In response to numerous requests for more information on the defunct Safe House Pilot Project that was to address the growing numbers of displaced and homeless LGBTQ Youth in New Kingston in 2007/8/9, a review of the relevance of the project as a solution, the possible avoidance of present issues with some of its previous residents if it were kept open.

Continued conflation of same gender sex & abuse

It's not even the end of Child's Month yet another young one has been named as a The Clarendon Police are investigating an alleged case of buggery against a seven year old boy in the community of Cemetery Road in Denbigh. The incident reportedly occurred on last Wednesday. It was only recently I did a post entitled: 


Two brothers from the community accused of committing the act were attacked by a mob, chopped and stabbed.They were rescued by the police and taken to hospital.

Residents protested on Friday about the alleged attack on the child and the arrest of a member of the community who was involved in the mobbing.

Operations Officer for Clarendon, Superintendent Carol McKenzie, says one of the brothers who is considered a suspect remains hospitalised under police guard.His brother was treated and released.

Superintendent McKenzie says investigators are awaiting the medical report on the child.
A Hiace bus was said to be burnt by an invading mob as well alleged threats to family to leave the community.

The outrage from the public is justified if the allegations prove to true, it the conflation however of paedophila with same sex that is the problem, they don't even bother to check Google. Persons are claiming justified homophobia in a sense as in changing the buggery law with give  cart blanche to men to have access to little boys. 

Pedophilia or paedophilia is a psychiatric disorder in which an adult or older adolescent experiences a primary or exclusive sexual attraction to prepubescent children. Although girls typically begin the process of puberty at age 10 or 11, and boys at age 11 or 12,criteria for pedophilia extend the cut-off point for prepubescence to age 13.[1] A person who is diagnosed with pedophilia must be at least 16 years old, and at least five years older than the prepubescent child, for the attraction to be diagnosed as pedophilia.

Pedophilia is termed pedophilic disorder in the Diagnostic and Statistical Manual of Mental Disorders (DSM-5), and the manual defines it as a paraphilia involving intense and recurrent sexual urges towards and fantasies about prepubescent children that have either been acted upon or which cause the person with the attraction distress or interpersonal difficulty.[1] The International Classification of Diseases (ICD-10) defines it as a sexual preference for children of prepubertal or early pubertal age.

In popular usage, the word pedophilia is often applied to any sexual interest in children or the act of child sexual abuse. This use conflates the sexual attraction to prepubescent children with the act of child sexual abuse, and fails to distinguish between attraction to prepubescent and pubescent or post-pubescent minors. Researchers recommend that these imprecise uses be avoided because although people who commit child sexual abuse sometimes exhibit the disorder, child sexual abuse offenders are not pedophiles unless they have a primary or exclusive sexual interest in prepubescent children, and the literature indicates the existence of pedophiles who do not molest children.

Pedophilia was first formally recognized and named in the late 19th century. A significant amount of research in the area has taken place since the 1980s. Although mostly documented in men, there are also women who exhibit the disorder, and researchers assume available estimates underrepresent the true number of female pedophiles. The cure for pedophilia has been developed, but there are therapies that can reduce the incidence of a person committing child sexual abuse. The exact causes of pedophilia have not been conclusively established.Some studies of pedophilia in child sex offenders have correlated it with various neurological abnormalities and psychological pathologies. In the United States, following Kansas v. Hendricks, sex offenders who are diagnosed with certain mental disorders, particularly pedophilia, can be subject to indefinite civil commitment.

Nicholas Groth is a pioneer in the scientific study of sexual offenders against women and children, who has treated over 3000 child molesters over the course of two decades. A former director of the Sex Offender Program at the Connecticut Department of Corrections, Groth is the author of Men Who Rape: Psychology of the Offender, a work widely regarded as a classic textbook on the psychology of sexual violence.

He concurred in a recent debate on homosexuality vs paedophilia that Homosexuality and homosexual pedophilia are not synonymous. In fact, it may be that these two orientations are mutually exclusive, the reason being that the homosexual male is sexually attracted to masculine qualities whereas the heterosexual male is sexually attracted to feminine characteristics, and the sexually immature child’s qualities are more feminine than masculine. . . . The child offender who is attracted to and engaged in adult sexual relationships is heterosexual. It appears, therefore, that the adult heterosexual male constitutes a greater sexual risk to underage children than does the adult homosexual male.

The general belief in the stereotype that "Homosexuals are dangerous as teachers or youth leaders because they try to get sexually involved with children" or that "Homosexuals try to play sexually with children if they cannot get an adult partner." is very real in our scenario.

Assault under the guise of assistance

In previous posts I had attempted to address the business of the ‘couch surfing’ as temporary solutions that go bad or a hidden agenda revealing itself. April is Sexual Assault Awareness Month here and on sister blog GLBTQ Jamaica and while I started off on a more biblical note this year often used as justification for pastoral abuse or children other forms of assault are unfortunately ongoing. It gets more complicated when it has men who have sex men involved either as the impacted individual or the perpetrator. 


There are still reports of persons supposedly ‘kotching’ or crashing by a ‘friend’ or stranger who opened up their doors seemingly being honest only to abuse persons by playing on their vulnerability and the need they may have at the time. Co-dependency liaisons also can drive some of the nonsense as a privileged man who may be alone or lonely who turn his lesser powered male co-habiter into a house slave of sorts or sex slave demanding sex on call and if the lesser powered man refuses it can turn violent until the latter is able to run away from the crap.



Legal implications

One cannot simply just walk into a police station and report that he was raped or sexually assaulted as the buggery law or other legislation might kick in which may also see the ‘victims’ finding themselves detained. The laughter alone from personnel is enough and or dismissals and humiliation in the precinct can be a major turn off. That would also depend on what is unearthed in the investigations and what content the reporting party placed in the police report. Any hint of anal penetration whether by an object or penis or a fingers (grievous sexual assault charge) can be problematic on many fronts; on the part of the police suspected illegality cannot go un-responded to in the precinct of a police station at that; then there is the business of gathering the evidence for the case by way of the physical examination of the parties which can get sticky if there was shower taken or any other anal health or hygienic course by the receptive partner in particular to raise the suspicion on penetration. If there was no strong tearing or scarring of the area or the sphincter then the level of suspicion will be lesser still or if things such as Preparation H creams or PH adjusting enema or fleet product were used after the act to cool down burning or itching after the fact.

