Gay Robbery case mentioned ...........

Among the drama that unfolded some time ago was also an alleged homosexual who was reportedly among a group of 15 homosexuals and cross-dressers who tricked a motorist in New Kingston in the wee hours of the morning and robbed him of his valuables and cut him on his hand in January continued in court last week.

The accused, Barrington Mellington, 20, of Belvedere, St Andrew, appeared in court in January on charges of robbery with aggravation. The matter was heard last week again.

The court heard that the complainant was travelling in his motorcar long Trafalgar Road last December about 2:00 am when he heard an unusual sound coming from the left side of his car. The motorist reportedly parked the car in order to investigate and saw that his fender was missing, and he began a search for it.

He reportedly saw a group of men who asked him what he was looking for and when he answered they told him that they had thrown it over a nearby park.

The complainant reportedly went to the park and was held up at knifepoint by the men, who robbed him of his BlackBerry phone, $70,000 worth of jewellery and $2,500 cash.

The court also heard that the complainant received a cut on his hand during the reported robbery.

Following the robbery, the complainant reportedly saw Mellington and pointed him out to the police who arrested him.

But Mellington's attorney, Tonnelle Beecher, denied her client's involvement in the robbery and questioned how the complainant was able to distinctly identify her client out of the group, and why he was the only one who was identified.

She also sought bail for him but the request was refused.

He was subsequently remanded in custody until February 15 and was granted bail since, the matter is said to be mentioned again next month.

Issues such as this is what makes the whole homeless MSM saga in New Kingston in particular problematic as persons who would want to assist when hearing this other issues refuse or are very hesitant in doing so.

Also as we say in Jamaica the good suffer for the bad in this instance as there are persons who want to donate or get engaged but have simply changed their minds and gone to some other charity or so. A robbery as well in the Cross Roads are two weeks ago has had some fiery reactions as well as there are some who intend on enacting revenge for the matter who allegedly robbed a young man who is the the partner of a popular socialite on the LGBT scene. There is said to be a watch out for the accuses who is said to be also linked to this matter that is in court, things have been spiralling out of control yet in Kingston as only on March 21 as well a group said to be seeking asylum on behalf of some of the homeless youngsters in New Kingston tricked the men into appearing on camera and posting the item online.

Here is another account of the matter as appearing on another blogger's page:

The call came in at 10 pm. “Hi, Amy, I’m at the police station.” I got dressed and headed to the New Kingston police post. “It’s prickly there,” the taxi driver told me as I paid him the fare well ahead of my drop-off point. At the entrance, the police outside nodded for me to go in. Walking in, I made eye contact with Jermaine and asked what had happened. But before he could respond, I was ushered into a separate room with an elderly woman. The commander introduced himself and the inquiry began. How did I know Jermaine? What do I know about the laptop in question? I answered how I knew Jermaine and described the laptop that I had given him. What was on the laptop? Nothing, because I had wiped it clean of files before giving it away. Reply: It’s common to wipe stolen computers.

As another officer ranted about the gully kids making trouble, I noticed what seems to be a tug of war between police, who have attempted to drive out the youth from the sewers, and the homeless youth who refuse to leave the sewers, or gullies, where they have been residing for years.

As the policemen inspected the laptop in the backroom, the elderly woman introduced herself as Yvonne who works with Jermaine in outreach to the homeless LGBT youth in New Kingston. That night, it was explained, Jermaine was arrested, after a house break-in report described street youth with yellow T-shirts. Jermaine was wearing a yellow shirt and his volunteer badge.

After matching my description of the laptop with their own inspection, the police returned the laptop. I thanked the commander and explained that the young man suspected of theft was making an effort to help youth get off the street. The commander whisked off to another incident needing attention and the night ended with the laptop back in the possession of its owner.

I didn’t understand why the police didn’t question Jermaine directly on the contents to verify ownership of the laptop, but the experience had upset him. Overall, it was quite a night with my first encounter with the Jamaican police.

So here we go again with drama and a younger set of gay/trans displaced/homeless persons, where will it ever end or at least slow down?

A Male Whore ........ who defines him & perceptions

Prepared By Jerry Gay

In the heterosexual community a man is never truly seen as a whore. If he is dating and having sexual escapades with several women at one time, he receives a pat on the back as being a "ladies man", but the same can't be said for a woman. If a woman dates several men at one time, and sleeps with a minimum of two men within a certain period, she is considered a whore. So why is it that a woman can never take charge of her sexuality, but a man can? On the surface of this topic, some people believe that the act of being penetrated is more intimate and sacred than the act of being the one who penetrates.

There is also this image we have of women being held to different standards because of their roles in society. They are the ones who bring life into this world, and there is nothing more damaging to a woman than for her to not know who the father of her child is. I'm sure you've sat through those more-than tired episodes of Maury, and the guest who've slept with 15 different men, claim they are 1000% sure; didn't know someone could be 1000%, and in the end run off stage and curl into a ball because none of those men are the father. But all of a sudden she thinks she knows who it is...ho please.

A woman who sleeps around essentially has more to lose than a man. If she gets pregnant, she has to raise that child for 18-years, while a man has the option to run away from his responsibility, at least in the physical aspect of the situation. So if a woman's role as being the bearer of life is the primal reason why she can be a whore, but her cheating ass boyfriend can't, how does that translate into the gay community?

