Germany clears path to erase convictions of gay men

Paragraph 175

Germany’s Cabinet on Wednesday approved a bill that would annul the convictions of thousands of gay men under a law criminalizing homosexuality that was applied zealously in post-World War II West Germany.

also see: Historical gay sex convictions in New Zealand to be wiped

The decision also clears the way for compensation for those still alive who were convicted under the so-called Paragraph 175 outlawing sexual relations between men.

The legislation was introduced in the 19th century, toughened under Nazi rule and retained in that form by West Germany, which convicted some 50,000 men between 1949 and 1969.

Homosexuality was decriminalized in 1969 but the legislation wasn’t taken off the books entirely until 1994.

Wolfgang Lauinger, now 98, was persecuted first by the Nazis and then held in prison uncharged for several months in 1950 by the West German authorities.

“I still believe they used old Gestapo files,” he said of his post-war interrogators in a 2016 interview with the BBC.

The bill approved Wednesday by Chancellor Angela Merkel’s Cabinet of conservatives and center-left Social Democrats still requires parliamentary approval. It foresees compensation of $3,230 for each conviction, plus $1,619 for every year of jail time that convicted men started.

“The rehabilitation of men who ended up in court purely because of their homosexuality is long overdue,” Justice Minister Heiko Maas said. “They were persecuted, punished and ostracized by the German state just because of their love for men, because of their sexual identity.”

“The strength of a state of law is reflected in having the strength to correct its own mistakes,” he said. “We have not just the right but the obligation to act.”

In 2000, Germany’s parliament approved a resolution regretting the fact that Paragraph 175 was retained after the war. Two years later, it annulled the convictions of gay men under Nazi rule, but not post-war convictions.

The Lesbian and Gay Federation in Germany “welcomes the fact that, after long decades of ignorance, legal consequences are being drawn from the serious mass human rights violations that were committed against homosexual people by the democratic state,” spokesman Helmut Metzner said.

The planned legal rehabilitation will be automatic and won’t require applications, though people will have to apply to prosecutors if they want formal certification. It will exclude men who were convicted for homosexual activities with children or for acts that involved violence or threats.

It also will apply to men convicted in communist East Germany, which had a milder version of Paragraph 175 on the books and decriminalized homosexuality in 1968.

About 4,300 men are believed to have been convicted there. In all, some 68,300 people were convicted under various forms of Paragraph 175 in both German states before it was scrapped in 1994.

In addition to individual compensation, the government plans to give an annual $539,825 in funding to the Magnus Hirschfeld Foundation, named after a pioneering German sex researcher and gay-rights activist of the post-World War I period.

The foundation is working on documenting the stories of men convicted under Paragraph 175.

In October, the British government announced that thousands of men convicted under now-abolished laws outlawing homosexuality would receive posthumous pardons, while those still alive will be eligible to have their criminal records wiped clean. But none received compensation.

That action followed the enactment of the Turing law, which was the result of the 2013 pardon of codebreaker Alan Turing. The renowned mathematician was convicted of gross indecency in 1952 for having sex with another man. He was fired and was chemically castrated; two years later, he took his life at the age of 42.

A few other countries, including Canada and New Zealand, are considering pardons for people convicted under now-repealed laws against gay sex.

Caribbean pastors ask U.S. to stop promoting LGBT rights overseas

Source: Washington Blade as more misguided hatred filled so called Christians continue using piety deceptively.

Nearly 300 religious officials from the Caribbean and Guyana have urged the U.S. to no longer promote LGBT and intersex rights abroad.

The 289 ministers who are from the Bahamas, St. Maarten, St. Vincent and the Grenadines, Trinidad and Tobago and Guyana made the request in a letter they sent to President Trump on Jan. 31.

“We write to you as concerned Christian ministers and churches from the Caribbean region (including the Bahamas) who hope and pray that the United States, under your leadership, will once again cast a light from ‘The City upon a Hill’ of which your American forefathers and President Ronald Reagan so frequently spoke,” reads the letter. “Sadly, during recent years, that City has too often cast shadows instead of light.”

“We refer specifically to the policies of the U.S. State Department and other government agencies involved in foreign policy that have undertaken to coerce our countries into accepting a mistaken version of marriage,” it continues.

The letter specifically notes the appointment of Randy Berry as the special U.S. envoy for the promotion of LGBT and intersex rights in 2015 was central to “the promotion of same-sex marriage” in American foreign policy. It also questions then-Secretary of State Hillary Clinton’s 2011 speech to the U.N. Human Rights Council in which she said “gay rights are human rights.”

“We have our rights by virtue of being human beings and not by anything else — not our ethnicity, not our religion, not our race, not our tribe and certainly not our sexual orientation,” reads the letter.

The letter also points out to Trump that “several of your government agencies” are “using executive orders to foist transgender confusion through the bathroom issue on your public schools by threatening the loss of federal funds.”

