In response to numerous requests for more information on the defunct Safe House Pilot Project that was to address the growing numbers of displaced and homeless LGBTQ Youth in New Kingston in 2007/8/9, a review of the relevance of the project as a solution, the possible avoidance of present issues with some of its previous residents if it were kept open.

Shoemaker Gully homeless problems move southwards

The age old issue of mostly young MSM/transgender individuals has moved southwards along the near three mile stretch of the rain water runoff infrastructure. A police raid yesterday of the area after numerous complaints some of which were hinted to in previous posts had unintended consequences as Half Way Tree Road traffic was held up for a short time as raging members of the homeless argued with angry passers-by while the cops tried to keep the peace. Accusations are that since the persons had been removed from the top end of the Gully in the New Kingston business district proper even after said attempts by another set of cops in December 2014 they returned there but since made to move after comments at a townhall meeting by a former police commissioner was followed up with a raid. Since the persons have shifted their use of the gully robberies have increased nearby and according to the police communication unit several personal effects of persons including drivers’ licenses and so on were said to be in the possession of the persons.




The section along Half Way Tree road seems to be now homeless central also known as Kencot Gully for the most part but this is not new as historically it stood as a living spot for decades from the days when the nearby Northern Caribbean University, NCU previously the Highgate Chocolate Factory corporate offices and the car park for the adjoining art Gallery. The gully which runs into an area of Kingston known as Kencot also featured in early HIV/AIDS interventions in the 1990s when Jamaica AIDS Support, JAS (for LIFE was added way later to its name) had its early offices in the area close to the gully on Osbourne Road. So much so that the early GLABCOM typed meetings and support groups were impacted directly alongside the makeshift hospice care facility also. Populations would seek services from JAS and vice versa as outreach teams conduct street based engagements. So we can conclude history is effectively repeating itself but with way newer blood. Older gay men such as myself who are watching this closely are somewhat baffled yet not surprised as it is telling in some respects or an indictment on aging NGOs who knowing the issues or have years of data sitting on have simply not acted as they ought to meet some of this with a residential type structure however small. There has always been an unease as far as I can remember whenever there is a suggestion that said aging NGOs deal with homelessness directly, for the life of me why I just do not know.

Nationwide radio also carried the story in their newscast and interviewed a man who claimed he was the victim of the persons in the gully who cross dress who said he was approached by one of them who asked for some money only for a weapon to be pulled on him against which he retaliated and attempted to defend himself, he said he tried to box (slap in the face) the person but the exchange ended as the intended party made good his escape. 



A robbery at gunpoint also occurred earlier this year nearby the National Works Agency nearby on Half Way Tree road allegedly and at other spots so much so that Jamaica Observer’s cartoonist Clovis captured the issue in his one of his stereotypical caricature of gays as bleached faced yet dark skin tone persons looking masculine in tone but wearing impy-skimpy outfits. ‘Where will this end?’ is a question coming to hand yet again as the cycle is so regular some just simply dismiss the matter and indeed the group of persons as worthless. Jamie Rose, who was among the onlookers, revealed that he was robbed twice by the men who took his cellular phone and $18,000 from his pocket.

“I was robbed... coming from a meeting. As soon as I turned the corner, there was a young man that stopped me and said, ‘Goodnight, Sir, can I have your phone, please?’ and I said ‘For what?’ And him reach for a knife and I double my fist to thump him in his mouth, and there was another one behind me who said, ‘Sir, this could be dangerous.’

“When I looked at his waist there was a gun,” Rose continued, lamenting that it is not safe to walk along the road at night.

Rose told the Observer that he believed the robbers were the same residents of the gully as he recognised their “accent”.

With frustration etched on his face, he said the men should be removed from the gully.

“They need to get them out of the area. I don’t care where they want to go. I know at least four persons that have been robbed, including one of my church brothers,” the man said, adding that the homeless homosexuals are “plagues”.

We have been told of fund raising efforts both online and otherwise repeatedly and in some instances campaigns get stuck in limbo or monies go unaccounted for as the effort is stopped midway and no accountability comes forth to say where the monies are or what has it been used for; while the populations stagnate, all kinds of videos and photo shoots have occurred yet the problem has not changed, all kinds of so called artists claim to have launched albums where part proceeds were to go to some yet no proceeds seem to come (or the albums simply have not sold enough) and all this happening as a new wave of incoming from western Jamaica (more historical repetition) linked to lotto scamming as persons either close to or directly involved have found themselves left in the cold as kingpins fall from grace and once cash rich persons cannot ‘take care’ of drag queen broods and so on. Then there is the business of excuses from places such as JFLAG and Dwayne’s House and or Colour Pink groups all who claim they are “registered” NGOs to deal with homeless but claim they cannot find a place to do such, yet the same JFLAG wants all to simply forget the fact that the shelter pilot they watched close without protest before their very eyes was transformed into their then office.