After all a bottom cannot give birth, so why is it that bottoms and versatile men can be whores, but "strict" tops can't? I don't believe in sexual-position stereotypes, neither do I believe in gender-role stereotypes. A man can be a whore and so can a woman, just as a top, versatile, or bottom can be a whore as well. It's amazing to me how many tops are quick to call someone a whore, in some cases in reference to the same bottom they screw on a regular, but what does that make them? You've slept with just as many men as he has, sometimes for sexual gratification, other times for monetary gain, and in fact you probably have slept with the same amount of men as he has-if not more.

I view a whore as not being defined by how many men someone has slept with, but more about the amount of time that has passed between these men. If on Monday you sleep with Bryan, Charles on Wednesday, Marvin on Thursday, and Antonio and Vincent on Saturday; you are a whore. Now if your sexual liaisons with these men are spread out over a 6 or 12 month period, you would not be considered to be a whore. Everyone who engages in sex accumulates numbers over the years, it's normal. In your quest to find Mr. Right, you're dating different men, searching for compatibility in all aspects including sex, and sometimes things workout, other times they don't. Add those dating situations with your occasional hookup, and the numbers add up quick over a long period of time.

Some people believe that anyone who has sex is a slut to some degree. Nathan DeGraaf of Points In Case, believes in this exact theory, breaking it down into the Four Levels of Slut: The Sexually Liberated [Man], Garden Variety Slut, Cheating Slut, and the Money Grubbing Slut. After going through a really bad breakup he compiled this list, so let's see in further detail which level entails:

Level One: The Sexually Liberated [Man]
According to DeGraaf this man is not necessarily a slut, but he gets called a slut because he enjoys sex. He is classified as someone who doesn't have a boyfriend, or as someone who is in an open relationship. He doesn't involve any emotions when he engages in a hookup, because all he wants is sex, and the rest he can live without. He doesn't feel the need to settle down, as he is comfortable in his current state of his relationship status. Whether that be single or attached to a man who approves of him having affairs.

Level Two: The Garden Variety Slut
This guy doesn't have a boyfriend either, but leads men on, using his charm, and sex appeal, to lead them into thinking that one day-they will be in an exclusive relationship. He has no problem engaging in sex with several men at one time, and making each one feel like they are his knight in shining armor, their long lost soul-mate. He enjoys what he's doing, and at times will purposely set up situations where the men he's leading on, may run into each other, resulting in a physical or verbal exchange. A scenario that is not only entertaining for him, but increases his self esteem.

Level Three: The Cheating Slut
This category is broken down into three subcategories. The man who cheats on his lover of a few months-just because he can, but never lies about it and comes clean. The man who cheats on his boyfriend of a few months, never tells him, and allows him to find out through another party [ie: friends, associates, or the guy he cheated on his lover with]. The third subcategory deals with a man who has been in a relationship for years, but has been unfaithful the entire time, and never comes clean.

This level is the one that comes to people's minds the most when they think of someone being a slut. The reason why this is the most potent of the four levels is because of the motivation behind the cheating, not the act itself.

Level Four: The Money Grubbing Slut
The men who fit into this category can either be single or in a committed relationship. Those who are committed, are often in relationships where all of their needs are not being met, specifically the financial one. This guy usually doesn't make enough money himself to live a comfortable lifestyle or the glamorous one he feels he should have. His lover doesn't make enough money to lavish on him, but he holds onto him because he's great in every other way. So what does this cheater do? He finds some other man to buy him all the superficial things he needs, and in return offers up his sexual services. This is the worst type of whore for some because they don't care about love, they are only concerned with money.

I've never had an issue with anyone who sleeps around and does it safe and honestly. But if you're in a relationship, having sex with other men just isn't acceptable. Sleeping with multiple men within a short period of time, is not the behavior of a gentleman. Knowingly sleeping with someone who has a significant other is straight trashy. And of course if you're a Top, don't act like you are the almighty God because of your sexual position, and therefore you cannot be labeled a whore. Although the definition of a whore and who can be one varies in people's opinions, according to Merriam Webster-in black and white it reads, a woman who engages in sexual acts for money; a male who engages in sexual acts for money.

Being seen as a whore can be detrimental to one's self-esteem, due to other people's harsh judgement. We've all seen the club whore who enters the building, and every dude seems to know his name. Not only do they know his name, but they know what he looks like naked-in every position imaginable, how warm his mouth feels, how rough he likes to be fucked, the moans and groans he makes during sex, and how he handles himself after the one-night stand has concluded. If you don't want to be seen as a whore, there are several things you can and must do to change other people's perception of you, whether they are right or wrong.

You must first come to the realization of who you are. If you find yourself constantly searching for a new piece of dick or ass, sleeping with several different men within a short time-frame, looking for men outside of your city due to the fact that you've slept with all of the ones in your zipcode, or often you find yourself forgetting the government names of the guys you've slept with and only knowing them by their usernames; you may be a whore.

If you're always talking about your sexual adventures, what do you think people are going to think about you? That you are a cum bucket! Whether these are men you've been sleeping with for years, some of whom you've actually tried to build a relationship with, or random hookups, keep your sex life confidential. A gentleman shouldn't kiss and tell about every detail, with every man, save something for yourself. Find other things to discuss with people other than the date you went on the other night, or how many numbers you got at the club last week. These type of conversations lead people to form their own opinions about who you are, even if you've never slept with any of the men you met at the bar.

Never sleep with people who are part of your inner circle of friends, co-workers, classmates, acquaintances, or mutual friends-of-friends. Just because you don't discuss your sex life, that doesn't mean that the other person you've slept with holds themselves to such a standard. If you want to get your freak on and still be viewed as being "holier than thou," sleep with people you or your friends don't know.

