In response to numerous requests for more information on the defunct Safe House Pilot Project that was to address the growing numbers of displaced and homeless LGBTQ Youth in New Kingston in 2007/8/9, a review of the relevance of the project as a solution, the possible avoidance of present issues with some of its previous residents if it were kept open.

LOL let me tell you I bout crashed my car in all of 29 years of my life. Things got so bad I pulled my damaged car up to the corner of save me Jesus now and His grace and Mercy Heals souls. Prime Minister Bruce Golding has scored political points by stating on BBC that he will not have any homosexuals in his Cabinet. The statement might improve rather than lessen the tourist arrivals, as some might want a gay-free holiday.

But Golding's views seem to run counter to those expressed by Ossie Harding and Delroy Chuck, both of whom in 2004 called for the decriminalisation of homosexuality between consenting adults. Today, Delroy Chuck is Speaker of the House of Representatives and Ossie Harding is once again president of the Senate.

Despite the paedophilia scandals involving priests in the United States some years ago, the Roman Catholic Church has never approved of homosexual acts. Roman Catholic teaching regarding homosexuality is that "under no circumstances can they be approved" (paragraph 2357 of the Catechism of the Catholic Church). By the way, some statistics state that 61 per cent of all homosexuals in the world are white males. Interestingly, the majority of Roman Catholic priests worldwide are not white, but African or Indian.

At the same time, the position of the Roman Catholic Church is that "every sign of unjust discrimination in their regard should be avoided". These people are called to fulfil God's will in their lives, and if they are Christians, to unite to the sacrifice of the Lord's cross the difficulties they may encounter from their condition (paragraph 2358 of the Catechism of the Catholic Church). If one is pro-life any at all, then judgements should be left to God, and life should be preserved.

The anti-abortion stance of the Roman Catholic Church is an important part of the pro-life position, but it is much wider than that. It takes in the right to live, which includes homosexuals. Yes, a stance should be taken against homosexual activity, but violence is not the way. As a result of violence, homosexuals tend to become more creative in hiding their activities. But do you want to stop the spread of homosexuality, or do you simply want to beat up some homosexuals?

If you want to really stop it, you might just find that the present buggery law encourages homosexuality more than it discourages it. For one thing, there is no law against cross-dressing in public. Cross-dressing to my mind is the single most important factor in spreading the homosexual lifestyle. But as long as it cannot be proved beyond the shadow of a doubt that a homosexual act took place, the cross-dressers are free to continue to advertise and encourage homosexuality by cross-dressing.

While it is debatable that it might be better to ignore what adults do in the bedroom and allow God to judge them for their actions, the law should be changed to disallow cross-dressing in public and to disallow homosexual advances to a child. The cross-dressers who believe that they are simply following a style might be for the most part heterosexuals.

But young children under 12 years old might be confused as to what they see adults do and become homosexuals. This is why I wrote and sang the song Man fe look like man, and I thank Michael Sharpe of TVJ, Mutabaruka and Elise Kelly of Irie FM for giving it airtime. I have already written that I got a vision on Good Friday that American missionaries should stay in their homeland and clean up the Internet and the cable TV. This is perhaps the main reason why homosexuality is becoming so "in-your-face", though it used to be hidden. It is certainly a better way to morality when youngsters are not exposed to such things.

Indeed, we should help people to be morally upright instead of deliberately organising people's lives in such a way that they have no choice but to act immorally. Jamaica Public Service , the electric power company runs some advertisements on radio and television: "If stealing is wrong, how come you steal electricity, how come, how come, how come?" Of course, parents should set examples, but sometimes parents have no choice.

What happens when parents have lost their jobs yet their children need to do their homework? This is not the day when the children of the poor did not go to school. Indeed, the younger generation was not even born in that day. In such circumstances, they are going to be tempted to break both civil and moral law and steal electricity. And what about refrigeration? These are not the days when salt was the main preserver of food.

And kerosene refrigerators are no longer available, whether the reason is that they are simply not manufactured anywhere anymore or they just are not imported anymore. Are people to throw away good food after eating, as is done in so many hotels? If JPS can be complaining about electricity theft and still make a profit, then what should happen is that people should have the option to apply for electricity that they would not pay for, and give community service instead. Let us help people to do the right thing.