“Please understand that this same kind of coercion is being used against our countries to force us to fall in line with the entire same-sex agenda,” it reads.

The Obama administration last year advised public schools that Title IX of the U.S. Education Amendments of 1972 requires them to allow trans students to use bathrooms consistent with their gender identity. Trump rescinded this guidance on Feb. 22.
Guyanese group receives grants through Global Equality Fund

The promotion of LGBT and intersex rights abroad was a cornerstone of U.S. foreign policy during Obama’s second term. The promotion of marriage rights for same-sex couples internationally was never a publicly articulated part of this strategy.

The Society Against Sexual Orientation Discrimination, a Guyanese advocacy group known by the acronym SASOD, has received grants through the Global Equality Fund, a public-private partnership the State Department manages with the U.S. Agency for International Development. Officials at the U.S. Embassy in the Guyanese capital of Georgetown also meet with SASOD staffers and support their efforts.

Dennis and Judy Shepard met with LGBT rights advocates, parents and officials at the U.S. Embassy in Trinidad and Tobago in 2014. The Global Fund to Fight AIDS, Tuberculosis and Malaria has also supported HIV/AIDS programs in the country.

Consensual same-sex sexual relations remain criminalized in Trinidad and Tobago, Guyana and St. Vincent and the Grenadines. St. Maarten recognizes same-sex marriages that are performed in the Netherlands.
Ministers’ letter is ‘appalling’

Steven Anderson, who was deported from Botswana last September, traveled to Guyana earlier this year. The anti-LGBT pastor from Arizona who has said gays and lesbians should be killed and described the victims of the Pulse nightclub massacre in Orlando, Fla., as “disgusting homosexuals,” claims a hotel in Port of Spain, the capital of Trinidad and Tobago, cancelled his reservation earlier this month.

Activists in the region with whom the Washington Blade spoke on Wednesday criticized the pastors who wrote to Trump.

“It’s appalling that they are pandering to President Trump — a head of state who has demonstrated nothing but prejudice and intolerance towards entire communities, immigrants and Muslims especially,” said SASOD Managing Director Joel Simpson.

Erin Greene, an LGBT and intersex rights advocate in the Bahamas, agreed.

“The statement and petition is a desperate move by a once powerful structure in Caribbean societies,” she told the Blade. “The Christian church was once the center of Caribbean societies, and now, these pastors are grasping to retain power and relevance as they are being stripped of their influence in policy making and national development.”

“In fact, they would be fulfilling their Christian mandate by denouncing the exportation of anti-LGBTI hate speech to the region, and asking President Trump to focus on foreign policy initiatives that prevent the spread the of U.S.-based religious terrorism in the Caribbean, Latin America and the Global South,” added Greene.

Bahamas Transgender Intersex United President Alexus D’Marco echoed Greene’s criticism while defending Obama, Clinton and Berry’s appointment.

“It is inconceivable that these ‘Christian’ reverend gentlemen and gentle ladies could not find the love of Christ in the hearts,” D’Marco told the Blade.

A State Department spokesperson on Friday said “protecting universal human rights is at the core of U.S. foreign policy.”

“All people should be protected from discrimination and violence, and must be allowed to exercise their human rights, including their rights to the freedoms of expression, association, peaceful assembly, and religion or belief,” the spokesperson told the Blade.

The White House did not respond to the Blade’s request for comment.

Historical gay sex convictions in New Zealand to be wiped

As we in Jamaica continue to quibble after decades about the definition of rape and whether or not to decriminalize buggery and such other jurisdictions are getting the job done in terms of fixing the breach to gay men over so many years in error.

It was just some days ago that the folks in the United Kingdom also pardoned men with buggery running into the thousands who will benefit from such an action.

Yet we want to hold on to a 486 year old legislation simply because politicians are afraid to do the sensible thing.

New Zealand has said it will move to quash historical convictions for consensual sex between men.

Amy Adams

Justice Minister Amy Adams said an application process will be introduced and cases will be judged individually.

In 1986 when the Homosexual Law Reform Act was passed, sex between men above 16 years old was decriminalised.

But convictions for consensual sex between men prior to that still appear in criminal history checks and may have to be disclosed in job applications.

Ms Adams said the government intends to introduce legislation to implement the scheme in the coming months. About 1,000 people could be eligible to apply, according to New Zealand media reports.
'Stigma and prejudice'

A petition was introduced to parliament last July, asking for a process to reverse those convictions brought before 1986 and for an apology from the government.

On Thursday, Ms Adams apologised while addressing reporters.

"Although we can never fully undo the impact on the lives of those affected, this new scheme will provide a pathway for their convictions to be expunged," Ms Adams said.

"It means people will be treated as if they had never been convicted, and removes the ongoing stigma and prejudice that can arise from convictions for homosexual offences."