If you are receiving a lot of negative attention, being labeled a whore, and can't understand why, look closely in the mirror. What are you doing to make people think this way? Is it the way you dress? The stories or jokes you tell that are always saturated in sex? Is it that your online social media profile is filled with nothing but ass and dick photos?

Look at the company you keep. Think about it, if you surround yourself with whores, what do you think other people's perception of you are going to be? Chances are, you'll be labeled as such.

Start to think of yourself as more than a sexual being. Some times when we hear other's call us "sexy" or "hot" we internalize it as meaning that is all we are good for, therefore we unknowingly act in such a manner. Instead of seeing yourself as sexy, refer to yourself as handsome. Don't think of yourself as something people use, and then toss into the trash when it has expired. You are a product of God, therefore you are worth more than "sexy".

Flirting is always fun, and harmless when done correctly, but when it is filled with sexual filth, it becomes vulgar. Smile, wave, laugh- these are easy and non-sexual ways to still flirt, and let someone know that you are interested in them without being perceived as "easy".

If you find that your behavior becomes more sexual when you are intoxicated or under the influence of other substances, than cut-back on those activities. Not only are you putting your reputation at stake, but you are also putting your health at risk by participating in risky antics. You shouldn't have to ask your friend what you did last night, or not remember kissing several men at Club XL, while being bent over on the middle of the dance floor. Remember we are gentlemen. who hold ourselves up to certain standards.

Bottom line, when it comes to your reputation, only you can control how you are perceived when it comes to people labeling you as a whore. Be mindful of your actions, your words, and those around you.

American millionaire pastor Recalls The Days When Gays Were Stoned To Death, Blames Satan For Gay Rights

On the US TV show the 700 Club March 26th, Pat Robertson said that Satan is behind homosexuality and that Jesus wouldn’t have served gay couples since they would have been stoned to death.

I nearly got into a heated debate as well as it came on local cable source here in Jamaica with my sister in law's sister who is well aware of my sexuality and saw the clip, she claimed that the owners of the bakery shouldn't be forced to serve them, Obama is going straight to hell and that "they" should stay where they are but refusing to look at the lunacy of her argument specific to the bakery matter as the sexual orientation or whatever one thinks of the customer is immaterial it is the service that or ought to count.

Robertson made the remarks following a report on a Colorado baker who was sued for refusing to serve a same-sex couple and the controversy over Arizona’s so-called “religious freedom” bill. The segment included interviews with the baker, his attorney, a sympathetic customer and three conservative activists. It didn’t feature any interviews with people defending the gay customers.

“I think you got to remember from the Bible, if you look carefully at the Bible what would have happened in Jesus’ time if two men decided they wanted to cohabit together, they would have been stoned to death,” Robertson said. “So Jesus would not have baked them a wedding cake nor would he have made them a bed to sleep in because they wouldn’t have been there. But we don’t have that in this country here so that’s the way it is.” (Robertson’s claim that Jesus would never have encountered a same-sex couple is a matter of debate.)

Robertson added: “Ladies and gentlemen, I think we have to recognize what I said a few years ago, at that point homosexual marriage was condemned, homosexuality itself was considered a pathology and now those that are practicing that activity have turned and become the oppressors of those who hold deeply-held religious points of view, the tables have turned.”

“What is it about gays? What is it about abortion? Have you ever thought why they’re on the forefront right now? Both of them deny the reproduction of human species,” Robertson said, adding that homosexuality is “a meaningless exercise because it doesn’t go anywhere.”

“The Devil is trying to say, ‘I’m going to destroy your progeny any way I can. If you will kill your babies, that’s fine, I’m with you; if you will deny the chance of having babies, that’s fine too; but I want to destroy your opportunities to reproduce,’” he said. “It’s a very serious thing and we’re not talking about it, and we need to as a society, we have to realize where the attack is coming because it is definitely an attack.”

Co-host Wendy Griffith agreed: “The Devil wants to steal, kill and destroy. Well said Pat.”

- See more HERE Sadly this is the paranoia that continues to go out there and the LIE embedded in all of this is that the implication is that JESUS would have stoned gays or he would not have "baked them a wedding cake" is this man for real?

I was of the opinion that Jesus came for the outcasts and rejected yet going by this piece Pat Robertson in his world would be preaching to the so called converted and staying rich while at it too. Is it the devil that has also infiltrated God's handy work that nearly 400 other species out there also display clear homosexual tendencies or orientation for that matter?

Are or were all of us supposed to procreate .......really!?

That's is the only reason why we are here?

There maybe some deception yes in lobbying for rights but so is it is also in religion with capitalists such as Pat Robertson who sit infront of a camera daily making pronouncements yet we do no hear of his mega millions making network helping the poor; it is so easy to push hate from the pulpit in the name of God but the real work with those downtrodden you will never see these folks getting their hands dirty, oh no.

Home
Thanks to RWW for bringing this one to our attention, the stupidity out there sometimes is just mind boggling. I am still in the mindset of Christianity as my religion in a sense but the versions we are seeing as of late with fear mongering with side shouting at each other instead of listening and understanding what it is that is being objected to is sometimes laughable.

How can we ever get anywhere if all sides are holding their own refusing to budge then sooner or later the predicted doom must come as parties draw for more divisive means to win their arguments. Locally we are no different with some of the rhetoric from powerful pastors some of whom are aligned to various political parties and then we wonder as said parties pander to the gallery delay rights and recognitions due as Clovis's cartoon from the Jamaica Observer shows some time ago, take into account the characateur of the gay man, the other clip below published March 23, 2014 that however is a different matter as while one can agree the church has been silent on several issues where it ought to speak but the gay overrun Jamaica window is so off base .