But who cares about the least amongst us really, they are just dregs in the mix as the protected privileged thrive pursuant to ‘LGBT rights’ and yet again the blaring classism stares us all in the face. Some 11 to 14 different proposals were around at the time when the Safe House Pilot project in 2009 was dubiously closed without a truthful explanation yet former board members of Jamaica AIDS Support for Life engage in trifle tokenism claiming to be collecting canned items while obviously using the photos for attention seeking, a practice that thankfully is now being seen by more persons as deceptive. The preying on the homeless is not new but with social media around these days it is easily done and hardly gets questioned as some do not want to ruffle the feathers or upset the apple cart. The police seem more in control of the situation this time around as the persons for the most part were allowed to vent as members of the public hurled negative comments and homophobic remarks.

The other difficulty with this is that other miscreants also commit infractions in the area and in New Kingston and the age old blame game continues, not that there are not bad eggs in the populations but the trick is who to believe or not. So the gully populations get the blame whether or not for robberies and such, then there is the clash between cruisers and the homeless also continues. A recent standoff in December was evidence of that but it never led to any serious injuries as one before. Those who have been helped in some way have either lost the assistance or are too few to be counted as success stories while the majority are left to fend for themselves. Never leave out the ‘subject of study’ element with academia who only use the populations for academic sport and intellectual masturbation which include documentary productions which are shot taken back and no reciprocal assistance as said producers make good on the professional profile enhancement.

It is not as if solutions are not on paper somewhere but unwilling NGOs and such thrive on but do not want to get their hands dirty with this. This unwillingness is not lost on the public.

GoFundMe account launched to help 'gully queens'

Yet again we are told of some fund raising action for the homeless MSM/transgender in New Kingston and they have been used so much it is not funny. But let us give the benefit of the doubt. This summer, South-East London recording artist Ray Blk shot her video "Chill Out" with four of the Gully Queens – Mindy, Shadiamond, Beyanka and Sasha – along with Creative Director Savannah Baker, Director Philippa Price and Vogue.com’s Market Editor Kelly Connor. One hopes they were paid properly and the legal matters in terms of future royalties are set and they become nothing more than actors to make an artist's work look good.

It has to take a foreigner to set up another effort instead of the very group that says it is the foremost LGBT entity, that says a lot even as this problem pre-dates ALL LGBTQ organisations formal or not, registered or not, yet the deception continues but what is new?

In partnership with the Larry Chang centre through J-FLAG, the first human rights organisation in the history of Jamaica, to serve the needs of the LGBT community, the creatives behind this video are aiming to raise US$100,000 initially, so a property can be leased to accommodate these transgender youths, aka the Gully Queens of Kingston, Jamaica. 



The long-term goal is to purchase a safe haven, provide psychological support and assist with their medical expenses and welfare. We will also aim to provide a stable income for the transgender youth by creating the Queen's fashion brand. Mentored by volunteers from our collective creative communities, it will consist of crochet pieces and customised t-shirts from which they will receive 100% of the earnings. It will be sold on " www.pumpumgyals.com" platform. 

Problem is that JFLAG is not the first human rights organization so the error is there already, oh boi!. It was Gay Freedom Movement as operated by then its Gen Sec Larry Chang since 1974.

Meanwhile:

A GoFundMe account has been set up to raise funds to help create a permanent home for a group of gay Jamaican men who live in the Shoemaker Gully in New Kingston.

"These are beautiful people - the bravest in fact. To live in a country which is against them, where every day they face death, and yet they refuse to be silenced. Join us in our stand with them, and help them change their fate," the plead for cash said.

The men are referred to as 'gully queens', and according to Savannah Baker, who established the account on October 31, they are beaten and raped on a regular basis.

Some US$7,762 or approximately J$1 million of a targeted US$100,000 (J$12.9 million) has so far been raised.

The money is to lease a property to accommodate the men, provide psychological support and assist with their medical expenses and welfare.

The GoFundMe post also said the aim is to provide a stable income for the transgender youth by creating the Queen's fashion brand, from which they will receive 100 per cent of the earnings.

Dane Lewis, executive director for The Jamaica Forum of Lesbians, All-Sexuals and Gays (JFLAG) said the entity supports the initiative.

Lewis said that a number of the young gay and transsexual youth who reside in the gully are legitimately homeless and estimates a minimum of 20 are there at any given time.

Where oh where is Dwayne's House where the touts were that that outfit named after murdered transwoman Dwayne was posited yet nothing since or what about Colour Pink? It is so disturbing how the persons in Kingston proper are pigeon-holed when homelessness is an islandwide issue for so long.

I am taking this one just like the ones before with a grain of salt, we were told of shelters before, JFLAG had to return money before as they could not get a space for lease and here we are again this old familiar place.One other entity tried with a shelter but it died rather quickly, see: So our displaced cannot settle eh? ....... police raid premises with cross dressers! So many proposals, so many attempts and they seem to just fizzle while no real long lasting help and a permanent solution eludes them.