Only convictions between consenting adult men will be quashed, Ms Adams said, not those where the acts are still illegal today.

Britain announced it would pardon thousands of men convicted of offences that once criminalised homosexuality last year and a 2012 bill allowed those with historical convictions for consensual gay sex to apply to have them disregarded.

meanwhile locally here is some of the nonsense we have to contend with for example some of the comments on just the mere suggestion by the UN that rape should be redefined to reflect anal sex than just mere vaginal penetration:

Observer poll results February 2017

It is a little heart rending to watch countries that once criminalised buggery or anal sex with consent now rightsizing their legislation and going further to quash convictions that qualify while we fiddle with buggery. As a gay man who has been burnt by this buggery act I know all too well the sensitivities involved.

I am happy for the men who will benefit from this quashing in New Zealand.

US Antigay evangelicals have temper tantrums over Trump’s gay marriage flip flop

In this Jan. 31, 2016, file photo, Pastor Joshua Nink, right, prays for Republican presidential candidate Donald Trump, as wife, Melania, left, watches after a Sunday service at First Christian Church, in Council Bluffs, Iowa. AP Photo/Jae C. Hong, File

Donald Trump sat down with “60 Minutes” last weekend for his first televised interview since winning the election, where he discussed a wide range of topics, including gay marriage.
When asked whether he would rollback marriage equality laws, Trump nonchalantly said that it’s no longer an issue he cares to pursue.

seen as patronizing towards the LGBT community during the campaign

Why we can’t trust that lying liar Donald Trump on marriage (or anything)

“It’s irrelevant because it was already settled,” he said. “It’s law. It was settled in the Supreme Court. I mean it’s done…these cases have gone to the Supreme Court. They’ve been settled. And…I’m fine with that.”

This is a stark contrast to what he said on the campaign trail just one week ago, and his most die-hard evangelical supporters aren’t happy about it.

Christian extremists are not taking it well:

@realDonaldTrump Gay marriage is a abomination to most Christians! Gay marriage makes a mock of man & woman to bond & procreate
@realDonaldTrump Don't change or you will lose the Christians who don't agree with this backlash of Gay Rights...Man and Women..
@realDonaldTrump YOU ARE GETTING IT WRONG WITH GAY MARRIAGE. NEEDS TO BE OVERTURNED! DON'T SCREW IT UP WITH ABORTION. SAVE OUR BABIES!
@realDonaldTrump If you do not appoint judges who protect marriage... one man, one woman and protect bathrooms... then I've wasted my vote
@realDonaldTrump PLEASE UNITE THIS COUNTRY!Make it clear to the people you will do that! And pls do not touch gay rights! 🙏🏽@KellyannePolls
@LOVatoLUVAH @realDonaldTrump @KellyannePolls please touch gay rights one man one woman one life thats what the bible says

The hypocrisy continues much of which laughter is coming from some circles as those locally are also up in arms about the seeming about face by Trump, indeed uncertainty. It is laughable in a sense as they all thought he would go against marriage equality despite his misogyny, race baiting and right wing sentiments, playing on such folks malaise to win the elections. Evangelicals in the name of God were quite prepared to support him despite all the above and more.

Let us see how this play out.

Trump considering woman, openly gay man for leadership posts

some see this as patronsing the LGBT community

his third wife posing nude for GQ magazine

If this is to be believed then the religious crackpots who celebrated that he will change the gay marriage issues and such must be squirming in their corner.

WASHINGTON, United States (AP) — President-elect Donald Trump is considering a woman to run the Republican Party and an openly gay man to represent the US at the United Nations, moves that would inject diversity into a Trump team.

The incoming president is considering Richard Grenell as United States ambassador to the United Nations. If picked and ultimately confirmed by the Senate, he would be the first openly gay person to fill a Cabinet-level foreign policy post. Grenell previously served as US spokesman at the UN under former President George W Bush’s Administration.

At the same time, Trump is weighing whether to select Michigan GOP Chairwoman Ronna Romney McDaniel, a niece of Trump critic and 2012 presidential nominee Mitt Romney. She would be the first woman in decades to run the Republican National Committee.

“I’ll be interested in whatever Mr Trump wants,” McDaniel told The Associated Press yesterday, adding that she was planning to seek the Michigan GOP chairmanship again.

Appointing McDaniel to run the GOP’s political arm could be an effort to help the party heal the anger after a campaign in which Trump demeaned women. The appointment of Grenell could begin to ease concerns by the gay community about Vice-President-elect Mike Pence’s positions on same-sex marriage during his time as Indiana governor.

The personnel moves under consideration were confirmed by people with direct knowledge of Trump’s thinking who were not authorised to publicly disclose private discussions. They stressed that the decisions are not final.