Will we ever see true tolerance from the religious community in a large scale?

Pirates' Cove named as base for "homosexual prostitutes" KSAC asked to address homelessness by UDC

So as the landscape changes continue down-town imposing on the cruising, transactional sex populations and public order domains in Kingston a Gleaner article on Sunday March 23, 2014 entitled Play, Pot & Prostitution which spoke to the water front area, outdoor sex and the use of public space for recreational purposes but a police officer named in the piece said that the old Pirates' Cove just across from the Ministry of Health building as a haven for drug dealers/users and non violent homosexual prostitutes.

You may have heard me mention the down town waterfront in previous podcasts and posts where homeless MSM also use now comes the matter full front as the toss up between welfare and public order is before us in as far as MSM homelessness is concerned.

The article read in part:

Compromising positions

There, the occupants of the motor vehicles seldom open the doors, not to mention exit after parking. The windows of the vehicles, if not all the way up, are only slightly down with hands pushing from inside the vehicles only to dispose of unwanted garbage.

Visits to this car park are usually on a short-term basis and if one looks closely couples can be seen in compromising positions.

The old Pirates' Cove building, in its run-down state, serves as a home and a makeshift toilet to vagrants.

On other occasions, the building serves as base for homosexual prostitutes and drug dealers.
Marijuana can also be purchased around the waterfront with sellers available well into the dead of night.
The police are aware of most of the activities which take place at the waterfront at nights and are working hard to clean-up the area.

"We know for a fact that there are gay prostitutes out there, but most of them are non-violent," said Superintendent Victor Hamilton, the officer in charge of the Kingston Central Police Division.

Hamilton added that female prostitutes also do business in the area and drug addicts visit to get their fix. However, Hamilton argued that the problem is not as rampant as in yesteryear.

"What is a recent problem now is the illegal gambling. People sit around the concrete benches and gamble, and that is something that we have been dealing with," said Hamilton, as he accepted that some of the actions on the waterfront could hamper the development processes.

"It is still a relaxing area. People still find it a place to be, and many families come down there, especially on Sundays to cool out," continued Hamilton.

According to the senior cop, at least one police unit is assigned to patrol the strip at nights.

In some cases, that unit is joined by other patrol teams en route to their locations.

"I always encourage them to turn on their (flashing) lights. This is a deliberate method to increase visibility. It also wards off persons with criminal intent," explained Hamilton.

That was confirmed by The Sunday Gleaner as during recent visits to the area our news team saw regular police patrols.

Sometimes, the police unit's blue flashing lights were turned on, while the driver parked the vehicle inside the parking lot where the families stay.

In the meantime, general manager for the UDC, Desmond Malcolm, said while he is aware of mentally ill and homeless persons wandering the area, he was not aware that it also attracts drug addicts and prostitutes.

"We would like a more comfortable setting down there, but we do have some social conditions today, persons with mental-health issues, and such," Malcolm told The Sunday Gleaner.

"So there is the issue of persons drifting. We are aware of that and the plans for downtown does not exclude them.

"But things are looking up. As are far as vagrants are concerned, it is a question of people occupying the place. My experience is that once that place keeps on being populated (with visitors) there is a tendency for the so-called vagrants to drift."

Malcolm said the UDC has already requested assistance from the Kingston and St Andrew Corporation (KSAC) and other private companies to deal with these vagrants.

The KSAC has also been asked to provide nightly shelter for the homeless.
Malcolm explained that there has been increased interest in the area from corporate entities in the past two years, but noted that there is hardly any space there for additional construction.

ENDS

This is in keeping with the subsequent disappearance of other spaces along that very stretch going westwards to the Craft Market (or beside the police station) where to date homeless populations still reside despite the erection and opening of the Digicel head quarters; so all major "hide outs" are now gone and the last major cover is now blown.

popular figure from the homeless MSM by the Office Centre Building close to the Pirates' Cove old building, the management of the OC building have since employed canine security teams to ward off the men and other miscreants.

meanwhile designated spaces for shelters remain abandoned as this sign on upper King Street shows. Where are the populations to go with a state slow to respond to these issues save and except when power brokers want space and so on.

War of words between pro & anti gay activists on HIV matters .......... what hypocrisy is this?

A war of words has ensued between gay lawyer (AIDSFREEWORLD) Maurice Tomlinson and anti gay activist Dr Wayne West as both accuse each other of lying or being dishonest, when deception has been neatly employed every now and again by all concerned, here is the post from Dr West's blog entitled:

Posted on March 20, 2014by testifyingtotruth

It has been brought to Testifyingtotruth ‘s attention that the following item was

posted on LGBT activist Maurice Tomlinson’s Facebook page today, Thursday

March 20th.

In the post Tomlinson accuses Dr. Wayne West, Chairman of the Jamaica

Coalition for a Healthy Society (JCHS) of deliberately lying and doing bad

science for stating in the JCHS affidavit for the court case reviewing Jamaica’s

buggery law that“ anal sex is inherently infectious”

Paragraph 53 of the JCHS Affidavit states :
” The Coalition counters that the burden and impact of HIV on men who have sex with men stems from the inherently infectious practice of anal penetration. I exhibit hereto marked Exhibits WW20a and 20b, excerpts from the NAM (National Aids Manual) AIDSMAP (UK) http://www.aidsmap.com/Anal-intercourse/page/1323531/, accessed February 19, 2014, which reports that unprotected anal intercourse carries a higher risk of sexual HIV transmission than unprotected vaginal intercourse. “

Dr. West states that Tomlinson’s correction is valid and duly noted and that the

item should have read ” the inherently risky practice of unprotected anal

penetration”.