Dear Mr. Golding:

Recently a number of international human rights organisations have called for a boycott of Jamaica over concerns about how gays and lesbians and those perceived to be so are treated in the country. For our part, we at J-FLAG, while disagreeing with the strategy of a tourist boycott, have stated our concern about violence against persons because of their actual or perceived sexual orientation. We note your intervention in the matter in both the local and international media, where you have suggested that the right to privacy is guaranteed and ought not to be violated by the state. Yet, you have confirmed, in a very public way and in a global arena, the view that Jamaica is a repressively homophobic society. Yourinterview on the BBC’s ‘Hardtalk’, for instance, presented the country as one where open discrimination
against gays and lesbians is not only commonplace but sanctioned by a long-standing cultural history, ostensibly enshrined in law, and now condoned by the country’s political leadership.

We believe that the atmosphere of violence against homosexuals is sustained in part through the
perception that homosexuality is illegal in Jamaica, based on the provision in the Offences Against the Person Act criminalising buggery. While the law relates to all persons engaged in anal sex, it is to be underscored that the offence, driven by a religio-cultural sense of what is biblically appropriate behaviour, is used symbolically and disproportionately against men engaging in consensual sex. This kind of legislating on the basis of religion is problematic because it lacks consistent application; it is not used against heterosexual persons. Further, no other contravention of biblical sexual values—for example, adultery or fornication—is criminalised in Jamaica. We contend that the continued existence of this law is a violation of our right to privacy and makes many consenting adults into unapprehended criminals simply for having sex.
You also seem to have misunderstood our concerns. We wish to state that one of J-FLAG’s primary concerns is the lack of redress for culturally-sanctioned violence against sexual minorities. In your public pronouncements, you have depicted this as constituting a quest ultimately to sanction same sex marriages. We wish to make it unambiguously clear that same sex marriage is not on J-FLAG’s agenda.

We perceive the dragging of this issue into the discussion as a smokescreen that distracts from the real challenges of how as a society we grapple with the violence and hostility that have come to define our engagements around controversial but important socio-cultural issues.

Your statement to the BBC that the country would not be pressured by outsiders into changing its values around homosexuality begs the question of whether you have instead been willing to listen to the many local voices raised about the same concerns. We know that this has not been the case and note that the shutting down of such a dialogue by retreating into a discourse on the cultural right to prejudicial behaviour makes it difficult if not impossible to achieve substantive progress on difficult questions in the society.

On Friday May 23, 2008, my home country of Jamaica celebrated Labor Day and today May 26 in America we are celebrating Memorial Day.
My quote below suggests that no matter what I shall be happy however today is not one of those days. I am looking at how much I have accomplished and still looking at so many things that need to be accomplished and might I had I may not have the courage or the strength unless I draw some from you all. I miss my mother, my grandmother, my brothers, my friends, my colleagues and most of all I miss my country. Do not take for granted the things that you have today as you never know when they will be taken away from you.
I just want to take this time to remind us all that let us not believe that our labor will be in vain but in the end, we shall continue to accomplish great things.
Both days share significance for both countries and while Jamaica celebrates Heroes Day instead of Memorial Day, it is necessary to remember that there were many among us that has gone before us as they labored for our rights and freedom and liberty and justice for all. Some of those included members of the LGBT, Religious, and Political communities among others.
Let us put aside our personal biases and remember them, those present and past, and stand to honor them as they had fought and continue to fight the good fight.

GAYS WON'T BOYCOTT JAMAICA - Will not encourage tourists to shun the island

Gay rights group EGALE has decided not to call for the boycott of Jamaica as they had previously threatened.
In a release Tuesday, the human rights organisation said it would not suggest that Canadians shun Jamaica as a tourist destination but added that they would continue their campaign against perceived homophobia here.

"We will continue to raise the level of education, and awareness around homophobia in Jamaica, and continuing to fight for sexual freedom on the island and the right to live free from fear as a queer in Jamaica," Egale representative Akim Ade Larcher said.
In March, Egale, a Canadian group, issued an ultimatum in an open letter to Anne-Marie Bonner, Jamaica's consul general in Toronto.

Buggery laws

In the letter, spokespersons for Egale, along with Rev Brent Hawkes, said they wanted the Government of Jamaica to produce public service announcements denouncing homophobic/transphobic violence.
They also called for a national homophobia/transphobia education campaign, and the repealing of the buggery laws and other legislation that further stigmatise, discriminate and criminalise consensual same-sex acts.

