In response to numerous requests for more information on the defunct Safe House Pilot Project that was to address the growing numbers of displaced and homeless LGBTQ Youth in New Kingston in 2007/8/9, a review of the relevance of the project as a solution, the possible avoidance of present issues with some of its previous residents if it were kept open.

Stabbed for not probing deeply enough!

There is never a dull day in Jamaican and indeed gay life or aspects of it. As the holidays end and life slowly returns to normal as it were the drama, fun and bizarre stories usually come to hand as tongues go a wagging. A previous post showed us the lower socio economic spectrum of some of these sub-cultural matters of handcart lovers who had to beat a hasty retreat in downtown Kingston. A man in his thirties has been doing just that as he is still fuming as he felt he was dissed and then stabbed by the same person as a hook up went bad. Cruisers or at least the street walking/hunting ones and those who do not traverse such scenes consistently usually take the trek in holiday times as Christmas or New Year periods and by the man’s own admission as he felt “thirsty” according to a rather lengthy WhatsAPP thread where the man vented his upset quite openly. The laughter was palpable but the seriousness of the proverbial ‘changeling’ nature of some of this was not lost to us. The group is a mix of cruisers and other men who engage in gay sex with some experience.

This latest episode occurred in the eastern end of the New Kingston area on December 24 around 10pm both men came into contact with each other after picking up on each other (gaydar I imagine) and they both moved to finding a space to explore what they felt. After some negotiations according to the man on the WhatsAPP thread they settled on what was to go down between the two. Such circumstances tend to go beyond the typical as excitement sometimes can get to a sexual fever pitch and other action comes into play. It appears by the man’s own admission he wouldn’t normally do rimming with other men outside of his main partner and or if the recipient is “clean” a long exchange ensued on that diversion much to the laughter (lol and dwl) of some participants.

The men then started to ‘get busy’ and action picked up as both men liked what they saw and the other party seemed “clean” enough. As the rimming phase of the fun came into play the man admitted although he was doing the job he did not probe deeply enough (my words) or in essence penetrate the anus with his tongue by forcing himself passed the sphincter muscle opening. A typical rimming job or ‘fridge cleaning’ or ‘batty-wash’ a term made popular by dancehall artists such as Vybz Kartel and more so Alkaline(aka the rimming DJ) exercise is usually restricted to outside the anus by the opening of the sphincter muscle opening which can be just as pleasurable as actual penile of tongue penetration with the unusual high amounts of membranes at the area. The man admitted in words to the effect that the musty scent devoid of other expected scents was a kind of reassurance that the man was hygienic but no deep probing was done none the less. The man conducting the ‘cleaning of the fridge’ was busy self pleasuring but found himself the subject of demands by the standing recipient who instructed the rimmer to enter more deeply.

The rimmer hesitated for a moment but still proceeded as he was before; only to have the man attempting to forcibly pull on his head and backing up his ass in or on the man’s face. It was there that things got out of place and both men ended up in an altercation. Things cooled but the recipient wanted more or continued action while insisting deep tongue action, when the man suggested what appeared to be partnered masturbation (“shake off”) but the recipient wanted the tongue in his ass and by any means necessary. After some verbal persuasion the man still refused and decided he was leaving the scene but the man would have none of it and another round of a physical struggle ensued so much so that both men ended up on the ground struggling; the man found it funny and in what seems to be playful but rough language used terms such as “come nuh baby” and so on.

But things quickly moved to the next level as the rimmer really lost his cool, in the aforementioned thread “mi haffi fix de boi” (I have to fix the boy) and there was where the knife was drawn by the other man and the struggle went on. It resulted in a minor stab would on the right hand of the former rimmer from a ratchet knife the other man had and a banger phone that had fallen from the man to the ground was smashed under foot as they tussled. The men parted and an argument continued until the stab victim used a rag he had in his back pocket to wrap the wound and stop the bleeding. Then the unexpected came as the rimmer made his way to the main road he was outed so to speak as the exiting perpetrator pointed him out to passersby. Talk about dangerous closet queens who can be more dangerous than homophobes indeed. Both men then went their separate ways but he says he knows where the man hails which may suggest this may not be over by a long shot.

This one reminds me of an older case in the early 2000s where a similar matter occurred but it did not have the knife play element to it. There seems to be a string of newbies in town who have been noticed by older or practiced cruisers (the more adventurous ones that is); a reader who identifies as a cruiser suggested that I needed to differentiate the types of hunters as he does not do masculine spaces such as old buildings, abandoned garages or so on as I had hinted to in a previous post but he is a more plaza operative type or lavatory visitor, problem is such spaces have been rapidly disappearing in the last decade. This loss of space is also playing a role in how the population’s sex seeking behaviours play out literally. The old remaining section of the cholera cemetery for example where that now infamous emaciated HIV positive gay homeless man photo was taken is up for major development, bushing has removed the hiding/secrecy element, male commercial sex workers, homeless MSM/transgender and cruisers have all been impacted as the government and proposed developers are at odds as to the way forward alongside police patrols and local municipality clearances.