Readers of this Blog can rest assured that Dr. West and the JCHS will and are

already seeking to effect the necessary correction.

SANCTION UNETHICAL BEHAVIOR BY DR. WAYNE WEST:

Dr. Wayne West is a radiologist. He is also head of the Jamaica Coalition for a Healthy Society, a fundamentalist religious group that is opposed to the recognition of the human rights of LGBT Jamaicans. Dr. West has consistently used his medical credentials to push his anti-gay agenda, even resorting to blatantly unethical behaviour, for which I personally think he should be disciplined by the University of the West Indies, Mona where he works, as well the Medical Association of Jamaica.

In court documents opposing a repeal of the Jamaican anti-sodomy law he states that anal sex is inherently infectious. This blatant lie could be excused because, after all, Dr. West is NOT an epidemiologist. He therefore does not specialize in the science of how infectious diseases are actually spread. HOWEVER, his statement is at best unresearched hogwash, unworthy of the academic standards of the university, OR at worst, constitutes ethical misconduct of the highest order.

The FACT which ANY medical practitioner MUST know is that it is UNPROTECTED anal intercourse with an INFECTIOUS partner which is “inherently infectious.” By West’s logic, simply having anal sex will transmit HIV! Not true. If neither person is infectious (i.e., negative for HIV or if positive is on effective ARV treatment) then the risk evaporates. Further, if the inserting partner uses a condom, even if they are infected, the chances of transmitting HIV are significantly reduced. Instead of admitting this simple fact (which he has been PUBLICLY called out on, even by non-scientists) West persists in repeating his lie, and has even sworn an oath to it! He is, in my humble opinion, an unrepentant bigot who wants to stigmatize and demonize gays.

I call upon the University of the West Indies to reign in this fundamentalist lose cannon, or forever risk having their good name tarnished by being associated with sham science.

Now comes a status entry by Mr Tomlinson

This is laughable to me as both gentleman have broken the ethical lines of advocacy respectively repeatedly especially on HIV/AIDS and on legal matters concerning LGBTQ issues, only recently Mr Tomlinson denied that he has not made a decision to appeal the Supreme Court decision in his case against three TV stations

yet his employer and attorney's have been quite clear on their decision to appeal. Then there is the bizarre revelation that in the said trial he changed his plea in the middle of the hearings with regards to the PBCJ. Then there is the matter of using old narratives in as far as MSM not havng access to safer sex implements on national television which was denied by the other persons in the said interview on CVM TV, see: Unimpressed with the CVM TV show on MSM Homelessness

The September 6th 2011 appearance of representatives from The National Council of Drug Abuse and AIDSFREEWORLD's Maurice Tomlinson to address the recent public eviction of homeless MSMS from Cargill Avenue was at best damage control to another embarrassment regarding the poor response from the relevant LGBT agencies. JFLAG WAS NOT PRESENT AT THIS CVM TV LIVE @ SEVEN Program The attempt to use old programmatic language by Maurice Tomlison to suggest MSMs have no access to condoms while the CVM newscast itself showed the movers holding the condoms in their hands they found on the site and saying the men were practising safer sex should be instructive to ALL in view.

Alleged Gay advance upsets 'loader man' in Half Way Tree

A typical coaster bus interior used for fast movement of passengers in peak hour traffic which as sometimes overloaded with standing passengers or five passengers to a row of seats designed for four

A 'loader man' (men or a few women who fetch or try to get would be passengers on buses waiting in queue for a fee or sometimes subtle extortion) who used a machete to chop a man in his back, told the court that he did so because the man made a pass at him which he did not like.

"This youth a move like him like me and waan mek love to me," said Ryan Duffus, who appeared to be still upset over the incident.

Duffus told the court that he was in Half-Way-Tree loading a bus when the young man approached him. He said an argument developed between them, the man punched at him and he took out his machete and slapped the man across his back and shoulder.

"Negative thing me nuh work wid," he added. "Me nuh waan nuh man feel like seh dem waan have sex with me."

Duffus, who was taken into custody following the February 18 incident and charged with unlawful wounding, was remanded in custody for psychiatric treatment.

However, on Thursday the magistrate, after reading his medical report, encouraged him to continue taking his medication and made a no order ruling in the matter.

It is not the first time we have seen Half Way Tree original bus park where the franchise coaster buses use as scenes for issues with gay accusations and tiffs between downlown males versus more out ones. It has been rumoured for years that several of the loaders and bus crew are involved in sexual liaisons (not suggesting such in this matter) but one has to wonder as the town centre is a hub of all sorts meeting and crossing paths.