How many stories one has heard of persons sleeping at night only to find themselves with a ‘heavy weight’ on top of them; tabloids such as the Star News and the now defunct XNews were good at that and some sort of non-consensual sex occurs, from the non penetrative or missionary sex or partnered masturbation to the perpetrators pleasure or full on anal rape. The misguided or sensational tabloid reporting may be a function of ignorance of MSM relational matters I suppose. Some have actually argued that non-penetrative sex acts albeit without consent such as intercrural sex cannot be seen as assault or abuse but often such persons leave out the non consent component. It is as if there is a hierarchy for tolerated abuse or it may be justified as a form of payment for whatever the assistance that is being offered. 

The impacted party will never be comfortable psychologically during the act as far as I am concerned; to simply lay there like a dead log and the man presses his penis under the crotch between the testicles and legs of the ‘victim’ often with psychical restraint is still abuse. Once there is no consent whatever the act may end up as it is rape simply put; psychological rape if you will, some may see male rape by another male as simply the act of forced anal penetration experience but they are wrong. Obviously forcing persons to perform oral sex as well undress pain of eviction or other threats including at gunpoint as a case in 2013 is wrong and shows how far some perpetrators will go to knowing that they may not be caught or prosecuted that easily if any.

Unless the aggrieved party is prepared to go all the way with the case despite the challenges then like others before they will simply retreat often into silence or with knowledge of a few close friends. Psycho-sexual interventions can be sought by referrals but the legal side of it all is a problem yet still; the attempts to have the buggery law decriminalised to include the rape component linked to non-consent and ages of consent is still stalling despite the middle of the road sensible suggestion. The question therefore is how many MSM have been assaulted by more privileged men who exploit their vulnerabilities?

 Those power differentials are a main factor for abused to continue to get abuse and apart from some physical retaliation or running from the situation as mentioned above the former can and has led to murders within the MSM community. A few such murders have been seen as ‘crimes of passion’ more so by misguided antigay groups/activists to justify their hate campaigns without understanding or seeking to enlighten themselves or the social constructs in our world; they pray on the national ignorance nationally on male homosexuality in particular.

It is the retaliation of such abuse sometimes outside of robberies, so called crimes of passion and or jealousies between lovers and genuine homophobic cases that have led to some public murders in times past which further colours the whole affair of public perception of male homosexual life.

The business of consent is crucial in the shelter assistance gift being used as a guise to assault persons, if it were a case of the parties consenting and the soon to be assisted or even during the aid one is approached and there is agreement then we are dealing with a horse of a different colour. But to allow persons to relatively get comfortable and then seek to abuse them is just plain wrong whether there is anal penetration is involved; it is the principle of the thing that is important. But what to do about those who prey on weaker or desperate men for purposes of control? To bring them to book when it involves adults is difficult; obviously with a minor there are adequate laws including the Child Care & Protections Act and Carnal Abuse legislation.

Crime of passion linked to August Town shooting, transvestite said to be involved

A woman is in police custody this afternoon in connection with the murder of a 52-year-old man in August Town, St. Andrew.

The man has been identified as Trevor Grey.

Grey is from the Queen Road area of Maxfied Avenue in lower St. Andrew. He was shot and killed last night in an area in August Town known as Griz Close.

It’s understood that he was attacked by a group of women to include a couple transvestites who pass very well and other women who got involved in the melee in a fit of jealous rage as the deceased was set to be involved in a liaison with one of the women involved.


Head of the Corporate Communications Unit CCU, Superintendent Stephanie Lindsay, this afternoon confirmed the arrest.

The woman is to be questioned by the police.

Mr. Grey’s killing is the third in August Town since the beginning of this year. The peace efforts were pushed by artists such as the antigay Sizzla Kolanji who was sited in a public function marking the achievement earlier this year.

There were no murders in August Town during 2016. Earlier this year this happened as well:

 August Town has recorded its first murder of the year.

The murder comes on the heels of last week’s celebrations, when community members and stakeholders rejoiced about a one-year streak without recording a murder in the community.

Police say that a man identified as Damion Lewis, 25, of Love Lane in the community, was shot dead by an unknown assailant at the intersection of Bedward Crescent and July Road, yesterday.

The August Town police say that about 6:25 pm, Lewis was walking along the roadway with a friend when upon reaching the intersection, they were pounced upon by a lone man armed with a gun. The man shot Lewis.
When the police got to the location, Lewis was taken to hospital where he was pronounced dead.

Rihanna’s “Love on The Brain” & the ‘He beats me ‘cause he loves me’ issue

I was listening to the captioned song by Miss RiRi as one of the newer remixes out there as a promo and it hit me like a ton of bricks the song is actually about what appears to be tolerated abuse by the victim while supposedly being ‘in love’. The original recording is a little difficult to hear the vocals clearly as it is a rock sounding track and the guitar tends to overshadow other elements of the tune. As Jamaica is undergoing a rather bizarre set of cases of abuse and or intimate partner violence episodes with some awful outcomes this is not the kind of song we should be processing right now frankly, sadly it is extremely popular even on the LGBT circuit at parties circuit and it bothers me. The old ‘he beats me because he loves me’ thinking is very much alive; whenever others try to intervene or when the abused individual visits the police station for example they file a report, then change their minds afterwards and try to justify with the beat for love narrative, hence leaving the cops to effectively stop following the matter.

The opening stanza of the song is enough to tell us as to what it is about and frankly I have retired it from my playlists and sets.

That a mainstream artist as young as Rihanna is handed or forced to do a song such as this to perform to mostly young(er) impressionable fans that gobble up materials without the requisite checks and balances should be of concern. I am assuming that Miss RiRi and management are tied into a contract that may basically say sing what we give you or else, of course in a subtle form. I have been digging other new songs from her such as “Needed Me” & “Sex With Me” and spinning them in my sets both clean and explicit versions; although the latter is a little racy and more for adults but it does not promote violence directly although the “ .....switch on a fake nigga like a station..” line is kind of hinting towards black ghetto life and belittling hypermasculinity/bravado; the use of the word “nigga” is well known to many that that means a gangster or as in our case the dons. The redeeming line follows however in a sense “Vodka & water and a lemon and a few other things I cannot mention,” which seems to retrieve the dignity aspect of the track. While there is an ongoing national uproar about whether dancehall is influencing violence as life imitate art or vice versa (if one can call some of the stuff these days art) here is a big pop song brought in quietly over the mainstream and played on radio.