Increased police patrols generally also have had an impact of some of this which was kind of surprising to me when this matter came to hand. Post that townhall meeting with the outgoing Police Commissioner where he addressed the homeless gays in the Shoemaker Gully also had made the area off limits as the cruising community watch these things and plan their routes and hookup activities.

Happy hunting and just be vigilant and safe to include reading the man before you both get down or if it is a group even more reading is important.

Dancehall Act Alkaline (Rimming DJ) Nevis Show To Be Cancelled to Fears of him having negative influence on citizens

There is a way in which hypocrisy just shows itself up funny how these same Caribbean states when homophobic putrid spilling artists came to their shores they never banned them but a young artist Alkaline with all his controversy on oral and anal/oral sex in his songs for ADULTS I might add is to land voices suddenly appear out of nowhere.

Here is one of his songs that has made him so controversial owing to the section on anal/oral activity or rimming suggested in one line:




Even when other non controversial stars including others from Trinidad and such go to St Kitts/Nevis there is no such outcry so why this and why now?
Where are the antigay groups such as Jamaica CAUSE, Lawyers' Christian Fellowship and others who are claiming the stifling of "freedom of speech" by LGBT lobbyists or indeed the other dancehall acts who have joined that corner due to pressure from the Stop Murder Music Campaign on their kill gays subjected materials in their repertoire?

Silence! ............ Hypocrisy! ............ Selectivity! as per usual.

Fears of him having negative influence on citizens

News reports out of the island of Nevis claim that Premier Vance Amory wants a concert featuring Jamaican entertainer, Alkaline, to be cancelled over fears of his social and moral influence on citizens.

While the reports coming from the island suggest that the relevant permits for the concert to be held tonight will be revoked, a representative from Alkaline's camp told THE STAR contact was being made with a business partner on the island to have the matter resolved.

However, up to press time yesterday, it remained unclear whether the matter was cleared up as the representative is said to have reported that the matter was still being discussed.

"I checked back but I still have not been given any updates yet," Alkaline's representative said.

In a statement posted yesterday on the website NevisPages.com, the premier said it is necessary for the Government to take a stand on matters that have the potential to cause further deterioration of the social environment.

He said the cabinet of the Nevis Island Administration does not support the concert.

He said there had been no indication certain local authorities had been made aware of the impending concert to feature the Jamaican entertainer.

His concerns were also communicated to the Commissioner of Police Dr C.G. Walwyn.

In a statement by the commissioner, also on the website, it was made clear that permission was granted to host the concert by the Nevis Division of the Royal St Christopher and Nevis Police Force.

The police noted that the artiste and promoters were expected to conform to the island's laws relating to profanity. However, the statement further said that out of respect for the premier's office, the permission was being revoked.

When THE STAR attempted to get a comment from the office of the premier yesterday, we were told that he was in a meeting and would be unavailable for the rest of the day. The action against Alkaline, whose given name is Earlan Bartley, follows another case earlier this year in which deejay Tommy Lee was prevented from performing in Dominica.

Alkaline, The young rising dancehall phenom who is accused by some of devil worship took a photo in the main Cemetry in Basseterre, Saint Kitts and Nevis the Springfield Cemetry. 

The artiste is on St.Kitts Nevis since Wednedsay for a scheduled performance on Saturday in Nevis. The Premier of Nevis essentially cancelled the event and according to reports Prime Minister Dr Denzil Douglas facilitated the move of the event from Nevis to St.Kitts. 

Within hours after the announcement that he would be performing in St. Kitts the island was rocked with an unprecedented shooting incident which claimed the lives of three young men. The shootings have given rise to much speculation and theories of devil worship and collection of souls.

If tattooed black eyeballs wasn't enough to fuel these seemingly outlandish assertions then taking a photo in a Cemetery certainly would. 
Although it would be a stretch to link the presence of Alkaline to any crime on the island there are many who can frankly maybe credibly argue that the unprecedented carnage of last night was as a result of the presence of evil spirits. And with an artiste with tattooed black eyeballs posing for random pics in a Cemetery one cannot help but give the theories of collecting souls and evil spirits some second thoughts.

One pastor has declared that God spoke to the Nation through Premier Vance Amory and the young people laughed and ignored and as a result the nation is now paying the price and feeling the wrath of god. Is Premier Amory a prophet? Is he our Noah ? I am hearing done bible thumpers declare that he is. 

Whatever the case we cannot deny that this whole saga has seemingly brought a dark cloud of controversy and evil over the country. Not that we haven't had that cloud for the last 19 months but this cloud seems to be much darker and sinister.