In 2011 a "gay joke" that went wrong also led to a tussle in the western side of Half Way Tree by Molynes Road that I had witnessed then and was posted here, at the time I wrote "Several of these coaster buses were on the stand with callers or loaders beckoning to passers-by during peak hour a man who approached the bus in question on which the gay joker was conducting looked in by the door but hissed his teeth and moved on to stand elsewhere apparently not pleased with the seating he desired, the conductor and the other loader men as is sometimes customary do not take kindly to such open refusals or ignoring from members of the public when they invite you to the bus of activity at the time and proceeded to describe the man as stush (selective) and probably gay as he was well dressed, the teasing among the loaders now numbered three (an intimidating form to get passengers) and the conductor commenced in typical colourful Jamaican fashion but when the conductor said that one of the loaders should go ask the "stush" male passenger for a f*** that's where all hell broke out, a shouting match began and more men from across the road joined the throng, not before the now 80% loaded bus started to move off the stand that the mob rushed the "gay joke" conductor, other persons also joined arguing that he was out of order and the "stush" man had boarded a JUTC bus some moments before all this. The angry men left behind following the bus's departure vowed that the bus will not return there to work anymore. I was amazed how this all went down and how a simple matter can blow up in no time."

see more HERE, that same year as well a brawl on a Portmore bus too was carried as well where a man was accused of "ass riding" while the bus was in transit; a featured some men enjoy doing with women but in this case it was a male that was the object of the "ride"

Buju Banton's Boom Bye Bye still available on iTunes despite so called ban in 2008

go here

While going through some archives on murder music for an upcoming workshop I checked online just to see if the song famed for being the most homophobic of all the anti gay songs released from Jamaica was still being sold and to my surprise despite the fanfare of sorts and news of a ban of the song there lies the track listed on iTunes for sale. I have long said that I won't accept from anti gay acts the line that they do not perform the tracks anymore as I know that they are still earning from the music despite removing said offending tracks from live sets. Please do not tell me either that it's iTunes UK that has it, I am not interested in semantics here, iTunes and or their affiliates are one in the same in my eyes.

I say they MUST separate themselves from the materials to convince me that they have changed their course. In 2008 we were told that iTunes had banned the song, the Jamaica Star at the time carried it:

iTunes bans Buju, TOK, Ele - Specific songs and albums removed from catalogue

T.O.K. members from left, Flexx, Craigy T, Alex and Bay C

American company Apple Inc has removed songs from dancehall artistes Buju Banton, T.O.K. and Elephant Man from their iTunes site citing that the songs incite violence against homosexuals.

In response to letters written by the pro-homosexual Canadian-based organisations Egale and SMM (Stop Murder Music) to iTunes in January, iTunes has removed controversial murder music from Jamaican artistes in its North American markets. Boom Bye Bye from Buju Banton, Chi-Chi Man from T.O.K. and Log On by Elephant Man have all been pulled from iTunes stores and the iTunes website.

Apple's iTunes is the leading on line distributor of music in North America through their websites and iTunes stores. Since 2008 over four billion songs have been downloaded since the service first launched on April 28, 2003.

When the STAR spoke with Akim Larcher founder of SMM (Canada) he explained that SMM had written to the two biggest record distributing companies in Canada to pull these songs and songs from other artistes. According to Larcher, iTunes gave a positive response and has not only removed the songs, but the albums they were on, as well as any compilation CD that contained the songs.

In a release issued Mr Larcher said "this is an historic victory for the LGBT community here in Canada and in the Caribbean. iTunes is exercising its corporate responsibility by pulling this murder music and raising the bar for other retailers and distributors to do the same."

Helen Kennedy, executive director of Egale - a national organisation that advances equality and justice for lesbian, gay, bisexual, and trans-identified people and their families across Canada; stated in the release "we are extremely pleased with this decision. We have also contacted HMV, Archambault Inc, and Amazon.ca and we are optimistic that they will follow iTunes lead."

When the STAR contacted Flexx of T.O.K. he was unaware of the situation but not worried that the song would no longer be on the website. "That song came out six years ago in 2002 and is still a problem I guess people are just trying to hang on to get publicity. We have matured as artistes and have done so many other songs, I guess people just love that song" he said.

The song Chi Chi Man was released on T.O.K.'s first album My Crew, My Dogs which will be pulled from iTunes stores. However, Flexx is unworried stating that the album is a classic and they have tons of other songs on iTunes. "Let them try to stop the album, our songs, people have other means of getting music, iTunes isn't the only thing out there" Flexx said.

Stop Murder Music (Canada) advocates against anti-gay lyrics targeting the lesbian, gay, bisexual and trans-identified communities. In 2007 Stop Murder Music successfully launched a campaign to stop concerts in Ontario Canada of artistes such as Sizzla, Capleton, Elephant Man, Baby Cham and Beenie Man.

ENDS

Lest we forget the false apology from Beenieman as well about his songs especially the "All Battyman fi dead" track.

Here is my audio response at the time with that whole fiasco, his response taken from Television Jamaica's TVJ's Entertainment Prime show

They need to pull the track altogether from their repertoire

'IN GOD’S IMAGE' SUMMIT ON SEXUALITY OPENS IN CAPE TOWN - CONFERENCE TO ADDRESS LGBT ISSUES

'In God’s Image' summit on sexuality opens in Cape Town

March 17, 2014 | Cape Town, South Africa | Adventist Review/ANN staff

Nearly 350 Seventh-day Adventist Church leaders, pastors, academics, and human services experts have gathered in Cape Town, South Africa, for a four-day summit intended to help the worldwide Church better address the experiences of homosexuality and alternative sexualities.

Titled “In God’s Image: Scripture. Sexuality. Society.”, the conference at Africa’s southern tip is intended to be “a conversation with key people in the global leadership of the Seventh-day Adventist Church, to gain a greater understanding of the issues surrounding alternative sexualities, and to counsel together regarding the challenges the church is facing in this area,” organizers said.

Each of the denomination’s 13 world divisions has sent a delegation of at least 20 persons composed of senior administrators, theological and social science scholars, and “frontline personnel”—pastors, chaplains, and human resources directors—to the intensive event that begins March 17. Monday evening’s keynote address by world Church President Ted N. C. Wilson is titled “The Truth as It Is in Jesus.”