Homeless Awareness Month 2016 issues

As the visibility of LGBT persons in Jamaica increases thanks in most part to social media platforms and a willingness of persons to come out or be open these days the usual side effects come forth. Forced evictions, family fallout, displacements and even more ghastly murders not homophobic related but more a consequence of the illegal lotto scamming, especially in western Jamaica are having a deleterious impact of some persons; numerous reports which have come in seem to suggest an increase in such matters when compared to previous years. It is looking like déjà vous to some of us in the trenches for some time, the Kingston cohort of persons who were at the Cargill Avenue, Shoemaker Gully and Millsborough Avenue locales have since splintered since their removal by the police in December 2014.

And we continue to reap the world-wind for not addressing homelessness when it was manageable

Despite promises made by some from various quarters including so called concerned religious leaders, members of parliament, some LGBT party people and others the resulting interventions amount to mere tokenism and a drop in the bucket given the size and ever changing scope of the problems. So called ‘feeding programs’ and parading the after photos on social media is not solving anything more than persons seeking to enhance their profiles by going the charity route; some so called entertainers have gone as far as to release pro-lgbt music albums with the photos of some of the homeless on the cover of the disc marketed all over the place yet it turns out the very persons who were so captured have been struggling and are still struggling, not to mention the HIV positive persons in the groups. One time of short term feeding programs only address immediate service needs and may even create a dependency issue where homeless feel that they do not have to do much but wait until ‘feeding time’ as Aunty so and so or Uncle so and so is coming with food or goodies; this can serious impact negatively on the efficacious component of the interventions (if any).

The pigeon-holing of the populations by media especially our friends in Kingston has sent shock waves in terms of kind individuals who once would open their doors when approached have simply stopped doing so in fear of the growing perception of the antisocial behaviours that might come as a consequence; an ongoing court case involving a former homeless man who was being assisted with housing is accused of extorting over a million dollars from a university lecturer has only sought to widen the gulf between the have and have not gays and refusal or severe reservations about helping in some way such persons, hence the groups such languish in essence with very little interventions save and except for the HIV/AIDS interventions that are peripheral in terms of welfare and other workshop nonsense that go nowhere the moment the participants down the lunches or snacks and have to return to the old buildings, bushes and such or the lucky ones who can crash at someone’s home.

It is estimated that some forty persons are in Kingston alone who identify as MSM or transgender and that is taking into account those who can be found or aren’t underground. St Catherine has some twenty or so based on reports counted over the last two years and from an ongoing pilot project by GLBTQ Jamaica for HIV positive MSM entitled ‘Brothers Positive on Positive’ which was designed in May 2016 to meet some of the shortfalls that can come with government driven support group activities under the national HIV programs; the results so far have shown that many persons prefer to suffer in silence and of the twenty persons registered in the response not counting regular attendance of sessions 55% of them are under the age of 25 and have no steady income saved and except for commercial sex work and other vendor type activities. It is a shame that after some forty years plus of some kind of organised LGBT activities in Jamaica to include the slow years between Gay Freedom Movement and its cessation to the impact of HIV/AIDS in the 1990s and the deaths to present, and with all the hard and anecdotal evidence no sustained response has come from well funded and powerful NGOs but who really cares?

Recurrent issues:

The ongoing court case of the alleged extortionist who hailed from the Maxfield Avenue area leading to fostering mistrust for helping persons who may require same

Crimes in certain jurisdictions being committed by selected persons or others but blame is accorded to the MSM groupings

Occasional clashes with members of the public and homeless persons in Kingston and St Catherine as a viral video evidenced in Kingston

New case reports from nearly every parish but the follow up with persons for confirmations can be tedious at times, (un)confirmed Kingston (2) (2), St Catherine (1) (3), St James (6) (4)

Forced evictions linked to lotto scamming in St James with a particular violent twist

Worrying antisocial behaviours from some persons in the St Catherine populations and some challenges in St Ann as a stabbing incident in June suggest

Worrying migration patterns from other parishes especially St James to Kingston resulting in what appears to be an explosion of the numbers as was evident in 2010

Haemorrhaging of persons who would normally or occasionally open their houses, spare rooms or spaces for temporary assistance

Inappropriate and or unethical behaviour or sexual advances from persons under the guise of assistance to those who are the benefit of same

Females factoring more in reports since 2015 and especially since the lotto scamming unravelling in St James

Limited resources to accommodate persons being assisted by individuals and an ongoing lack of funding to support properly structured responses

Some members of the near four year old weed-whacking project in St Catherine having issues with prolonged accommodation

Fallout from the lotto scamming associated violence in western Jamaica, notably Montego Bay, Trelawny and nearby parishes with drive by shootings and broad daylight arson attacks. Rival gangs fight for turf, guns and the ever shrinking income from the scourge as the federal folks make some impact. Some frightened MSM/trans individuals have been relocating to safe ground, notably Kingston, Portmore and so on even as the reserves were called out but murders continue as high as 5 a day.

