This week Mexico’s Supreme Court rejected an appeal by federal prosecutors and ruled that the new same sex marriage laws in Mexico City is constitutional!
The justices’ 8-2 ruling gave legal victory to hundreds of gay couples who have tied the knot in Mexico’s capital since the ground breaking law that came in to play on 4th March. When it won approved last year, it was the first of it’s kind in Latin America giving gay marriages the same status as straight ones – even including adoption.
AP reported that the court, must still rule on the adoption clause and also whether the ruling will affect areas outside Mexico City boundaries. That issue is expected to be addressed next week.
“We are very happy,” the Mexico City lawyer Leticia Bonifaz said,”It fell to us to carry to a conclusion a struggle that has taken a long time.”
Jaime Lopez Vela, of the local LGBT group said “Now we hope that the final ruling declares it all constitutional,” he said, referring to the adoption issue.
Federal prosecutors had cited an article in Mexico’s constitution that suggests , but does not state, that families are constituted by men, women and children. The article states: “Men and women are equal before the law. This protects the organization and development of the family.”
Argentina became the first country in Latin America to legalize marriage for same-sex couples with a law approved in July. Mexico City remains the only city in Mexico with a similar law.

Another positive move in terms of rights for gays and lesbians in obtaining benfits in as far as unions and the public recognition of same. It's as simple as that. After all marriage has been redefined over the centuries to reflect the customs and mores of societies and groups contrary to the christian opposition who want to paint a different picture of marriage. In biblical times for example some cultures women who owned by their husbands or marriages were arranged with very little opposition from the parties involved as they had to go with the wishes of the elders.