Pardon Mwansa, a Zambian who is a general vice president of the Church and chair of the headquarters committee that organized the summit, believes that the event is a watershed for Adventist discussion of difficult social and religious issues.

“We are dealing with an issue about which the world around us has already formed a perception,” Mwansa said. “We can’t avoid dealing with this matter because those perceptions affect how we express ourselves. The Church needs to clarify its light: we must say where we are on this matter, so that people will understand us and how we view this subject.”

“We are a moral group—a church—and we have to shine and say just what the light is on this issue.“

Mwansa additionally underscored the importance of the Cape Town conference by pointing to the persons attending. “This is a meeting to which all Church leadership has been invited—and all will attend,” he noted. “The quality of meetings is generally judged by who attends, and here you have all world division officers attending, along with pastors, teachers and human services personnel. The goal is to make sure that what is done here reflects the corporate thinking of the Church.”

The summit organizers are clear that they intend no redefinition of the Church’s historic opposition to all sexual expression other than heterosexual marriage between one man and one woman. Listed first among the summit’s “learning objectives” is the goal to “describe the Bible’s teaching on alternative sexualities.” Two of the conference’s first three plenary sessions focus on how to read and understand the Bible’s teachings about human sexuality, as well as specific passages of both Old and New Testaments that address homosexual behavior.

On Tuesday evening, three Adventists who spent major portions of their adult lives in gay or lesbian relationships will relate their experiences in a plenary session panel. Wayne Blakely, Ron Woolsey and Virna Santos each describe themselves as “redeemed” out of homosexual behaviors, and now lead ministries designed to help others organize their lives according to Biblical norms. Woolsey, now for many years in a heterosexual marriage, is also an ordained Adventist minister.

The denomination’s legal and employment concerns with legislation about homosexuality in various nations will be in focus at a Wednesday morning plenary panel moderated by General Conference general Vice President Lowell Cooper.

Two additional plenary sessions on Wednesday afternoon and evening seek to update the international delegation on latest understandings of homosexuality and alternative sexualities from the perspectives of medicine and psychology. Dr. Peter Landless, Health Ministries director for the world Church, and Dr. Peter Swanson, assistant professor of pastoral care and a licensed psychologist at the Seventh-day Adventist Theological Seminary at Andrews University in Michigan, USA, will address research findings regarding the possible roles played by genetics and social influences in the formation of alternative sexualities.

On Thursday, the summit will focus on ministry to homosexuals and those practising alternative sexualities, and discuss how the denomination will relate to church membership for those not following Scriptural teaching about human sexuality. Dr. Miroslav Kis, professor of ethics at Andrews University, will offer an overview of the ethical issues the Church must wrestle with at both global and Congregational levels as it seeks to be both clear about its loyalty to Bible teaching and compassionate to individuals in various life experiences.

Courtesy Corps officer stabbed to death at home for alleged sexual advance in Western Jamaica

CONFIRMED:

A tourism Courtesy Corps officer (often called tourism police) was stabbed to death at his home in Granville, St James on Wednesday morning, February 5, in what is said to have been over unrequested sexual advances. Dead is Peter Lewis, otherwise “Peaty” 43, courtesy corps officer of Brown’s Lane s in Granville.

Typical courtesy cop uniform in Western Jamaica and now also in New Kingston
Meanwhile the 26-year-old accused, who police say has confessed to the killing, has been taken into custody.

Reports by the police are that about 5:45 am, on Wednesday both men were at a house in Granville when a domestic dispute developed between the two. A knife which was brought into play was used to inflict over fifteen stab wounds to Lewis’ face and upper body. The wounded man was rushed to the Cornwall Regional Hospital where he was pronounced dead.

Reports are that Lewis met up with the accused in Kingston late last year and promised to get him a job with the Courtesy Corps whose members operate from Gloucester Avenue in Montego Bay, St James. It is further reported that the accused went to Montego Bay and had been staying at the home of the deceased for a while now.The accused man indicated that on Wednesday morning he was at the house when Lewis started to act in what he suggested was an inappropriate sexual manner and made several sexual advances toward him.

He further stated that he cautioned Lewis but instead Lewis grabbed hold of him and a struggle ensued. It is reported that a knife was brought into play and Lewis was stabbed several times. The Granville and Freeport police are investigating.

Clear panic defence here is at work I find it strange that both men are cohabiting and then this all of a sudden, In the gay panic defense, the defendant claims that they have been the object of homosexual romantic or sexual advances. The defendant finds the advances so offensive and frightening that it brings on a psychotic state characterized by unusual violence. Such cases come to mind from the past include the Ambassador Peter King matter.

Observer: Man before court for killing alleged homo .... gay panic defense again

Sad that this had to happen but sometimes we may never know the full truth in cases such as this.

Christian group visits homeless MSM/Trans in New Kingston

This account is from Jamaican activist Yvonne McCalla-Sobers, who is chair ofDwayne’s House, the initiative seeking to provide a home for LGBT youths:

Church group visits homeless LGBT youth in Jamaica’s sewers: Love ensues

The Rev. Margaret Fowler, a United Church minister and member of the Board of Directors of Dwayne’s House, is a serious advocate for a change in the overall approach of the Jamaican church towards issues of sexual orientation. So, on Thursday night, March 13, she arranged for a group of Christians to visit the homeless LGBT youth who are living in the sewers of Kingston.