Internal deliberations about staffing come a day after Trump made overtures to warring Republican circles by appointing RNC Chairman Reince Priebus as his White House chief of staff and Breitbart News executive Stephen Bannon as chief strategist and senior councillor.

The two men had made up the president-elect’s chief of staff shortlist, and while Priebus received that job, Bannon is expected to wield significant clout. Trump gave top billing to the former media executive, who led a website that appealed to the so-called “alt-right” — a movement often associated with efforts on the far right to preserve “white identity”, oppose multiculturalism and defend “Western values”.

Priebus yesterday defended the media mogul, saying the two made an effective pair as they steered Trump past Democrat Hillary Clinton and toward the presidency. He sought to distance Bannon from the incendiary headlines on his website, saying they were written by unspecified others.

“Together, we’ve been able to manage a lot of the decision making in regard to the campaign,” Priebus told NBC’s Today. ‘’It’s worked very, very well.”

Trump’s hires were, at first glance, contradictory, though they fit a pattern of the celebrity businessman creating a veritable Rorschach test that allowed his supporters to see what they wanted. Priebus, who lashed the RNC to Trump this summer, despite some intra party objections, is a GOP operative with deep expertise of the Washington establishment that Trump has vowed to shake up. He has close ties to House Speaker Paul Ryan, a fellow Wisconsinite.

Bannon, meanwhile, helped transform the Breitbart News site into the leading mouthpiece of the party’s anti-establishment wing, which helped fuel the businessman’s political rise. Ryan has been one of his most frequent targets.

Neither Priebus nor Bannon brings policy experience to the White House. Chiefs of staff in particular play a significant role in policymaking, serving as a liasons to Cabinet agencies and deciding what information makes it to the president’s desk. They’re often one of the last people in the room with the president as major decisions are made.

In announcing the appointments, Trump said Priebus and Bannon would work as “equal partners” — effectively creating two power centres in the west wing. The arrangement is risky and could leave ambiguity over who makes final decisions.

Trump has long encouraged rivalries, both in business and in his presidential campaign. He cycled through three campaign managers during his White House run, creating a web of competing alliances among staffers.

Priebus is a traditional choice, one meant as an olive branch to the Republicans who control both houses of Congress as Trump looks to pass his legislative agenda.

The Bannon pick, however, is controversial.

Bannon, who became campaign CEO in August, pushed Trump to adopt more populist rhetoric and paint rival Hillary Clinton as part of a global conspiracy made up of the political, financial and media elite and bankers bent on oppressing the country’s working people — a message that carried Trump to the White House but to some, carried anti-Semitic undertones.

An ex-wife of Bannon said he expressed fear of Jews when the two battled over sending their daughters to private school nearly a decade ago, according to court papers reviewed this summer by The Associated Press. In a sworn court declaration following their divorce, Mary Louise Piccard said her ex-husband had objected to sending their twin daughters to an elite Los Angeles academy because he “didn’t want the girls going to school with Jews”.

A spokeswoman for Bannon denied he made those statements.

A look at the fear of the feminine (Effemophobia) by Jamaican standards & how it drives the homo-negative perceptions/homophobia in Jamaican culture/national psyche.

After catching midway a radio discussion on the subject of Jamaica being labelled as homophobic I did a quick look at the long held belief in Jamaica by anti gay advocates, sections of media and homophobes that several murders of alleged gay victims are in fact 'crimes of passion' or have jealousy as their motives but it is not as simple or generalized as that.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills

The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard

When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Dr Shelly Ann Weeks on Homophobia - What are we afraid of?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?

It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness

Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Steps to take when confronted by the police & your rights compromised:

a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014

CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

Superintendent Murdock

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

Remember JFLAG's exclusion of the group from that IDAHO symposium on LGBT homelessess? See HERE, how can we ask the same people who only want to academise and editorialise the issue to also try to address their own when they do not want to get their hands dirty but publish wonderful reports as was done earlier this month, see HERE: (re)Presenting and Redressing LGBT Homelessness in Jamaica: Towards a Multifaceted Approach to Addressing Anti-Gay Related Displacement also LGBT homelessness has always been with us from the records of Gay Freedom Movement(1974) to present but the current issues started from 2009, see: The Quietus ……… The Safe House Project Closes and The Ultimatum on December 30, 2009 as carried on sister blog Gay Jamaica Watch. Notes on Bail & Court Appearance issues

If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

Originally aired on CVM TV December 8th 2013, apologies for some of the glitches as the source feed was not so hot and it kept dropping from source or via the ISP, NO COPYRIGHT INFRINGEMENT INTENDED and is solely for educational and not for profit use and review. The issue of the pending legal challenge in the Constitutional Court in Jamaica as filed by Javed Jaghai an outspoken activist who happens also to be openly aetheist.

The opposing sides are covered as well such as
The Jamaica Coalition for a Healthy Society
The Love March
Movement Jamaica

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
