Former Australian High Court Justice, Michael Kirby has criticised Commonwealth member states that criminalize homosexuality, at the recent Commonwealth Law Conference held in Hong Kong Convention and Exhibition Centre.
This year’s Commonwealth Law Conference 5-9 April was themed the The Dynamics of law in a Rapidly Changing World.
starobserver.com reports that Kirby urged lawyers of the Commonwealth Lawyers Association (CLA), to join forces in curbing laws criminalizing homosexuality which continue to lurk in 41 of the 53 Commonwealth member states.
“Commonwealth lawyers, who combined to end racial discrimination, to reduce gender discrimination and to tackle other human rights issues, should now combine to remove this remaining unlovely legacy of the empire”, Kirby told the publication.
Kirby raised concerns about the escalating rate of hate geared towards lesbian, gay, bisexual, transgender and Intersex (LGBTI) people by Commonwealth countries saying it is erroneous.
“They are wrong because they oppress a minority in a community and target them for an attribute in their nature, which they do not choose and cannot change.”
He added that the Commonwealth countries that still criminalize homosexuality “put a cohort of citizens into a position of stigma and shame that makes it hard to reach them with vital messages about safe sexual conduct, essential in this age HIV/AIDS.”
The Commonwealth Lawyer’s Association aims to maintain and promote the rule of law by ensuring that an independent and efficient legal profession serves the people of the Commonwealth.
The Commonwealth is a voluntary association of 53 countries that support each other and work together towards shared goals in democracy and development.
18 African countries are member states of the Commonwealth.
In 2007 Nigeria lost the bid to host the 2014 Commonwealth games to Scotland because of its laws that undermine human rights and criminalizes homosexuality.