Ever migrating groups and individuals who are not reached or do not want to be reached by present feeding initiatives and systems with some local authorities and police interventions.

This video below recently surfaced of a murder in broad daylight as a call centre employee who identifies as gay was gunned down as he exited a taxi in St James, warning the footage may be uncomfortable for some but while police investigate this, friends close to him ascribe a homophobic motive is involved as he was being stigmatized prior. As with investigations it is hard to get the right follow up information with a view to close a case accurately. It is also alleged that he was being pressured into getting into scamming to which he had refused WARNING contains disturbing images:





Such refusals or ignoring has also led to other issues where persons have ran scared to seek cohabiting assistance with friends in their networks and so on. Effeminacy is still sadly a factor used by some to justify their homophobic stance often still evidenced in violence, despite the aforementioned social media plus was and is still expected to raise awareness and information on LGBTQ matters in a perfect world but old habits die hard and there is a refusal to engage the materials while often seen as ‘grooming’ by some including religious leaders. Only last month I was asked to house for a short time an employed man who ran into some issues with men in his former community but he has since been able to secure a new rented space. Then there are the internal issues as well where some turn to crime robbing any potential victim and end up in legal woes repeatedly.

The deaths from HIV related illnesses is still a concern to me, we lost at least two persons in the year despite the valiant fight via treatment, poor monitoring by their medical interventionists, improper adherence, zig-zagging nutrition and diet to include carbonated beverages and grapefruit ingredient juices) also seem to be playing a factor by observation; if those things which are cheaper can be had then persons are going to have them despite being advised otherwise whilst vitamin supplements which can be so expensive are hardly provided either through the national programs and NGOs.

Kingston's Mayor Burke receive Death Threats... so she claims yet with all her optics with JFLAG and such claiming she is concerned she cannot deal with homelessness citywide; some over a 1000ft westwards from her Church Street Mayor's office, infront of all places the Supreme & Appeals court also seen as the hallowed halls of justice buildings as seen below.

How is she therefore going to address MSM/transgender homelessness that requires specialist interventions when the very JFLAG isn't showing any forward momentum on this for so many years?

I still want to encourage persons to assist where possible especially on the fundraising front by donating to trusted outfits and individuals, donations are still accepted here and sister blogs by way of Paypal, the buttons are located on the top left hand side just under the banner. KSAC working to clear streets of homeless people, will the LGBT populations be assisted as well?

March 6 this year the housing minister proposed dipping into the National Housing Trust funds to provide shelter or expand existing old overcrowded facilities on Hanover Street in Kingston. It is now some three months since the Shoemaker Gully populations in New Kingston have been barred from accessing the area by temporary fencing/blockade via an operation by the police and the MSM?Transgender group is now scattered and some have gone into hiding as the cops continue to crack down on alleged miscreants in the group.

The stoning of JFLAG's offices by some of the men yet again this time at a different location in January has not helped the situation either with an ever deteriorating relationship one wonders where this will end. Now comes this 
Following the stabbing of a policeman and an eight-year-old boy in downtown Kingston on Wednesday by a man believed to be of unsound mind, the Kingston and St Andrew Corporation issued a release stating that it is committed to clearing the streets of the homeless.

“We continue to work in a responsible and caring manner to clear the streets of the homeless, some of whom are mentally ill. The Bellevue Hospital has partnered with us to treat these mentally ill individuals and to find a place for them”, announced Town Clerk Robert Hill.

The KSAC, through its Poor Relief Department, according to the release, has held several meetings and has partnered with many organisations to find accommodation for the homeless. Some have been placed at the KSAC’s own Marie Aitkens Shelter and other homes and have been trained in various skill sets, some have even been given jobs while others are still waiting to be placed.

The release said the process has been slow because of limited resources and options in assisting this group.

“The KSAC is always trying to assist the less fortunate and mentally ill in Kingston and St Andrew. This incident is unfortunate and we stand in solidarity with the youngster and his family. We pray that something like this will never happen again,” said Mayor Angela Brown Burke.

“We will continue to work in a coordinated effort with all the stakeholders with a

view to alleviate conditions that could lead to such incidence reoccurring,” the mayor said.


Trouble is such facilities are overburdened, the Salvation army's program by parade has been curtailed somewhat as a new edict by the goodly mayor some time ago also restricts open feeding of homeless persons be they LGBT or not.
With all the nice goals the Poor Relief Act espouses it has not been helpful at all to the displaced and homeless especially those who are LGBT.