Same-sex acts

In the letter the group had promised to make a public announcement on May 17, the International Day Against Homophobia, calling for, among other things, a Canadian Tourism boycott on Jamaica and a blockade of goods and services from here.
However, earlier this week Egale, while promising to continue its campaign, refrained from advocating a boycott.

"We have a responsibility to continue to educate the Canada LGBT (lesbians, gays, bi-sexuals and transsexual) community on countries which criminalise same-sex acts and we also have a responsibility to LGBT Jamaicans who have sought refuge in Canada to tell their story of persecution and violence whilst in Jamaica. Every Canadian citizen can then make an informed choice whether to travel to such countries," the release stated.

Egale's decision had come after Bonner had sent an official response to the group last Thursday. In the response she stated that the Jamaican Forum for Lesbians All-sexuals and Gays (JFLAG) did not support a boycott of Jamaica's tourism and trade. She added that the Government has taken action to reduce incidence of violence by the security forces and condemns all forms of violence.

Strong condemnation

"You would be aware of the public statement issued by the government on 14th April 2008 reiterating its strong condemnation of mob attacks and violence against any individual or groups for any reason whatsoever," the statement said
The statement added, "The Constitution and laws of Jamaica provide protection and rights for all. There is not an intention to write into the Constitution specific reference to any particular group, as all groups and individuals have equality under the law."

Stop Murder Music Canada (SMMC), the group organizing the boycott, cancelled the action after receiving an official response from Anne-Marie Bonner, the Jamaican consul general.

The response refuses to specifically recognize gays and lesbians as a protected group in Jamaica's constitution and doesn't even mention repealing laws against homosexuality.

But Akim Larcher, the founder of SMMC, says the response was enough to call off the boycott. The response was dated May 15, three days after the deadline set by SMMC.

"The letter may not suffice in every respect but it is definitely a step forward that they see a responsibility to protect their citizens," says Larcher. "There are quite a number of positive things, especially around police and law enforcement."

SMMC — a coalition of groups including Egale Canada and the Metropolitan Community Church of Toronto — had demanded that the Jamaican government immediately denounce homophobic violence in the country and begin work on repealing laws criminalizing homosexuality, including sexual orientation in the Charter of Rights and developing education campaigns for the country and for the police.

Bonner's response doesn't specifically address any of those demands, although it does address questions of police accountability and structural reform. She writes that she wants to "draw attention to some of the relevant actions being taken by the government of Jamaica:

"A bill for consideration by Parliament at this session to establish an independent authority to have statutory responsibility for investigating instances of abuse by members of the security forces;

"A bill to establish a special coroner to conduct speedy inquests in cases where a citizen dies at the hands of agents of the state...

"Budget provided for continuation of the Citizens Security and Justice Program (CSJP), which had a positive impact on community strengthening and crime reduction."

The Jamaican Ministry of National Security describes CSJP as a "national crime and violence prevention strategy."

Bonner writes that "The government is focused on the need to dramatically reduce the incidence of crime in the country, regardless of cause.... You would be aware of the public statement issued by the government on Apr 14, 2008 reiterating its strong condemnation of 'mob attacks and violence against any individuals or groups for any reason whatsoever,' whilst underscoring the obligations of the state, in particular the police in such cases.

"In the context of your specific concerns it is to be noted that the constitution and laws of Jamaica provide protection for the rights of all. There is not an intention to write into the constitution specific reference to any particular group, as all groups and individuals have equality under the law."

Larcher says he is not disappointed by the letter's failure to mention homosexuality.

"That was totally pretty much expected," he says.

Larcher admits that the defiant response of Jamaican prime minister Bruce Golding also made SMMC think twice about a boycott, as has the possibility Golding may soon call a snap election.

On Apr 23 Golding told reporters asking him about a possible boycott that he had "seen nothing yet to convince" him to repeal Jamaica's antisodomy laws, saying, "There is a road down which I'm not going to allow this country to go under my leadership."

But Larcher says the boycott call has had positive effects.

"It has not left us where we were," he says. "It's forced the Jamaican government to face the issue head-on. It's put them on alert. In terms of the international support it has raised the level of support."

Larcher says SMMC will try to force the Canadian government to use its trade relationship with Jamaica to effect change.

"We will continue to raise the education level here in Canada," he says. "We will continue putting pressure on the government here to raise human rights and sexuality in the current situation in Jamaica."