The group, which included persons from across the Caribbean, was attending a regional conference on human trafficking,

Rev. Fowler was heartened that the conference organisers readily agreed to allow the visit to the youth. However, she then wondered how many of the church persons would want to come on the visit, given all the negative stereotypes spread about the youth in the media. The visit would also have to occur late in the night after a very full day of meetings. Members of the group would have therefore been exhausted.

However, at 10:00 p.m. when the bus arrived there were hardly enough seats, as so many persons showed up! The bus was completely packed for the short ride from the hotel in New Kingston to the sewers where the youngsters live.
Rev. Fowler was overwhelmed with the turnout and briefed the group on what to expect, such as males dressed in female attire. She also told them that if they missed the bus coming back, they would have to disclose their earnings from sex work the next morning!

I had prepared the youth for the visit, and they were keen enough to have our liaison, Tyrone, call me a couple of times between 9:30 and 10 pm to check on whether the group was still coming, and on whether I would be accompanying the visitors. The youth were anxiously waiting for us when we arrived.

I had thought about calling Commander Murdock of the New Kingston police post to let him know about the meeting, and decided against it because we were not asking police permission to meet. Further, I did not anticipate any incident that would require police intervention. There was a concern that public anger about the murder conviction of popular reggae singer, Vbyz Kartel, that was handed down earlier in the day might have overflowed on the streets last night. However, a police officer had assured the group that New Kingston would not be affected by any Kartel protest.

So, there we were. The church group was largely female, and Rev. Fowler assured the men that they would be safe from the youth, but if they encountered any harassment, the women would protect them!

The interaction and exchange amazed and humbled me. The churchpersons came with love, respect, and acceptance, and the youth reciprocated. Rev. Fowler started out with some Christian choruses, and our youth sang along with energy that showed how familiar they were with church activity. They also started singing some choruses of their own and the group of visitors joined in.

A member of the church group gave the youth some words of encouragement, based on the Biblical story of the woman at the well. The theme was no condemnation, and freedom to choose. Rev. Fowler ended the evening with a prayer, and the group left behind care packages with toiletries and packages with drink and snacks for the youth.

The behaviour of the youngsters was exemplary. There was hardly a murmur during the meeting, let alone side conversations or any form of distraction. They were focused. During the visit, there were points of engagement and exchanges, such as holding hands and speaking words of love and acknowledgement.

There was brief feedback from the church group on the brief bus ride back to the hotel. One person, a Cuban, openly cried to see the conditions under which our youth exist. Rev. Fowler will have more information on feedback from the group, but she thought the visit had humanised the youth in the eyes of the church group.

The feedback from the youth has been a request for Rev. Fowler to return on the last Sunday of each month. Tyrone told me that the youth said they would like to go to church, but they feel embarrassed when they go. They felt that, after they saw more of Rev. Fowler on their turf, they may feel prepared to visit her church.

My heart is full!

A look at the fear of the feminine (Effemophobia) by Jamaican standards & how it drives the homo-negative perceptions/homophobia in Jamaican culture/national psyche.

After catching midway a radio discussion on the subject of Jamaica being labelled as homophobic I did a quick look at the long held belief in Jamaica by anti gay advocates, sections of media and homophobes that several murders of alleged gay victims are in fact 'crimes of passion' or have jealousy as their motives but it is not as simple or generalized as that.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills

The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard

When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Dr Shelly Ann Weeks on Homophobia - What are we afraid of?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?

It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

The Deliberate Misuse of the “Sexual Grooming” Term by Antigay Fanatics to Promote Their Hysteria

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness

Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Steps to take when confronted by the police & your rights compromised:

a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014

CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

Superintendent Murdock

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

Remember JFLAG's exclusion of the group from that IDAHO symposium on LGBT homelessess? See HERE, how can we ask the same people who only want to academise and editorialise the issue to also try to address their own when they do not want to get their hands dirty but publish wonderful reports as was done earlier this month, see HERE: (re)Presenting and Redressing LGBT Homelessness in Jamaica: Towards a Multifaceted Approach to Addressing Anti-Gay Related Displacement also LGBT homelessness has always been with us from the records of Gay Freedom Movement(1974) to present but the current issues started from 2009, see: The Quietus ……… The Safe House Project Closes and The Ultimatum on December 30, 2009 as carried on sister blog Gay Jamaica Watch. BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM

As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....

a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues

If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Hello readers,

thank you for your donations via Paypal in helping to keep this blog going, my limited frontline community work, temporary shelter assistance at my home and related costs. Please continue to support me and my allies in this venture that has now become a full time activity. When I first started blogging in late 2007 it was just as a pass time to highlight GLBTQ issues in Jamaica under then JFLAG's blogspot page but now clearly there is a need for more forumatic activity which I want to continue to play my part while raising more real life issues pertinent to us.

Donations presently are accepted via Paypal where buttons are placed at points on this blog(immediately below, GLBTQJA (Blogspot), GLBTQJA (Wordpress) and the Gay Jamaica Watch's blog as well. If you wish to send donations otherwise please contact: glbtqjamaica@live.com or Tel: 1-876-841-2923 (leave a message just in case)

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

Originally aired on CVM TV December 8th 2013, apologies for some of the glitches as the source feed was not so hot and it kept dropping from source or via the ISP, NO COPYRIGHT INFRINGEMENT INTENDED and is solely for educational and not for profit use and review. The issue of the pending legal challenge in the Constitutional Court in Jamaica as filed by Javed Jaghai an outspoken activist who happens also to be openly aetheist.

The opposing sides are covered as well such as
The Jamaica Coalition for a Healthy Society
The Love March
Movement Jamaica

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