The Poor Relief Department of the parishes of Kingston and St. Andrew is a welfare agency of the Kingston and St. Andrew Corporation. It was established as a result of the Poor Relief Act, which was enacted on April 29, 1886 and modified a number of times over the years.
The department was located at the Old Wolmer’s Ground (now an Arcade) – 65 Church Street, Kingston. It was relocated in the fifties to 65 Hanover Street – its present location.

Functions
The Poor Relief Department is the welfare of the Ministry of Local Government, Youth and Sports and is administered by the Kingston and St. Andrew Corporation under the Poor Relief Act. Its aims and objectives are to alleviate destitution in all its forms. Under Poor Relief Act, all persons who are physically or mentally disabled and unable to work and earn a livelihood and who are destitute are entitled to receive Poor Relief benefits.

Manning any shelters established, registering persons to be accommodated therein, and ensuring that food, bedding and health care are provided.

Investigation of persons who are reported to have suffered in the disaster.

Rehabilitation of disaster victims

Mission Statement
To serve as a catalyst for our clients, by alleviating destitution, to improve their standard of living and enhance their quality of life through counseling, rehabilitation and the use of available resources. All that we do will be in keeping with our motto “Show You Care; Do Your Share”.

Management Structure
The Board of Supervision is the legal body that supervises Poor Relief islandwide. The Poor Relief Committee (a sub-committee) is the manager of the poor on behalf of the Corporation as stipulated by the poor on behalf of the corporation as stipulated by the Poor Relief Act. The department is administered and operated by a group of social workers known as Poor Relief Officers. The chief among them is the Inspector of Poor. Others are the Deputy Inspector of Poor, the Senior Assistant Inspector of Poor and Assistant Inspectors of Poor. The Assistant Inspectors of Poor or Field Officers are in charge of one of the 13 zones that exist with the parishes of Kingston and St. Andrew.
There are also some support staff that assist in carrying out the functions of Poor Relief Department. The Poor Relief Officers are guided in their work by Laws and Regulations governing the system. Some of the Laws are:-

2. The Status of Children Act
3. The Married Women’s Property Act
4. The Affiliation Act
5. The Vagrancy Act
6. The Offenses Against the Person Act
7. The Children Adoption Act
8. The Maintenance Act
9. Mental Health Act
10. Juvenile Act

These functions are carried out through interviewing, investigating, counseling, visiting, reporting, rehabilitative intervention and referrals. Monitoring is done through domiciliary visits (follow-up) to evaluate client’s progress.

With growing numbers of younger MSM/Trans youth from other parishes adding to the already problematic populations we cannot ignore or overlook this group despite the negative press they have caused onto themselves over the past 7 years since the closure of the only MSM safe house by Jamaica AIDS Support/JFLAG under dubious circumstances.

Poor Relief Programs are supposed to consist of some of the items below but they seem not willing to touch the LGBT population with a long stick so for instance:

Eligibility
The criterion for eligibility is dependent on the program. For Poor Relief Assistance, “The persons entitled to relief are the persons within the parish who are wholly destitute of the means of subsistence, and are at the same time due to mental or physical causes, unable to work and earn a means of subsistence” (Poor Relief Act Section 29).
There are two forms of Poor Relief Assistance – the institutional and Non-Institutional.

1. The Institutional – care is available to destitute persons who are;
a. Without a dwelling place
b. Ailing and have on one to care for them
a. The Non-Institutional – care relates to those who need Poor Relief Assistance and can manage outside of an institution.
c. Those who become destitute because of circumstances such as catastrophe, which makes them entitled toDisaster relief and Rehabilitation is assisted as described in the Poor Relief Act.

The Street People Program is administered to those persons who are homeless and are in need of shelter, daily meals, medical attention and the opportunity to have a bath and change of clothing.,

The Marie Atkins Care Center for Street People was established in November 1993. The purpose of the center is to improve the quality of life for the Homeless. Clients are able to reunite with their families in U.S.A., Canada, Great Britain and here in Jamaica.
The Feeding Program is available to destitute persons who are able to provide a meal on any given days. Food packages are provided to registered clients monthly and a hot meal at some pay stations on pay days.

The Indigent Housing Program is available to an indigent who is in need of a house or who is in need of repairs to be done to his/her dwelling. This is facilitated through the Member of Parliament/Councilor S.E.S.P. allocation. The department in collaboration with the Food for the Poor also builds hosing units.

The Adopt a Child Program is an outreach initiative, which seeks sponsorship from organizations and individuals to provide a scholarship for destitute children who are doing well in school but are failing financial deprivation.

Assistance and Services

The Poor Relief Department by virtue of the Poor Relief Act is the primary agency to relieve destitution and in all disaster it stands prominent as the authoritative body to make assistance readily available prior to committee approval. Assistance is given in the form of money, food, clothing and shelter inter alia.

Let us see if there'll be any improvements even as Dwayne's House an outfit designed to address the matter post JFLAG et al pussyfooting struggles to raise funds.