Bonner's letter also makes reference to the Jamaica Forum for Lesbians, Allsexuals and Gays (JFLAG) — the country's queer lobby group. It is, in fact, the only time the letter uses any words to do with homosexuality.

"You would, I am sure, be aware, that the Jamaica Forum for Lesbians, Allsexuals and Gays does not support your strategy for a boycott of Jamaica's tourism and trade...." she writes. "It is to be assumed that, naturally, the views of the persons whose interests are ostensibly being promoted will be respected."

"We are continuing to have an ongoing dialogue with JFLAG," Larcher says. "We are going to try to provide more strategic support for them."

The program coordinator of JFLAG says the boycott proposal has led to additional homophobic violence.

"We've had about four cases [of attacks attributed to the boycott] which have come to us," says Jason MacFarlane. "Our perspective is still the same. A boycott is not helpful, especially since the prime minister has made a statement that he won't be going down that road."

Travel agents say that a tourist boycott was not likely to have a major impact anyway.

"I'm not sure if they're getting a lot of queer dollars so I'm not sure how much impact a boycott will have," says Deb Parent of Toronto's Conxity travel agency.

Parent also says a boycott might have hurt gay Jamaicans more than it helped them.

"There are many poor countries around the world where poor queers are part of that tourist economy," she says. "It might be better to actually make a point of going and hanging out with queers who are on the front line in a way that I, as a Canadian, am not."

John Tanzella, the president of the Florida-based International Gay and Lesbian Travel Association, agrees a boycott would accomplish little.

"Zero," he says. "If anything it's going to hurt the gays and lesbians in Jamaica who are trying to survive on visits from gay and lesbian visitors. It wouldn't be proper for us to go against the wishes of the local gay organization. It would be kind of arrogant."

California Marriage Decision

SUMMARY OF CALIFORNIA MARRIAGE DECISION:

What happened today?
The California Supreme Court struck down all language in California's state laws excluding gays and lesbians from marrying. They ruled that marriage is a right that must be made available to gays and lesbians. The ruling applies only to the State of California.

What does the ruling mean?
California today became the second U.S. state, after Massachusetts, to legalize same-sex marriage.

When will the ruling take effect?The Court ordered that the State of California implement its ruling "forthwith." Unlike Massachusetts, the issue was not referred back to the state legislature. The Court is requiring the state to move quickly to implement its ruling.

Can today's ruling be overturned?
Not by the courts. But right-wing activists have announced plans for a state initiative for later this year in which Californians will vote on an amendment to the state constitution. The proposed amendment, if approved by voters, would overturn today's court's decision. This has been in progress for some time -- and has already been qualified for November's ballot. A major battle will loom in California over the next six months to defeat the amendment.
Gov. Schwarzenegger has already announced he opposes the amendment and will uphold the court's ruling.

What was Troy Perry's role in this case?
Troy and his spouse, Phillip, joined with Robin Tyler and her partner, Diane, to file the first marriage lawsuit in the California courts. Their lawsuit asked the State of California to make marriage available to gays and lesbians and to legally recognize same-sex marriages performed legally in such places as Canada. (They won both of their requests in today's ruling.) Shortly after they filed their lawsuit, the City of San Francisco issued marriage licenses to LGBT couples -- that situation ended up in the courts. Troy's case was combined with the San Francisco case when it went before the California Supreme Court.

"(R)etaining the designation of marriage exclusively for opposite sex couples and providing only a separate and distinct designation for same-sex couples may well have the effect of perpetuating a more general premise - now emphatically rejected by this state - that gay individuals and same-sex couples are in some respects "second-class citizens" who may, under the law, be treated differently from, and less favorably than, heterosexual individuals or opposite-sex couples." (from the opinion authored by Chief Justice Ronald M. George.)

Is there anyone out there that in the physical body seem to be in good health but when you exam the mental and Spiritual areas in your body and felt so much pain and sickness? I have my hand raised! At times I can not understand why I have awful dreams that result in night mares.

So today I noticed an act that I did the night before. Some web sites and even things I watch open a small door crack and allow Satan to creep in and cause havoc! So be mindful of what you guys are watching and listening to!

This morning I anointed my and noise with oil and went into prayer. There is a battle in your mind rebuke Satan and his ideas and suggestions replace it with the Holy Spirit and the Truth the living Word of God! Be blessed and highly favored!

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues


If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