Same gender liaisons challenges

The unanswered question of the age for me is why would someone who is the subject of abuse outside of a co-dependency issue stay in said union and take it and then when it comes to crunch time the justification is ‘he beats me because he loves me?’ do not for one minute believe that this a hetero-normative construct only because it’s definitely not; especially when there is the aforementioned co-dependency matter at work. A poorer gay man versus a monied or privileged man in a liaison and the main driver is not necessarily sex but also control as the motivator which can lead to abuse. The lesser powered man is sometimes forced to take all kinds of abuse including sexual, psychological and violence against his person re-emphasizing the dependency element; while he may have some difficulty reporting same to a police station; he may be the brunt of humiliation, homophobia or simply ignored by the cops and chased away from the precinct. Once the cops realize it is more a lovers’ quarrel bordering on an old crime of passion mantra one can just walk away or if one is strong enough take it to a higher authority such as the area’s Superintendent and such. It might get a little tricky if there are hints of rape or sexual assault when it comes to two men, a buggery charge might hit one or both if they don’t handle themselves well or have an attorney present to wade through the matter. The lesser charge of grievous sexual assault might also creep into the mix.

There was some attempt via the USAID Comet II training exercise with some cops in 2016 but that only seems to target new recruits and not necessarily the older ones who are set in their ways; after years of very little strong oversight and workshops for capacity building via improved customer service experience. Some changes have come through at certain stations but others the bad habits are still there, but change is usually slow anyway.

Conflict resolution interventions if not far more public awareness programs are needed, despite we have a dispute resolution mechanism and a hotline service they are not promoted enough and the other ones that are out there tend to be more so female based for the most part with the man being the aggressor. Campaigns since the upsurge in intimate partner violence cases are too flat in my view and sound too politically correct, flat and cannot be compared to the strength of the cadence of what dancehall acts for example use in more misogynistic songs. The message has to be firm and placed in a real world context not presented by some middle class person who has never experienced any pain or is in tune with the culture in a far more real way than just an observer in an observational tower or privilege. I was expecting more on the grounds of foreign songs with similar messages to RiRi’s i.e. some rap for example that directly promote violence against women, but what do we do, censorship is an issue as well but there is also responsibility on the part of artists, song writers, producers and so on.

It seems what is popular trumps what is right in the scheme of things when the current hot matter of alleged new recordings of Vybz Kartel while serving a life sentence; it does not seem to matter that Kartel is a convicted murderer indeed the incarceration of him is seen as a stripe of sorts; the deafening silence from the prison authorities is telling when in fact it is only the Tower Street facility aka General Penitentiary, GP that has recording equipment my short time there I remember but they maybe old nowadays as analogue ones i.e. reel to reel tapes device versus newer compact hand held devices such as tablets with a good microphone, auto tune and Q-sound technology does the rest for the post production to finished product; when compared to the voice quality of the ‘new songs’ (or as we are told previously recorded tracks) it suggests that much higher grade of device(s) such as a phone were used. That also speaks to the business ‘contraband’ and what is allowed in and by whom. The subject matter of the ‘new songs’ is telling as most of the songs content are counteraction songs and also dealing with present matters and clashes with other rival artists so it cannot be that these songs are previously recorded materials held in wait for release and sale.

There are other songs even done by female dancehall acts though not popular as some of their male counterparts that hint to the ‘he beats me because he loves me’ mantra. The songs usually have one-liners contained suggesting that there would be no separation in the relationship even though the male in the union may handle the woman rough. Similarly to having a prison sentence or serving time as a stripe of ‘badness’ the physical scars of violence is also sold as a sign misguidedly of a strong relationship. It is almost a confirmation of submitted power to the man probably borne out of years of patriarchy and misogyny well established in dancehall music for example and some early reggae. Other rap songs also have such content and even spew threats to women who say they are ending the relationship there will be violent consequences even as the man has multiple partners sometimes knowingly to the threatened woman. Tracks such Cam’rons “Bitches Aint Shit” from way back in the 2000s though sexually suggestive via the “beat my bitch with a stick” line the threat element comes in where he threatens that if she leaves she’ll get a “dick in her mouth” and so on. Other older rap such as Cash Money Millionaires’ “Project Chick” from the Ballers Rollin’ album is quite clear, similar to Cam’ron is very suggestive as long as the woman is willing to comply at whatever costs, and failure to comply would have serious consequences. I don’t think I need to get into the days of 2 live Crew’s materials they are noted for their misogyny and such.

Artistry and repertoire (A & R) departments these days from record labels seem interested in pushing the envelope in terms of making too pretty or clean imaged females more street credible but are going overboard as music sales still struggle when compared to the days of CDs, vinyl and so on, case in point Miss RiRi herself nearly on the songs on the album are cutting it close designed to make her obviously more edgy. Mariah Carey’s latest video for example looks more like a lingerie advert instead of the polished diva we are used to; it is not the first time she has collaborated with rappers but this new one is kind of a turn off to many as they question why is she going so hard (or her handlers) to match up against younger stars? She is already the queen in certain respects as she really does not need to and while I can appreciate coquettishness to a point there are limits frankly. There is a reason why Diana Ross and the older gurlz have lasted so long without having to show too much leg, cleavage and hips albeit enhanced for some these days.

