Miller in 2009 (poor audio though) where she sided wholeheartedly with the then Prime Minster Bruce Golding (his speech linked) on the banning of gay marriage, gay marriage rights by the way was never asked for by the LGBT advocacy structure but it was dishonestly pushed on the agenda during the Charter of Rights debate then as a smoke screen to deny us recognition in the Charter. 


She said on October 20th 2009 - "Mr Speaker when we accepted the final report from the joint select committee that were looking at the bill we were completely satisfied with their recommendation of a provision to restrict marriage and like relationships to one man and one woman within Jamaica and that the provision should be specifically spelt out so that there could be no ambiguity .......... yes one man one woman (laughter in the house) and if you are Jamaican and go overseas the same applies ..........."

Rowdy gays banned by J-FLAG, JASL .......... (Jamaica Observer)

SEVERAL homosexuals who have been cast out of their homes and communities and are now living on the streets of Kingston, including some with the dreaded HIV virus, have been banned from the premises of the two most prominent advocacy groups in Kingston for bad behaviour.

These males, some of whom are commercial sex workers, are complaining that they no longer have the full support of advocates Jamaica Forum for Lesbians All Sexuals and Gays (J-FLAG) and Jamaica Aids Support for Life (JASL), charging that they had left them defenceless against attacks from hostile 'homophobes' and even police officers bent on getting them off the streets.


Homeless homosexuals in New Kingston say they have been deprived of medicine and other assistance from JFLAG and JASL because of the bad behaviour of a few.

"They say we are not allowed on their property because you have some 'girls' who go up there and behave bad," a gay man admitted to the Sunday Observer in an interview at one of their popular hangouts in New Kingston.

He declined to be named, but gave examples of lewd brawls — some of which resulted in physical confrontation between gay men on J-FLAG's Kingston premises — as the reason for the ban.
He said that as a result, those among them living with HIV had been struggling to access the vital and cost-free medical treatment they used to get.
Several of these homeless gays have also felt the chill of the night air as they are forced to sleep in abandoned buildings, their cries for help falling on deaf ears.
The JASL was established in 1991 with a mandate to provide stigma-free prevention, treatment, care and support services to Jamaicans living with HIV/AIDS islandwide.
J-FLAG is an advocacy organisation which provides support and intervention programmes for those who are victims or potential victims of violence because of their sexual orientation or gender identity discrimination.

The premises of advocacy groups Jamaica Aids Support for Life (above) and Jamaica Forum for Lesbians All Sexuals and Gays have become off limits to some unruly homeless gay men.

Both J-FLAG executive director, Dane Lewis, and his JASL counterpart, Kandasi Levermore confirmed that some persons had been barred from visiting their organisations' premises, but the ban only applied to an overly unruly few numbering seven.
"Yes, we have banned those who have violated the space because of their bad behaviour, but it's not everybody that is banned from accessing our services," said Lewis. "And it's not that we don't still look out for them," he added.
But, another gay male, who also declined to be named for this article, but who sported women's tights and spoke with the customary feminine drawl during the interview with the Sunday Observer, questioned the organisations' decision even as he defended his friends.
"There is no way you can take on 20 to 30 gay persons from different backgrounds, different homes, with different personalities and expect them to behave perfect. It can't go so," he said while gesticulating wildly.

"You are going to have fights, you are going to have fuss, you are going to have quarrels, 'cause even in a normal family that happens. You understand? There is no way everything will go smoothly," he said.
"If somebody start something you don't ban the whole group! They need to 'tan tuddy' and make sure that the rules and regulations are applied."
"Even on Thursdays they used to have a thing they called the K-package (at JASL). This was a programme they set up so that the homeless could go there and get lunch on a Thursday. Now the homeless can't go there anymore," said another member of the group.
"You have a number of homeless gays living in an anti-gay country, so to now have your own turn against you is not easy," one of the men told the Sunday Observer.
They told stories of how they ended up selling gay sex for money and living in abandoned homes and on the streets and gullies in the capital city.
"Some of them on the streets have nowhere to go, their families put them out, they can't go back to their communities and so they just out there suffering," said one of them.