Popular Homeless MSM gets six months for throwing acid on another man

A popular gay man from our community who got angry and sprinkled acid on his friends after they reprimanded him about a robbery, was sentenced to six months in prison on Thursday 19th of February.

Shevaughn Lewis, 21, otherwise called "Batman", of a Portmore address in St Catherine was sentenced to six months each on charges of malicious destruction of property and assault occasioning grievous bodily harm by Senior Magistrate Judith Pusey. However, the sentences are to run concurrently. He has been accused of other serious crimes in the area of New Kingston over the last few years where the homeless populations resided in the Shoemaker Gully.

The Crown led evidence that on November 19 of last year, the complainants were at Shoemaker Gully in New Kingston when an argument developed between them and the accused, who sprinkled a corrosive substance on them burning one of them on his hands and feet and the other on his foot.

According to one of the complainants, a 27-year-old hairdresser, on the day in question he went to Lewis and said: "How yu fi rob de people dem whey me stay wid a New York."

The complainant said Lewis then turned to him and said: "A wha happen to yuh Kenneth, yuh live inna house and we live inna gully so we haffi hustle."

The complainant said Lewis then pushed him and he retaliated by shoving Lewis, who went inside his bag for a knife and a bottle containing the substance.

The complainant said his friend who had also spoken to Lewis about the incident then called and asked him if he could be fighting a man who had acid and he went inside his friend's car.

While they were sitting inside the car, the complainant said Lewis approached them and sprinkled the substance on them, burning them. They drove to the Andrews Memorial Hospital for treatment and then reported the matter.

The substance also damaged the car seat and the dashboard, hence Lewis was also charged for malicious destruction of property.

However, Lewis was not held until January 26 of this year and when he was cautioned he said: "A lie she tell pon me, me nuh do har nothing. Me neva mash up nutten fi di dutty gal dem.


Sad that he was a member of the original Safe House Pilot Project under JASL/JFLAG as highlighted on this blog. This what happens to persons who are left to fend for themselves and they go astray.

Hope more and better solutions can be found, it seems the suggestion by another Superintendent, see New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population has been ignored of shelved. Meanwhile JFLAG's offices formerly of Phoenix Avenue was stoned by some of the homeless/displaced MSM/Trans persons in January as confirmed recently. Staff and other business operators on the mini-complex had to take cover as the angry group threatened them with physical violence. JFLAG was apparently being blamed for neglecting them and sending the police to pursue all of them instead of the bad eggs linked in or found in the group. Sadly history has repeated itself as it was only two years ago in February 2013 members of the group stoned their offices when located at Upper Musgrave Avenue which is now demolished.

Gay Men Blamed for Fire at Old Court House Occupied by Squatters on East Street

The scattering of displaced or formerly homeless MSM or Transgender persons across Kingston due to the challenges in the Shoemaker Gully, downtown Kingston and other parts of the capital (indeed island-wide if one were to really examine the situation) has reaped some blame to at least one of them following a fire at an old court house on East Street. The flames were set to have been set by one of two men who also occupied a room in the building used by squatters for some time and the fire was reportedly set in revenge by one who accused the other of infidelity and spending an amount of cash he was not to have done.

It was only some weeks ago a similar incident outing occurring off East Queen Street had two alleged gay men had to relocate following angry residents descending on them after a heated argument leading to a fight over some clothes, a fire was not the final outcome but the men were left subsequently left without a roof and told not to return; so many skirmishes dotted across town has the New Kingston population of displaced MSM/trans individuals bouncing from here to there.

The police raid as carried by Superintendent Murdock in New Kingston who has been trying to strike a balance between public order and welfare issues with this group has not helped either as now the persons are left to scatter once again in the long line of clashes with the cops and members of the public. One such clash allegedly also occurred in June in the Coronation Market district where one person was accused of stealing or attempting to steal a phone from a woman, he was set upon but managed to escape in the crowded corridor as shoppers try to purchase their ground provisions and so forth. A clash as well with other wondering or cruising populations in the downtown district have not gone unnoticed, the challenge is they occur so frequently these days as cruisers and commercial sex workers jostle for possible clients that it is near impossible to keep up and report on them. The last clash ended up in a stone throwing incident nearing the Railway Corporation office on Darling Street and as a consequence the men who load buses and guide cars to be parked in the informal parking lot have vowed no ‘battyman’ will be allowed near their turf.

Residents at the fire incident at hand are very much up in arms as some have lost everything as the building was raised, school supplies in particular that were just purchased was where the anger was present as former resident complain they have no money to resupply those items while one woman said she had not completed shopping for the remaining items on the list.

Veiled threats have been dropped by some of the residents or victims of the fire possibly directed to at one or both men who are accused of contributing to the blaze as persons tried to fend for items in the cooling down operations. Some persons managed to save what they could and it is unclear as to how many families were actually affected by the fire.