So are the labels of Premier Amory as a modern day Noah and a Prophet And Alkaline as some sort of devil Worshipper justified or are we all just being plain ridiculous ? 

Tonight is a full moon. Can we expect more evil? Is everyone simply overreacting to this whole issue? Will officials allow the show to proceed? Let's wait and see.

Let us see how this one plays out eh.

"Rimming" promoting DJ gets blamed for freaky singjay's ostracism & death threats

So as two newer dancehall DJs continue to push the envelope in terms of once tabooed freakish promotions in their song lyrics one is now complaining that he and his music has been ostracised and disc jocks on sound systems are very reluctant to play his song, J Amsterdam has been reported in today's Star News Entertainment section that he underestimated the backlash from his provocative "Wine Inna Mi Face" (sit or squat while rotating hips in ones face) song which is targeted for the heterosexual market, the song has gotten some attention in as far as the sex industry is concerned as I have heard the track on several trips to strip clubs in Kingston and St Catherine but according to J Amsterdam it goes no further, here is the article first from the Star bearing in mind that oral sex like homosexuality were once strongly resisted by dancehall acts back in the day:'Local DJs refuse to play my music'



Freaky dancehall singjay J Amsterdam says local DJs are refusing to play his music because they are afraid of the stigma.

According to the Wine Inna Mi Face singer, Jamaica's music industry is not prepared for his level of 'freakishness'.

"I think they don't want to play the song because they don't want to be associated with that kind of thing, and that's why so many people were going against it on Facebook," he said.

The singjay also said while he does not blame DJs for not playing his song in an attempt to protect their reputation, its blatant hypocrisy.

"If DJs played it, they would get 'fire bun' and honestly, I don't think they would want to risk their career," J Amsterdam said.

He also told THE STAR that he misjudged the level of backlash he would get for releasing the controversial single, and even made an attempt to retract his admission to having performed oral sex.

"I can't go anywhere right now, and I have been getting death threats. I have stayed in my house for three days without going outside. I have not done the things I said in the song, I was just trying to fulfil my dreams of having a lucrative career. When I did the song I thought the freaks would have supported me, but they have not," he said.

J Amsterdam also commented on Alkaline's 'anal licking' lyrics saying, "Alkaline is making it bad for me right now because people feel that he did the anal licking line because of me, Demarco and Ricky Carty. But what he did in his song with one line is worse than my entire song. This did me more harm than good because I have received no bookings, not even Tiana or D'Angel want to be associated with me. Persons have to be hypocrites to survive in this industry ... Jamaica is not ready for it, and even though I said oral sex in the song, I have never performed it," J Amsterdam added.

In an industry where sex sells, more dancehall artistes and fans are accepting and becoming liberal about oral sex.
Probably sparked by the increase in the number of 'freaky' songs by Vybz Kartel, many artistes are now openly singing about a more risqué lifestyle.


While male artistes had previously openly sang about receiving oral sex, more female artistes are now also boasting about this in their lyrics.


Artiste CéCile received backlash after releasing her song, "Do It To Me Baby," several years ago, and artiste Lisa Hyper was also chastised after images of her were released on the Internet participating in oral sex.


Fast forward to 2013 and at least three female artistes have revisited the topic of oral sex, citing their love of either performing or receiving it.
However, there is far less resistance to those advocating the act. Instead, it seems they have received the stamp of approval from dancehall. The women believe this is an indication of a new dancehall paradigm.
Up-and-coming dancehall artiste Angelina performed her single Head Mistress at Sting 2012. The song, which blatantly explains her oral sex experiences, was well received by the audience.


Demarco referred to in the article also found himself for some flack as his newest video/song "Ride" was considered too racy that he was cut from the Youth View Awards in January, of course older DJs such as Babycham already pushed the envelope with his older track "Boom Tune" but what J Amsterdam, Alkaline (Anal Licking song fame) are up to is child's play, the video, which features Demarco alongside two females who appear to be performing oral sex and other sexual acts on each other, has been described as pornography, distasteful and tacky. Still, others have hailed him as being groundbreaking and different.

Following the backlash, Demarco released a statement to THE STAR stating that the video was meant for mature audiences only.

"Amidst all the tattering (which is much ado about nothing), it is important to note that my video is intended for mature audiences only. This is explicitly stated at the beginning of the visuals, which contain nothing most 'mature' individuals have not seen or been exposed to in their lifetime. As a further precautionary measure, the video was never released via any of my official outlets (Twitter, Youtube, Facebook, Instagram, etc.), but unfortunately perpetuated to social media platforms by overzealous individuals," the release read.

Demarco added that it is the responsibility of parents and guardians to safeguard minors against such offerings through proper parenting and vigilance.

"The hypocrisy of our society is so paradoxical; accusing me of lechery, yet here's the real truth - only weeks earlier I was the good Samaritan saving a woman's from the clutches of death after she cracked her skull in a severe car accident outside my studio compound. myself and my team rushed her to hospital.