A word on church hypocrisy


Even as so many disturbing cases involving pastors and men of the cloth accused of inappropriate sexual contact with minors or psychologically weak women with convictions, the way less outrage from the church groups or the very vocal antigay fanatical religious right (who make the rest of the church body look stupid) is telling. This blog is replete with such considerations in previous posts. Where are the stronger public calls for action from within the church body? The responses so far are unimpressive if not unconvincing why are certain antigay groups more focused of child abuse while rightfully so but hardly any protests, marches as in the antigay pro-buggery mass rallies? The hypocrisy indeed the cherry picking is clear yet still. Yet these same groups were worried about a telephone directory cover with an eighties themed dancehall setting which is child’s play compared to the more raunchy aesthetics that come with the genre. They find millions for buggery constitutional challenges while yet declaring we have more churches per square miles yet we have more homeless LGBT and otherwise per square inch more and more on sidewalks and cities. Some of these folks have missed the boat in terms of God’s work and just true tolerance and caring if not forgiveness. Some seem to be more interested in maintaining their silos fed with tithes and offerings while pontificating on piety similar to the Pharisees and Scribes who crucified Jesus using a Roman system. The recently concluded seminar on abuse while condemning child abuse rightfully but from an outside perspective of the ‘church’ on a whole but very little introspection and a call for pastors to recognize their responsibility; the press releases only reiterate that it’s an outside problems by sinners as opposed an internal issue.

Meanwhile

There is a thin line between fantasy on record versus reality as we are learning nationally, the separation is not clear to some given the death threats being thrown via social media predicated on Vybz Kartel worship towards opposition spokesperson on youth Lisa Hanna by a mere suggestion that a review maybe needed as to allowing incarcerated persons to produce and record new music; the rapidity of rapes and abuse even from men of the cloth all so close to each other in terms of timing says to me that things were festering all along and we thought all was well. We really have to begin to consider the lyrical content of some of the songs and calling for bans on radio is one thing but the same tracks in their raw versions are readily available on an ever expanding set of platforms; with smartphone technologies and APPS it is a synch for any youngster these days. There may be legal implications as well in terms of censorship and our charter of rights. Many parents do not check or are able to check the content being technologically naive so all kinds of things can slip by. Then there is the business of the angel at home versus the bad boy/girl wannabe out of parents’ sight.

I think we need to calm for a while first then decide emotion free as possible the way forward but with fans of Kartel still up in arms we have some seriously embedded evil on the national psyche to contend with. For mostly men and bizarrely some women to openly suggest on social media while ignorant to the cyber crimes act Miss Hanna and indeed other persons who agree with her are to die violently or raped as punishment for the Kartel diss even though she widened the comment to other acts in prison is frightening to say the least. Restraint seems all but dead these days as some seem to think they have license to post or say anything online; we are told that the main instigators of the threats are known and the requisite posts (even after deletion) are being gathered to take the requisite prosecutorial actions by the police as empowered under the cyber crimes act.

Another bout of annoucementitis?

Yet again we hear aspirational soundings from politicians and privileged folks and NGOs but the announced strategies to include getting abused persons mostly women to come forward with the needed psycho social support sound nice on the face of it; while also announcing a shelter for battered women (not the first time) when others have been forced to close down due to lack of funding and help from successive governments. I hope not Let us see whether these ideas will ever come to light; case in point the human rights institute that is yet to come, homeless shelters promised but not fulfilled, infirmaries left to languish although places such as the previously structured Womens’ Crisis Centre and others struggle; there was a merger of sorts in 2015/6 but what has come of that new entity that announcements should come about shelters?

This is by no means the end of this. But should there be a ban on songs with this ‘he beats because he loves me’ mantra?

Shoemaker Gully homeless problems move southwards

The age old issue of mostly young MSM/transgender individuals has moved southwards along the near three mile stretch of the rain water runoff infrastructure. A police raid yesterday of the area after numerous complaints some of which were hinted to in previous posts had unintended consequences as Half Way Tree Road traffic was held up for a short time as raging members of the homeless argued with angry passers-by while the cops tried to keep the peace. Accusations are that since the persons had been removed from the top end of the Gully in the New Kingston business district proper even after said attempts by another set of cops in December 2014 they returned there but since made to move after comments at a townhall meeting by a former police commissioner was followed up with a raid. Since the persons have shifted their use of the gully robberies have increased nearby and according to the police communication unit several personal effects of persons including drivers’ licenses and so on were said to be in the possession of the persons.




The section along Half Way Tree road seems to be now homeless central also known as Kencot Gully for the most part but this is not new as historically it stood as a living spot for decades from the days when the nearby Northern Caribbean University, NCU previously the Highgate Chocolate Factory corporate offices and the car park for the adjoining art Gallery. The gully which runs into an area of Kingston known as Kencot also featured in early HIV/AIDS interventions in the 1990s when Jamaica AIDS Support, JAS (for LIFE was added way later to its name) had its early offices in the area close to the gully on Osbourne Road. So much so that the early GLABCOM typed meetings and support groups were impacted directly alongside the makeshift hospice care facility also. Populations would seek services from JAS and vice versa as outreach teams conduct street based engagements. So we can conclude history is effectively repeating itself but with way newer blood. Older gay men such as myself who are watching this closely are somewhat baffled yet not surprised as it is telling in some respects or an indictment on aging NGOs who knowing the issues or have years of data sitting on have simply not acted as they ought to meet some of this with a residential type structure however small. There has always been an unease as far as I can remember whenever there is a suggestion that said aging NGOs deal with homelessness directly, for the life of me why I just do not know.

Nationwide radio also carried the story in their newscast and interviewed a man who claimed he was the victim of the persons in the gully who cross dress who said he was approached by one of them who asked for some money only for a weapon to be pulled on him against which he retaliated and attempted to defend himself, he said he tried to box (slap in the face) the person but the exchange ended as the intended party made good his escape. 



A robbery at gunpoint also occurred earlier this year nearby the National Works Agency nearby on Half Way Tree road allegedly and at other spots so much so that Jamaica Observer’s cartoonist Clovis captured the issue in his one of his stereotypical caricature of gays as bleached faced yet dark skin tone persons looking masculine in tone but wearing impy-skimpy outfits. ‘Where will this end?’ is a question coming to hand yet again as the cycle is so regular some just simply dismiss the matter and indeed the group of persons as worthless. Jamie Rose, who was among the onlookers, revealed that he was robbed twice by the men who took his cellular phone and $18,000 from his pocket.