The growing numbers of young MSM/trans persons without a home or job to sustain themselves has been a concern of mine for some near ten years in Kingston in particular as other avenues of escape dry up, Club Heavens where some of the older persons would sleep is no more, so too is Calabash formerly run by the late BeBe Stevenson that was closed after a police raid in Montego Bay in the hunt for lotto scammers. The recent offensive of alleged scammers as well has only sought to add more problems as persons who would take in young unemployed males (gay or straight) for such activity fall from grace the formerly engaged males mostly are left stranded or lost in the cold after arrests, family members who disown or leave them to languish in lockups or forcibly evicted as well apart from new cases of homophobic relatives doing the same.

The age of persons who are being thrown out is also frightening as young as 11 in one case earlier this year and the other challenge is that older men take advantage of some of these youngsters pretending to help them when really what they are after is some fresh meat. These entire issues just further compound the matter of a problem that had a solution but we all know where that went and we now live with the consequences with nice damage control and explain-aways by crafty bloggers and press release writers.

We are told of feeding programs, difficulty to find a place for a shelter, so called Dwayne’s House ideas, politicians hovering to capitalise on the matter and an incompetent LGBT agency in the middle of all this with documentary after documentary yet the populations’ situation has not improved, in fact the last photos and interactions I have had with some of the persons they are clearly not well physically and other videos with musical artists supposedly showing some sympathy also reflects the concern of the actual health of some of the more vocal members of the group.

Where will this Kingston problem end? When there are other smaller fires in St Catherine, St. Ann, Manchester to a certain extent (linked to lotto scamming crack down) and Trelawny as well with this fire adding more back on the streets. The community based shelter assistance is still an option but not for this particular set of homeless gays and transgender persons as the fear if they will wreck ones house and home and while the half way house concept is being pushed by some the needed stabilization work required prior to such residency is nowhere in sight it seems.

Peace and tolerance indeed is required firstly for our own before making demands of and on John Public or the politicians to change laws when all the group is also seen as HIV prevention guinea pigs.
The Star News in the meantime carried an entry on the matter:

Homosexual men, believed to be involved in a heated altercation, are said to be responsible for the massive fire which yesterday gutted a board structure along East Street in Kingston.

More than 20 persons squatting in the building were left homeless. Some residents managed to save a few household items.

Whether the building was insured or the estimated cost of the damage is not known.

One of the more than 20 residents of the dwelling, Charmaine Burch, said she woke up to what sounded like stones being flung against zinc.

She said the men responsible for the fire were homosexuals who were involved in a heated fight at the rear of the premises, which then resulted in the building being set ablaze.

"Same one dem from New Kingston. Mi come out and turn to, and seh to him a waah gwaan inna de yard. Him say he didn't know. Mi come out and look and see mi room up in a smoke," said Burch, who lost everything including money and school items for her four children.

The chaos that emerged saw residents scrambling to remove what little they could, others armed with stones were seen chasing some men further along East Street.

Police at the scene said one of the men responsible was detained at the Central Police Station.

Funny And Framed - 'Mother' Of New Kingston Gays Says They Are Not To Be Blamed For Increase In Crime

Well obviously not all of them would or could be blamed as established for some time now and this blog has been clear that only a few bad eggs have been made to cause the others who really need help to suffer with agencies some of whom are mentioned turning their backs on the men in the first place thus allowing the problem to fester in New Kingston. The greater numbers of persons in the Shoemaker Gully when seen at nights are NOT homeless or even displaced but are friends of the those who are and hang out together, others are just enjoying the ride so to speak in terms of public expression often not had and socialization.



The Safe House pilot, the ONLY residential response was made to close down by Jamaica AIDS Support for Life's Board as JFLAG stood silently by and then moved into the very space that was the house turning it into their offices in 2009/10 with the causality being the Executive Director of JASL then and the men eventually discarded in 2010 five years later here we are with deaths, in-fighting, pretentious agencies and individuals all ready and willing to parade them and gratuitous sympathy but no real help and did I mention parade them for HIV prevention purposes and as condom distribution recipients but where is the real help that these powerful well funded agencies and NGOs can more than give if they desire?

MP Julian Robinson claims he wants help for New Kingston homeless gays

It is painful for myself and a few others having been apart of the mess and the lead up to the formation of the Safe House to watch this and other happenings most of which go unreported such as a recent attack as caused by a mistake of one of the youngsters.

They are being accused of being the main perpetrators of crime in the once almost idyllic New Kingston area, but the mainly homosexual men who live in the Shoemaker Gully say they are being framed.

New Kingston residents and the cops who patrol the area last week toldThe Sunday Gleaner that the increase in murders, shootings, robberies, assaults, house break-ins, car break-ins and larceny reported in the area coincides with the migration of a large group of homosexuals to the gully near Trafalgar Road.