He claimed he knew a 15-year-old gay youth who was chased from his home and community after his sexual preference was discovered. One night, while on the streets, the police accosted him, beat him and chased he and others like him away from their corner. The teen reportedly took refuge in the home of someone he knew, sleeping in a back room. However, even there he was not safe as he was stabbed to death in a mysterious incident.
"He didn't have anywhere to go, or anyone to help him. If JFLAG or JAS(L) did help him when him family put him out, he would still be alive today," said his friend.
"...That organisation was built to protect the rights of gays in Jamaica, but now we are not able to go there and access anything. They not protecting us at all. Once we could go there and access services and make reports and then they would try to venture out and see what they could do to uphold the rights of the gays," another young man said.

But Lewis insists that his organisation still does what it can for those gay males in need as long as they are well-behaved.
"Anyone who has not violated the rules because of bad behaviour has not been denied access to our services as far as I know."
For JASL, Levermore said: "We have generated a list of about seven guys that are, in fact, banned from the AIDS Support property," she said.
"However, that does not prohibit us from bringing the services to them. And from time to time we do have outreach where we take some of the services out to the guys. The seven in particular, they fight, they quarrel, they stab up (each other) and you name it. And they just behave in a manner that is just not appropriate for even in your home."

She said the ban had to be imposed as their outrageous behaviour was a turn-off to those legitimately seeking help from the organisation.
"It pushes our other clients away from seeking our services because of these same guys... when the other clients come, they have to put up with the kind of behaviour that these guys carry on with. Other than that, it makes it a very unhealthy environment for the staff at Jamaica Aids Support for Life. We have in many ways asked, begged, solicited, (be)friend(ed), we have tried everything to get these guys to understand that their behaviour is unacceptable and we have asked them to amend, adjust, all of that to no avail."

She said as recently as last August 6, there was an altercation involving some MSM (men who have sex with men) that resulted in someone being stabbed on the property.
She insisted that it was not a permanent ban and her organisation had not cut its services to the gay homeless population in New Kingston.
"Usually a ban is for a period of time. It's not that they are totally restricted. Depending on the offence there would be a time frame affixed. Many times we have had to call the police or the security company that does monitoring for us. We have to be panicking every minute when these guys are fighting on the property.
"So once it gets out of hand, it's usually things that are an offence against the law, and then we have to put some restrictions in place, especially after we would have intervened and asked them to cease and desist and the behaviours continue."

Reports suggests at around 9:15 am a set of the homeless men went to the property adjacent to the Jamaica AIDS Support for Life offices where a gaping breach is in the bordering fence and created a temporary scene calling the occupants gays and battymen and other negative connotations so much so that the security detail contracted to provide surveillance had to be called in to maintain order, the men reportedly entered from the rear of the premises via an adjacent property but were kept back by the security, a shouting match ensued for some minutes. There seemed to be a zero tolerance approach the security detail however was professional who for all intents and purposes are usually summoned via a panic button or some other digital signalling device. According to the eyewitness while one of the men behaved very badly, almost defrocking infront of the detail the other men were more subdued and seem to cooperate in retreating to the neighbouring property.

The behaviour of the men is a cause of concern for the residents as they fear needed attention to the property a view that is fear but given the article in The Jamaica Observer and the hint to where certain offices are there is some concerns as well. Certainly I am on record as to the behaviour of the men and would be unfair if I did not bring that part into question but if the only way to deal with this rebellious population is to not engage them and besides the major LGBT body politic is not engaged anyway then I am afraid more reports like this may be forthcoming or worse.

Case Update: Brotha Hurt by Homophobic Violence in 2008

Remember this case in 2008? where three gay men were attacked in Mandeville, Manchester at their home by an angry mob of approximately 20 people who had threatened them with violence days before if they did not leave the community to which they refused. The matter was also aired on CVM TV (a DVD copy should be a JFLAG's archives, if kept safe) at the time with the fire brigade saying on camera they supposedly went down a natural cave formation where one of the men was suspected to have fallen into and found nothing, a claim that has left many including myself doubting as our forces do not have the requisite cave exploration equipment to do that kind of investigation.