“I was robbed... coming from a meeting. As soon as I turned the corner, there was a young man that stopped me and said, ‘Goodnight, Sir, can I have your phone, please?’ and I said ‘For what?’ And him reach for a knife and I double my fist to thump him in his mouth, and there was another one behind me who said, ‘Sir, this could be dangerous.’

“When I looked at his waist there was a gun,” Rose continued, lamenting that it is not safe to walk along the road at night.

Rose told the Observer that he believed the robbers were the same residents of the gully as he recognised their “accent”.

With frustration etched on his face, he said the men should be removed from the gully.

“They need to get them out of the area. I don’t care where they want to go. I know at least four persons that have been robbed, including one of my church brothers,” the man said, adding that the homeless homosexuals are “plagues”.

We have been told of fund raising efforts both online and otherwise repeatedly and in some instances campaigns get stuck in limbo or monies go unaccounted for as the effort is stopped midway and no accountability comes forth to say where the monies are or what has it been used for; while the populations stagnate, all kinds of videos and photo shoots have occurred yet the problem has not changed, all kinds of so called artists claim to have launched albums where part proceeds were to go to some yet no proceeds seem to come (or the albums simply have not sold enough) and all this happening as a new wave of incoming from western Jamaica (more historical repetition) linked to lotto scamming as persons either close to or directly involved have found themselves left in the cold as kingpins fall from grace and once cash rich persons cannot ‘take care’ of drag queen broods and so on. Then there is the business of excuses from places such as JFLAG and Dwayne’s House and or Colour Pink groups all who claim they are “registered” NGOs to deal with homeless but claim they cannot find a place to do such, yet the same JFLAG wants all to simply forget the fact that the shelter pilot they watched close without protest before their very eyes was transformed into their then office.

But who cares about the least amongst us really, they are just dregs in the mix as the protected privileged thrive pursuant to ‘LGBT rights’ and yet again the blaring classism stares us all in the face. Some 11 to 14 different proposals were around at the time when the Safe House Pilot project in 2009 was dubiously closed without a truthful explanation yet former board members of Jamaica AIDS Support for Life engage in trifle tokenism claiming to be collecting canned items while obviously using the photos for attention seeking, a practice that thankfully is now being seen by more persons as deceptive. The preying on the homeless is not new but with social media around these days it is easily done and hardly gets questioned as some do not want to ruffle the feathers or upset the apple cart. The police seem more in control of the situation this time around as the persons for the most part were allowed to vent as members of the public hurled negative comments and homophobic remarks.

The other difficulty with this is that other miscreants also commit infractions in the area and in New Kingston and the age old blame game continues, not that there are not bad eggs in the populations but the trick is who to believe or not. So the gully populations get the blame whether or not for robberies and such, then there is the clash between cruisers and the homeless also continues. A recent standoff in December was evidence of that but it never led to any serious injuries as one before. Those who have been helped in some way have either lost the assistance or are too few to be counted as success stories while the majority are left to fend for themselves. Never leave out the ‘subject of study’ element with academia who only use the populations for academic sport and intellectual masturbation which include documentary productions which are shot taken back and no reciprocal assistance as said producers make good on the professional profile enhancement.

It is not as if solutions are not on paper somewhere but unwilling NGOs and such thrive on but do not want to get their hands dirty with this. This unwillingness is not lost on the public.

Gay, straight gang war leads to murders, May Pen mayor wants to reduce crime

A war between two rival gangs in Rocky Point, Clarendon, a division which recorded six murders last year, is said to have started over an ongoing conflict between homosexuals and straight men in the area.

Information reaching THE WEEKEND STAR is that members of the Compton and Cuban gangs have been at odds for more than three years, so much so that battle lines have been drawn in the informal settlement.

Councillor for Rocky Point and Mayor of May Pen, Winston Maragh, explained that the war started because of a murder.

"I represent the community, and over the past two years Rocky Point has had numerous murders. There are two gangs - one over on the western side and the other on the eastern side. They keep fighting and we don't know what they are fighting for," he said.

"My investigation is that it started with a gang of homosexuals against a gang of heterosexuals. You kill this one relative, then they come back and kill. Reprisal, until everybody gets involved. One of those killed was regarded a good boy, but he was the brother of a bad boy. They couldn't catch the brother, so they killed him," Maragh said.

Ghost town

The mayor also told THE WEEKEND STAR that the entire community was flooded with guns.


"The police have managed to come in and intervene, and it has now calmed down. The main players were caught and some of them killed," he said.

According to some residents and officials, the crime situation has been so bad that the area is like a ghost town after certain hours.

"The fear is still there. If I call a community meeting now, they tell me start 2 o'clock and finish by 6," Maragh said.

All hope is not lost as Maragh said he has embarked on initiatives aimed at rescuing the community.

"My community renewal programme will take care of that when fully implemented. It will be over a four-year period. It is intended to reduce crime and make life easier for everybody," he said.

Head of the Clarendon Police Division Superintendent, Gwendolyn Cameron Powell, also told THE WEEKEND STAR that she is aware of the gangs operating in Rocky Point.

"Policing Rocky Point has been an issue, however, the police have been managing the crime situation," she said.

THE WEEKEND STAR spoke with several community members who said they were aware of the two gangs. However, no one was willing to state which one of the gangs represented the gay or heterosexual side.

Three Constables Charged For Breaching the CPA Three Police Constables of the Hanover Division who were arrested last week by detectives from MOCA West, were subsequently charged for breaches of the Corruption Prevention Act, according to MOCA.


They are Shemroy Hewitt, Andre Drummond and Conrod Clarke; all stationed at the Hanover Police Headquarters. Allegations are that on Tuesday January 3, 2017, the driver of a Toyota Corolla was travelling along a main road in Hanover when he was stopped by a team of policemen. The occupants were then ordered out of the vehicle and during a search, documents relating to lottery scamming activities were found. 

The three policemen then solicited and later accepted the sum of One Hundred and Fifty Thousand Dollars ($150,000.00) from the driver, who subsequently reported the matter to detectives from MOCA West. Following interview sessions and an identification parade, charges were laid against the Constables. 

They were placed before the Hanover Parish Court on Monday, January 16, 2017 where they were each offered bail in the sum of Five Hundred Thousand Dollars ($500,000.00) with sureties. 

