Dancehall entertainer Elephant Man was yesterday morning freed of rape charges after the prosecution offered no evidence against him.
The entertainer, whose given name is Oneil Bryan, appeared in the Home Circuit Court on charges of rape, buggery and grievous sexual assault.
However, the prosecution said it could offer no evidence against Bryan because the complainant has died and was buried on January 17.
It did not say how the woman died and the information was not immediately available when The Gleaner made enquiries.
The prosecution also said under the Evidence Amendment Act, it would not be allowed to submit the complainant’s written statement.
Justice Marcia Dunbar Green then instructed the jury to return a formal verdict of not guilty.
The police said the charges against Bryan stemmed from an incident at his St. Andrew home in January 2012.
Investigators say a woman filed a police report claiming that the artiste had sexually assaulted her.
Bryan was represented today by attorney Jacqueline Asher who appeared on behalf of attorney Linda Wright.

Not very many cases of what can be termed as "heterosexual" buggery make it this far to a conviction.

In November 2010 the well publicized case was reported on in the Star News:
After completing a sentence for rape in 2008, deejay Zebra was yesterday again locked away for 30 years' hard labour for another sex-related crime.
The deejay, whose real name is Garfield Vassell, was sentenced by Justice Evan Brown in the St Catherine Circuit Court.
Justice Brown outlined that for buggery, Vassell should serve 10 years and 20 years for carnal abuse.
The entertainer, who was represented by attorney-at-law Everton Dewar, was found guilty on Tuesday by a jury which retired for less than an hour. He was found guilty of carnal abuse and buggery.
The Crown led evidence that the entertainer sexually assaulted the teenage daughter of his girlfriend.
It is said that the child had to run away from home and related her ordeal to a senior relative who reported the matter to the police.
The deejay, who is known for songs such as Redder Than Red and Rupert, was held in June of 2008.
He got ten years full for buggery the woman and 20 years (max 25 years at circuit level) for rape of the same victim. If the victim had not died and Elephant Man was found guilty on all counts he may have been sentenced for thirty years plus seeing he had assault added as well coupled with grievous sexual assault which also involves the anus as part of the crime and analysis for the doctor's report.