What as even more disturbing at the time was that a group of local expert cavers offered on a pro bono basis to assist to prove if such excavation was done as said by the fire department to which JFLAG declined, this was one of the many controversial pointers that has gotten several persons doubting JFLAG's reoluteness on issues at the time to the present day leading to the strong criticisms about their stewardship.

The photos below highlight some of the injuries then as I had taken at the old office when he had come in for an interview I had insisted upon then that injuries be documented carefully and the necessary permissions granted for re-publication:





He has since healed miraculously along with his other friend who sustained far lesser injuries as he managed to escape the impending doom as they watched television in their rented flat. I caught up with him at a party recently and he was in good spirits, unlike others he decided to remain in Jamaica no matter what and do what he has to do and not take the asylum route for now. He was looking quite well physically too and his scars could barely be seen as they have healed nicely, including the chopped left ear that was reported as severed on some news sites and blogs.

Thankfully his life was speared after this harrowing ordeal, as for his missing friend he is not sure what has happened really to him but he doubts he fell in the cavern at the time as no signs of any deceased has occurred since including unusual odours etc. to indicate such. His other friend has since also found resolve from his temporary displacement and was last heard from some months ago by our photographed individual above.

Great news as we sometimes do not follow up and bring some closure to some of the atrocities past thus leaving detractors to think no such happenings go on in the first place hence the cynicism when LGBT groups agitate and to also inform the LGBT body politic of the outcomes of some of the cases where persons think the victims are still victims when they do not see or hear of the transitions and gains they have made in rebuilding and assimilating into general society.

Hope he grows from strength to strength other updates will come from time to time as needed.

Cartoons and the use of gay typed characters part 2

See part 1 where I briefly looked at the Shebadarization of entertainment on a whole with brief effects on Jamaican psyche and associated gay typed characters on Jamaican stages.

Over these many years cartoonists in particular have been weighing in on the issues with every thing from very disturbing and stereotypical pieces to more satirical ones poking fun at the issues, many persons in the LGBT community and by extension the advocacy groupings have expressed some outrage specifically to today's Observer image as done by resident cartoonist Clovis:

This is following on the recent apology from the police high command on Superintendent Fitz Bailey and his assertions on gays involved in organized crimes without specifically naming the ones they are involved in.

Other popular cartoons include the now infamous call from public defender to put prisoners to work however Clovis gave a spin on the issue by showing the two prisoners in a romantic position in jail-house fatigues, another was the barred closet door as hammered blocked by former Attorney General A.J. Nicholson.

Certainly the Boom Bye Bye one I included here was one of many others that were too offensive so I left them out of this entry that was a supposed response to the "Not in My Cabinet" rant on the BBC's Hard talk show in 2008/9 however one can also appreciate the cartoonists are also carrying the views of readers and John Public which may be for or against LGBT issues but given our very slow change to a more tolerant society the toons seem to be reflecting more comedic themes especially the Clovis ones that have a stereotypical cross dresser with male features also visibly shown.
As I said elsewhere sometimes we have to laugh things off sometimes if not we all may go mad.

Dear Editor,

This is in regard to your cartoon of July 19.

I find your portrayal of gay people to be most offensive! Do you really believe that all gay people carry themselves in this manner? You are setting a bad precedent and initiating a stereotype that will just help perpetuate the rampant homophobia that plagues the Jamaican society.
Please act responsibly by understanding the ramifications of what you publish! I sincerely hope you will see the gravity of this and take corrective action.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard



When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues


If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law



Originally aired on CVM TV December 8th 2013, apologies for some of the glitches as the source feed was not so hot and it kept dropping from source or via the ISP, NO COPYRIGHT INFRINGEMENT INTENDED and is solely for educational and not for profit use and review. The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