A Stop Order was also placed on them and they are scheduled to return to court on Wednesday, February 28, 2017. The alleged scammers who said to have paraphernalia of contacts overseas and lead lists were not arrested even after the sting operation was set up and the cops nabbed. This suggests that the allegations by the cops was false it seems as their wrong is now being exposed.

They are to return to court on February 28 after being granted bail in the Hanover Parish Court. They were each offered bail in the sum of $500,000 with sureties when they appeared before the court.


The last time there was a similar case carried on this blog was: 
Cops freed of corruption charges shakedown of gay men in 2015. That case ended due to want of prosecution as the two men who made the report did not follow up for the preliminary hearing and court mention dates, even after reporting to MOCA and having them extend state resources pursuant to a successful sting operation.

Another phone thief held, forces victim at knifepoint to unlock phone

So the homelessness guys issue and other thugs outside of the Shoemaker Gully main group have come up for some accusations of robbery in the New Kingston business district; a gay man was relieved of his BLU smartphone on December 22 I was able to confirm, the man however even after releasing the phone to the robber was effectively re-assaulted after the robber realised the phone was locked not only with a password which could easily be wiped by a factory reset but APPS that offer remote protection were active. Said APPS can be activated remotely to wipe the full contents of the device and SD cards or allow the front facing camera to take a photo and send it to a designated preset email or to the manufacturer as in the case of Apple for iphones and they in turn would alert the authorities as to the stolen device.

A series of phone robberies in that area and other surrounding zones on Constant Spring Road near Popeye’s eatery, the same zone where a soldier earlier in December pulled his firearm and killed a man who tried to rob him after he left a bank of cash and his smartphone is hot again. Another man not known to be gay but hangs out with the more masculine acting types of the group allegedly; one such case was carried on this blog earlier this year as it occurred to a close friend of mine. That phone was never recovered and it never had the aforementioned activated security enablers to act as reinforcements. Complaints have been reported in traditional media of robbers demanding of their victims in the robbery to unlock the phones and disable any APPS for protection while also demanding they try no attempt to take photos secretly or else. Two men who were walking for a popular LGBT spot earlier in December towards Half Way Tree were also relieved of their phones and cash by two thugs said to be linked to the homeless MSM/transgender in the New Kingston region.

The incident was not reported to the police as the victim just counted the episode as a loss which is sad to me but it is what it is. It was earlier in the year another case involving a lesbian and gay man and another man was ended in the St Andrew parish court when the victim was relieved of his Samsung phone under the guise of being accused of stealing the very phone from the woman, she called a crowd’s attention playing a victimhood card and the other two accomplices to arrive as the saviours of the supposed damsel in distress and relieve the man of his phone with onlookers supporting the robbery disguised as a rescue. It was only when the victim profusely protested and demanded someone call the number, it was when the number was dialled the phone rang as the woman was walking away laughing. The matter was reported to the police and the suspects were held and tried. They were found guilty and fined; sadly such fines are not punitive enough in my view to deter persons from reoffending; the two were also linked to an elaborate phone stealing ring where even so called phone repair men who have informal stalls on the streets benefit from scrapping and or selling the phones after getting them wiped.

It is suspected that the ring is still in operation and gays are also being targeted as another unconfirmed reports of at least two robberies just outside the a LGBT spot where after parties persons are targeted by beggars mostly homeless and or thugs who prey on the physically weaker than they are and steal phone and cash. Montego Bay is also not immune from some of this as despite the clamp down on sex work and idlers at the infamous dump up beach stretch cruisers and others have been robbed by phone thieves as well. One case had a violent element according to an unconfirmed report in August of this year , the male victim was approached by a man who begged money but when his request was not met he went on to pull a knife and relieved the man of his Alcatel phone, he subsequently posted a status message on Facebook advising that his phone had been stolen so his number would have been down.

Tips to secure your device etc:

Use the available APPS for security and remote wiping capabilities available from reputable sources as the Google Play store or Apple

Avoid using similar APPS that claim to offer protection when they may be malware or identity stealing capable masked as protection

Activate features such as capabilities to locate your device or take a photo via a front camera if an attempt is made to open the phone

Backup all your data from the phone and SD cards and SIM cards to another location just in case

Install other features such as the ‘stay alert’ APP linked to the local police

Avoid as best as possible using your devices in certain parts of town

Avoid wearing what be considered to be expensive headsets as fashionable as they can attract thieves who may assume you have a smartphone

Pay attention to your surroundings when in public or on plazas

Avoid sending messages or browsing on the device while walking, it also has implications for safety in traffic or loss of direction

Walk with or obtain a banger phone just in case to avoid possibly robbery although such phones are also being stolen surprisingly

Plan and execute your routes when going out just in case and if needs be do not answer the device in a place where you are uncomfortable.

Plain and simple just be vigilant and be safe it is not worth your life to loose a phone because it is yours and is expensive, they can always be replaced.

Alleged Spanish Town extortionist who targeted gay vendors now on the run after shooting

A shooting incident which brought Spanish Town to a complete standstill some days ago where one extortionist was shot by another near the old popular locksmith near the crab lady over territory and the lucrative illegal trade is now on the run. He is Akeem Johnson or Jackson linked to the now in hiding kingpin Tesha Miller otherwise known as Bubba or Bobba Sparks and the police have had a strong presence since the shooting and have placed an all points bulletin for him. The inner turmoil in the Clansman gang is on in earnest as younger gangsters and extortionists fight amongst themselves for power and wealth surmised to be a ten million dollar figure per week as wholesalers, business, vendors of all types including bag juice sellers and ground provision persons from rural parts; other groups such as taxi/robot bus drives all have to contribute or else they are threatened or killed as had happened in recent weeks prior to the Christmas shopping season.

In a previous post I had highlighted a friendly male heaviot bleached vendor who myself and others LGBTians do business with has gone into hiding after receiving a hostile reception by men allegedly aligned to the Clansman gang near the market who claim he should pay up or else. The strong armed agents for the gang tend to also go after perceived gay vendors as well and have been accused or ‘giving a bligh’ to such persons over the other vendors as it is well rumoured that Tesha Miller its leader and some other bleached skin characters do engage in gay sex despite they have baby-mothers and multiple female partners. Those two phone in rectum incidents involving Tesha Miller in two different lockups only has added an aura of his long perceived homosexual activity; in other words a kind of behavioural bisexuality if one were to unpack some of this. The previous post the other vendors while glad that the competition is less with the hiding vendor they are concerned about their own safety without saying too much on it.