But the so-called mother of the group, who goes by the name 'Thelma', last Friday denied the allegation and charged that most of the wrongdoings are committed by persons who visit New Kingston for short spells.

"I see it in the paper that we are responsible for most of the crime in New Kingston. Some of dem that do the crimes just come around, sleep and tek weh dem self; they don't live in the gully," the 30-year-old Thelma toldThe Sunday Gleaner during an interview on the bank of the gully.

"Yu have man weh come amongst wi who have dem place, but just come and stay and do dem crime. Some of dem wi deh beside di gully and all si people a pass and grab dem phone, mi nah hide nothing. Like all me now, mi lie down a sleep fi go mek my own honest bread and man weh nuh live wid wi, but just come among wi mek trouble and all last night (Thursday) dem tek weh how much phone and my bleaching cream," alleged Thelma.

But the theft of skin-lightening products pales in comparison to crimes like murder, for which the police have accused at least one of the gay men, 'Pebbles' who live in the gully.

Thelma disputed that Jevon Francis, otherwise called 'Pebbles' or 'Trina', is responsible for the May 18 fatal stabbing.

"Mi a read inna di paper say a someone name Trina (Pebbles) do di killing, but is not she do di killing. Pebbles do whole heap a thieving and robbery, but a nuh she do di killing," declared Thelma, even as he admitted that it's a member of the group who committed the murder.

According to Thelma, the killer has claimed that there was no robbery involved as the killing resulted from a long-standing feud, "but me know say that is not so".

The St Andrew Central police have reported that between December 2013 and May this year, 45 major crimes have been reported in the New Kingston area, and most of these are being attributed to the gays residing in the gully also referred to as 'Gay Bridge'.

"We have carried out several operations in the days, but in the days, the group numbers about seven or eight homeless boys. At nights, the number grows considerably and among that group are some persons who use the diverse community as an umbrella to do crimes. If you move to them, you are being seen as anti this group," argued Deputy Superintendent Christopher Murdock, who is in charge of the New Kingston Police Post.

"Persons within the group would want to say that it's a handful of persons that are committing crimes, but this is not so. They have caused an increase in crimes as it relates to the stealing of smartphones, robbing persons at knifepoint, robbing persons under menace, and then using means to extort them by saying that they will call their wives and tell their wives that they came to seek sexual favours from them. These are some of the crimes that have been reported to us," added Murdock.

Thelma does not dispute that some among them are involved in wrongdoing, but he sought to put it in perspective.

"Nuffa dem hear bout it and see it on TV that here suh brand as a b—— man spot, and nuff a dem come out here and do what dem want to do and then want to trick di people dem," argued Thelma, as he defended the stealing from some of the clients of these gay men.

But residents say the menace by these men extends way beyond just 'punishing' those who try to deny them their earnings.

"All of New Kingston is affected by this brazen crime spree and action needs to be taken now. I'm very scared of the reports I'm getting about the many attacks on my neighbours," a member of the New Kingston Citizens' Association wrote in an email to The Sunday Gleaner.

"How can any decent, law-abiding community simply allow a band of men to take over and operate illegally from a section of the road?"

But according to Thelma, this is a short-term arrangement for many of the men.

"In the next five years, I don't plan to be on the road; maybe even migrate. I don't have anywhere to go right now, because if mi go town people a buss shot after mi, because when mi walk, mi come in like the queen of town," he said. "So I want to migrate and try to get asylum somewhere."

Great health risk

He accepted that the occupants of the gully are putting themselves at great health risk, as they defecate, eat and sleep in proximity to each other.

However, Town Clerk Robert Hill told The Sunday Gleaner that steps are being taken to create somewhere to house these persons who have made the gully their home.

"We are trying to come up with some sort of social-intervention policy in partnership with other places like (Jamaica) AIDS Support and a United Nations agency, to kind of redirect the type of antisocial behaviour and see if we can now assist in finding land on which a centre may be built to offer counselling and other divergent services," said Hill.

It was only in June as the JFJ/CVCC funded sex education fiasco was in full swing I asked: Why did CVCC & JFJ not Fund a Project/Home for Homeless LGBT Youth in New Kingston instead of the Children’s Home Fiasco that now obtains?

These personalities on these boards and management committees obviously do not care about these homeless men more so than parading them as victims as the clashing imperatives of the differing agencies cause a lack of pro-activity and priority in frontline responses to such matters even as more displacements continue to add to the numbers.

Those persons who do open up their homes and let in persons despite the risks are to be commended even without any financial or logistical help from powerful advocates and NGOs which shows we may not need these folks after all. I can attest to the difficulties in offering shelter and the fallouts but only kindness matter I guess as singer Jewel says.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

MSM/Trans homeless - From gully to graveyard



When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

The issue of the pending legal challenge in the Constitutional Court in Jamaica as filed by Javed Jaghai an outspoken activist who happens also to be openly aetheist.

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