"Aside from a selected few, no one saw the need to highlight this. I also donated a sizeable contribution in back-to-school supplies to various inner-city children in Kenya and Jamaica, another deed treated with utmost inattention."

Making mention of the fact that he released a song titled It's Not Right, campaigning against various atrocities committed against children with little to no media attention, Demarco stated that there are more important issues affecting our nation that need attention.

"The focus that is being thrust upon this video should be given to matters such as the disenfranchised youths of this country, the rising rate of unemployment, lack of proper infrastructure for our children to learn, squatting, the crime epidemic, among other social issues." Who can also forget the Vybz Kartel photo and discussion surrounding the demand of oral sex being performed on men but not vice versa which has been readily accepted. 

I find it interesting from a DJ's standpoint mainly that the tide has turned so radically excluding homosexuality's coverage in dancehall of course but to see a once tabooed matter getting open proponents in song would have been unheard of ten years ago this is outside of the acceptance and fad of bleaching by men once linked to male homosexuals and tight fitting pants or jeans as well led by of course Vybz Kartel. I guess there are certain lines that may not be crossed in this lifetime but will true tolerance from a local DJ for homosexuality ever come? Let us see.

Is this art or desperation for attention by unheard of artists, I agree with Clyde Williams musicologist, former producer in the dancehall arena and judge on Digicel's Rising Star show where he said we need to be careful that the cure does not become worse than the cause since some religious folks have suggested censorship and banning of any material with even the slightest hint to sexual content. Poor parenting is the main culprit identified in a recent radio discourse he was apart of also present was Daniel Thomas from the anti gay group Love March who suggested outright theocracy; he was however cautioned by Cordel Green of the Broadcasting Commission that while the free availability of Xrated materials it should be made NOT available to minors with the ease of which they are out there now; financial sanctions are also being considered but the matter of other materials such as books does one regulate strictly that medium too?

His song, 'One Gyal', has received more than 100,000 views on YouTube, but dancehall artiste Gage said fans should not expect a video.

Known for its raunchy lyrics, One Gyal chronicles the deejay's experience with a female, who performs oral sex on him.

However, because of its raunchy nature, Gage doesn't believe a video will happen soon.

Though the lyrics explicitly describe the encounter and is only suitable for a mature audience, Gage insisted that was not his intention.

"Mi neva really plan fi write di song fi one audience, mi just put pen to paper and the lyrics come out. It just happen that only an adult can listen to it," he said.

The artiste said despite the song's sexually charged lyrical content, it has been doing well on the local scene.

"A crazy talk bout it in the streets. I would say 99 per cent of people like it, and that's what matters because everybody nah go like it."

When asked about the sexually aggressive turn dancehall has taken, Gage said some artistes have taken things too far.

"Mi feel like dancehall stray from Mavado and Kartel days. Dem man deh make lyrics talk fi dem but nowadays artiste feel like dem affi do something outta di box fi get a hype," he said.

Admitting that he doesn't necessarily support this idea, the entertainer said each artiste is responsible for his career.

"Mi nuh really support some a di tings weh nuff artiste a do, but every man affi do what they think is best for their career, including myself."

Gage, who recently resumed bleaching said that decision was made to improve his image and not to get attention.

"Mi know say mi ago get good feedback and bad feedback. I don't want to be a white man, I'm just doing me, and mi neva hear bleaching do nobody nuttin yet," he said.

Though unsure of the release dates, Gage is working on a number of singles including Hey Mama pt 2, Candyman, Fashion Police and City Rock.

Controversial dancehall artiste Ricky Carty, who opened the floodgates for critics recently with one of the most explicit music videos in dancehall, has released a more positive single.

The single, Sure Love, is poised to create a positive vibration for the artiste as he seeks to mute his doubters.

Ricky Carty has also rebuffed the stance of the Christian Brethren Assemblies of Jamaica (CBAJ), who recently bashed him for what they called promoting "sexual and moral depravity that has eroded basic concepts or respect, dignity and discipline from our culture".

The Christian group also stated that the authorities should put an end to what it claims are "controversial music videos" laced with strong sexual images, including group orgies, lesbian simulation, and oral sex.

In response, Ricky Carty said, "Even among the church dignitaries, they are doing far lewder acts. People who go to the church for assistance, they take advantage of them because no one will know. When it comes on to Ricky Carty and his video, he is not doing anything strange or ludicrous."

He added that he has other positive songs which are not being highlighted.

"It's nothing we haven't seen, many artistes have positive music, even I myself have positive music releasing shortly, but they don't highlight that. They didn't do a press release thanking these artistes about their positive work in helping the youth and helping to build the country. They try to beat down and belittle artistes getting a buzz, and it is very strange," said Ricky Carty.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard



When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues


If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