Another popular vendor in Spanish Town proper in the old bus park where the Linstead buses and taxis are comically known as “Shelly Ann” due to his semi-effeminate demeanour which itself is comical expressed similar sentiments when I ran into him a day ago as I exited the Tastee party store, he greeted me with the usual comical “wah gwaan gal?” (what’s up girl) to which I giggled, days gone by I would have cringed at such a greeting but I really do not care anymore, it is what it is. He tried to get me to buy things from him and I did take some blank DVDs from him but he had to be careful even as despite the cops are around they are targeting mobile vendors or walkers as well and not just ones with stalls or handcarts in one place. Shelly Ann in our conversation said the character Ackeem Johnson/Jackson had been busy in the town collecting money and organizing others but there was internal strife as well in the Clansman gang.

He also referenced Tesha Miller’s absence but most persons suspect he is calling the shots wherever he is and there is fear that after the holidays things are going to get worse. But this morning the police announced their increased patrol for the very same reasons indicated by Shelly Ann which says he was on to something. Shelly Ann also said he has been targeted by both factions of the Clansman gang now in split mode for extortion fees and that the dollar amount had not been dropped but instead doubled and the other rival gangs have been trying to infiltrate that zone; they are so covert however one would never see the actions or know what is happening.

I remember a soup vendor who was killed for the same reason of non payment of extortion way back in 2000 and the outrage that ensued as members of the public reacted that a simple soup vendor needn’t have been killed as he would not turned over significant amounts to pay fees. Several vendors refused to pay any more money but soon found themselves the recipients of threats in failure to do so. Another bleached butch identified woman in the town who sell DVDs as well had reportedly found herself in trouble prior to the clearing of the vendors and the building of BASHCO on Burke Road just in front the Kentucky Fried Chicken store, it was noticeable that she was missing for a time and rumours was that she was threatened so she laid low.

With Tesha Miller and this other Bubba Sparks character now on the run many vendors are hoping they will end up with more money in their pockets for Christmas and those in hiding can come out to try and make a living; that also includes those former homeless/displaced gays who were in or often return to the income generating weed whacking project that is some four plus years old when they get jobs or calls of interest hence my reference to the bag juice sellers who have also been targeted. The now infamous voice notes issuing threats of disruption for the Christmas from as far back as October has only added more salt to the wound, the police’s initial reaction was that the tapes were a possible fabrication or mischief making on the part of the originators but in an almost about face the cops through its Constabulary Communication Unit, CCU that they have intelligence that point to so plans for some extra ordinary event as the in-fighting continues and some persons in the affected areas are threatened with possible violence if they did not switch allegiance or stop opposing the new order.

The CCU has been trying to reassure the public that all be well as they have stepped up patrols in the business district but some are not convinced and are asking then what of undercover sting operations?

This extortion business is everywhere even in the upscale business districts of New Kingston and Half Way Tree surprisingly; west Kingston is already well known for that, I had encountered indirectly some of it in my days at the Ministry of Health when I did HIV outreach, the team and I while conducting the P.L.A.C.E pilot HIV project in 2006 we had to speak to a mini-donman to gain clearance to access certain parts of the rural bus park and market district alongside the lavatory in the bus park, this ‘permission’ was outside of the formal clearances we got from the administration of the market and bus park itself; and even that part of town also had its challenges with perceived gay and lesbian vendors coming under seemingly more pressure than others.

Hope some solution can come to the crime problem but we have allowed this scourge to become so entrenched and near normative it is going to be difficult to break, hope remains while company is true.

'Hickey' video man murdered!

So in a follow to a previous post the man in question has been murdered according to the Star News, the first question many are asking is where was or is JFLAG in terms of assistance or asylum given the high publicity he got and exposure? another question coming to light is did he make a report of the threats to the police?


RIP Devon whatever the circumstances he never deserved this!


Devon 'Chris' Fray, the man who claimed there was a misconception about his relation with controversial Bishop Steven Ricketts, was brutally murdered on Thursday.

Fray, 20, was shot and killed by unknown assailants at his home in Commodore district, about 1:10 am.

His death comes five months after Ricketts' SUV plunged into the Rio Cobre killing him and four others.

Following the bishop's death, an old video footage resurfaced of him allegedly beating Fray.

The 33-second clip at the centre of the controversy was initially posted online in 2014. It shows the bishop wielding a machete, while grabbing a young Fray and enquiring about three hickeys on his neck.

In a subsequent bid to clear his name from allegations that he was Bishop Ricketts' lover, Fray reached out to THE STAR and did an interview.

He told THE STAR that the controversy surrounding the video has taken a toll on his life and that of his family members, so he wants to clear the air and move on.

"People was sending pure threats to me. All some young bwoy a seh dem wah kill me. My mother trouble with pressure and it a stress her out. She nuh know wah fi do," Fray lamented.

He stressed that the bishop never made any sexual advances towards him.

"He is nice, and kind, and so forth. He has done a lot for me. We would sit and eat, and drink, and reason. I'm so sad about his death, but all now me nuh cry because of this whole video thing," Fray said.

The Linstead police yesterday said that Fray's body was found in his house with multiple gunshot wounds.

The cops said no motive has been established for the murder.

Game shop operator caught performing sex act on boy

Yet again we hear of another game shop operator involved allegedly in inappropriate activity with young patrons of their shops and end up getting caught and rightfully so. Sadly cases as this latest one helps to conflate the issues of male homosexuality versus a paedophile as many say gay men are simply predatory.

A paedophile is someone who has some sort of sexual attraction to minors despite the gender of the intended victim and is seen as deviant behaviour by the Diagnostic Statistical Manual, DSM, the guide for psychologists on such matters.

Some of the early comments thus far are pointing to the above mentioned conflation and is cause for concern as it leaves a misconception of the issues and can be problematic for public LGBT advocacy. It is really heartbreaking when stories like this come to hand.

The Star reported:

A St Andrew businessman, who was caught on tape performing a disturbing sexual act on a little boy, has been arrested and charged with gross indecency.

The man, who operates a game shop, was charged by detectives from the Centre for the Investigation of Sexual Offences and Child Abuse (CISOCA), after a report was made to the Stony Hill police.

He was captured on video performing the disturbing act on the little boy in his house from which he operates a game shop.

In a 7:25-seconds amateur footage of the incident, which was captured through a keyhole, the accused can be seen stroking the child, who he placed in his lap to play a video game.

The child, believed to be about seven years old, is seeing clutching the handset and playing video games as he was held by the accused who seemingly carried out the act.

Having apparently enjoyed himself, the accused released the child from his lap, wiped off his member, and then stood and pulled up his pants.

A senior officer at the Stony Hill police told THE STAR that the pervert is to face the Kingston and St. Andrew Parish Court on December 20.

Hope proper evidence can be brought to bear and the relevant judgement made by the bench.

Ground provision vendor gets death threats

An alleged gay ground provision vendor was issued death threats some two weeks ago following his supposed refusal or inability to pay up extortion ‘fees’ demanded by thugs in the Spanish Town area. His noticeable absence in recent weeks led myself and others to inquire of him as visits to the market to patronise his handcart of items but noticed he was not among the middle man vendors; he like others would by directly from the farmers/higglers from rural Jamaica wholesale and then place a mark up for resale. Extortion has been and continue to be an issue for street, market and store vendors as well as established stores such as the previously nearby located BASCHO, that has since moved to Burke road closer to the police station which was forced to close its doors due to the scourge. With all that relocation to the Burke road and the very bus park for safety I imagine, the crime has come right behind their establishment.

The bizarre shootings in the Jamaica Urban Transit, JUTC bus park in recent weeks is clear evidence of the problem as gangs clash over control of the lucrative multi-million dollar illegal activity. Vendors are afraid to report the matter fearing repercussions so some relocate to another locale or parish for a time or go into hiding, but with diminished income persons are forced to resurface to earn a living. The Clansman and ratbat gangs are responsible for the latest challenges. The vendor was others was approached by a woman with a composition book and what looks like a receipt or ticket role and collects the daily $300 up $500 fee sometimes allowed to accumulate so as to make one collection on the weekend. Two weeks ago the vendor was ruffed up by thugs who operate in stealth with the woman after an argument developed with the parties. It was then the two thugs openly threatened the vendor who for all intents and purposes is not effeminate or has any disguising feature towards same.

In fact he is the stereotypical bleached face and sometimes skin archetype with tattoos and such so when during the heated exchange according to another vendor as a witness who I spoke to, she hinted that the battyman accusation was as usual in any other male versus male argument but the men were resolute and claimed that they knew the vendor had no woman and that ‘him fuck batty’ followed up by the usual colourful parlance. Trouble with this one I have apart from the obstruction of freedom of movement in a public thoroughfare by unauthorised persons is that the gang in question, Clansman, its leader Tesha Miller has had the same gay or indeed bisexual allegations thrown at him repeatedly. Since his short incarceration in the United States and subsequent deportation to Jamaica, it has been open war within his own ranks and with the rival ratbat gang with fight for turf, even as the police has an all points bulletin of sorts out for him but it is a mystery to find him and he has not turned himself in. His attorney who ironically is anti gay attorney Bert Samuels who has been counsel for Miller for quite some time and says he is a Christian yet he has not been able to bring in Miller to the authorities for questioning.

Especially after a phone was found in his rectum alleged at a lockup some years ago the accusations of his sexuality had been swirling and this was also just around the time of the trial of another reputed gangbanger Zeeks where his trial revealed homosexual activities with the murdered victim by way of oral sex the victim was killed, this seems rather strange and curious as many including the main eyewitness vendor is questioning how would these thugs offering strong arms services know of the sexual activities of the now hiding male vendor, there is something else at work I suspect. We have had previous arrangements of this kind without the gang leader per say but it brings into to question the issues of downlow living.

Things have gotten so sublime to the ridiculous that even fast food restaurants in Spanish Town proper have once again do not use the friendly engagement term “Can I take your order?” as the ‘order’ in the term is offensive, from the point of view of those who oppose the one order gang’s reign. Most fast food joints now saw or ask “How can I help you?” or “what do you need?” this is like some serious ignorance laden regression to the dark days of wearing the wrong colour in terms of politics or the fist hitting greeting style changed to arm grabbing as fist bumping is seen as a cultural expression to West Kingston so it must be avoided.

Other vendors are circumspect these days and there is a noticeable decline of the ‘county higglers’ who would sleep in their trucks after a long journey from rural parts, do business and then return to their parishes of origins by truck, van or bus on a Sunday morning. I wonder if the dude will return soon as the other remaining vendors are glad for the spinoffs due to his absence seem to genuinely miss him as they seem to have cordial relations despite being competitors. Hope remains while company is true and we hope he comes back out soon. It has not been ascertained if a report was made to the police even as they have raised their visibility in the JUTC bus park and other parts of Spanish Town. How long will this continue is another fundamental question, criminals living big on ill gotten gains at our safety’s expense, now we are hearing of miscreants dressed as students in uniform or even legitimate park wardens either forced to become operatives or disguised as such to collect the extortion on behalf of the gangs while going undetected. The business of lotto scamming in western Jamaica is not divorced from all this as suspected and recently confirmed. Some of the extortionists have been jumping over to the illegal trade to prop up their already cash strong wealth.

The recruitment of gays even with homophobic consequences when things go sour is ongoing as the old perception of gay men especially the effeminate bright ones are said to be able to speak better by phone with intended victims hence closing the deals and ripping off persons who fall prey. Some persons have found themselves on the wrong side of some of the kingpins and their cronies and have had to relocate to other parts as well. Then the crackdown of the task force is showing up the network of already active gays quite plainly, so much so that a recent murder of a pocomania pastor has tongues wagging in St James about sexuality, obeah or necromancy and such.

Hope the vendor can ‘eat a food’ again soon.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard



When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues


If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
