Cops in $500k gays blackmail case mentioned in St Catherine court

One of two St Catherine gay men blackmail cases involving the police was heard in a Spanish Town court two days ago. I am all too familiar with some of the details emerging in this matter as my own November 1996 matter where myself and three other co-accused were in the wrong place at the wrong time in public where we were approached by cops who we subsequently found out were summoned by others on the site who thought we as males were involved in sexual activity, when no such evidence was there (apart from myself and my friend only dressed in our shorts as no sex was taking place) the cops decided to humiliate us by taking us to the nearest station and then to other precincts.

Then when the charges of gross indecency and buggery after the doctor’s examination were laid one of my co-accused was approached by individual cops to pay over a sum in exchange for making the charges disappear despite that the matter was scheduled for a preliminary hearing days after and the tabloids had our story splashed across their front pages. The success rate of such attempts is high I have since learned as persons choose to take the risk to avoid embarrassment and a charge sticking on their police records which can have an impact on job seeking or applying for tertiary education as well surprisingly at certain campuses.

I am only guessing what the two men involved in this current matter maybe thinking or feeling, thankfully they had the assistance of the corruption prevention agency to intervene and arrest the cops, in my case we had no such avenues for redress openly as such a case would have become material for humiliation and jokes by officers.




The cops accused in the present matter are Corporal Tyrone Harvey and Constables Lamore Small & Fabian Durrant of the Portmore police station allegations are that on January 27, 2013 at about 3:30am the policemen were on patrol along the Hellshire main road in the parish of St Catherine when they came into sight of what appeared to be two men in a compromising position in a car in a wooded area. The lawmen threatened to charge the men with gross indecency and demanded $500,000.00 to not arrest them, they were allegedly given a portion of the money and arrangements were made to collect the balance of the money. A report was made to the anti-corruption branch and following investigations the men were arrested, they were charged following a ruling by the Director of Public Prosecution, DPP. The case is to be mentioned today, I hope the men involved are prepared to go all the way with this one, we saw for example the University of Technology beating matter died in the water as the victim never turned up for court and then the guards accused were eventually freed for lack of prosecution.

The stronger charge of buggery apparently was not done as it seems a doctor’s examination was not done or as part of the deal the cops may have delayed that process to prove there was anal sex by one or both parties, usually the penetrator and not the ‘penetratee’ is charged with the stronger charge while the latter is left with a gross indecency one where a fine is usually the outcome once found guilty. The doctor’s report has to find certain things present such as the sphincter muscle being loose due to forced entry of some kind and spermatozoa cells possibly present in or around the anal orifice which can be problematic as some kinds of anal play via finger can also cause the transfer of such materials, a non-penile entry session where the hands of one partner can transfer unknowingly spermatozoa to another by simply touching the urethra (head of the penis) then to the anus or anal opening as such biological materials are invisible to the naked eye.

My case also benefitted from our stick-to-itiveness as we attended all hearing dates, made sure we were dressed appropriately, answered questions when asked by the judge(s) even in the face of humiliation and jokes made by some of them sadly but I understand the lack of interest after a time as our creaking court systems would make disillusionment set in easily when we are used to seeing court proceedings in other jurisdictions namely the US via cable moving much faster and judges with alacrity. Other blackmail allegations by police seem to have fizzled or died away or get drowned out by other more pressing matters that appear on the horizon hence the follow up or updates is shoddy.


A sine die adjournment (can be re-called up in 7 years if new evidence is found) or a full throw out may occur here seeing the charge cannot stick as the cops were caught. Adjournment sine die (from the Latin "without day") means "without assigning a day for a further meeting or hearing"

A word to the wise is sufficient as I had done when this case first broke, on my Facebook profile and in my main group GLBTQ Jamaica Chat I advised that while we cannot tell persons where to have their fun as outdoor sex is required sometimes for purposes of convenience and financial inability to rent a good hotel room persons need to be mindful where they go for not only police interference but possibility of robbery and murders. Only on Monday April 20th a reported matter in St Catherine also a gunman attempted to relieve a man of his laptop after he was seeking to connect to a free WIFI service, his friend was also present and they allegedly kissed prior to the miscreant’s arrival where he also used the blackmail strategy so as to gain material value illegally. The men managed to fight him off as it was soon discovered that the gun was not loaded based on the mannerisms of the attacker and his emphasis on bravado and loquaciousness than the apparent pain of murder. He rode off uttering threats that he will kill them next time, the matter was brought to the attention of the regular patrol corps that passes through the community. 


The accused are to return to court in two months time.

Judge warns cop who allegedly molested boy to leave witnesses in case

As we draw to the close of Sexual Assault Awareness month a series of cases involving a homo-paedophile construct in the allegation have come to public light. The latest is a case of a policeman who was charged for molesting a boy earlier this year was warned by resident magistrate Judith Pusey to not interfere with witnesses close to the case and stay away as best as possible from the victim. Sadly locally the restraining orders or such types of legal protections are not as strong as other jurisdictions. Charged is Police officer Dalton Leslie who was granted bail of $250,000.00 with surety. 



The Director of Public Prosecution, DPP ruled that the cop be charged after a file was prepared with statements gained from witnesses Leslie is to return to court on July 22, 2015.

The matter was said to have occurred in St Mary where the cop came into contact allegedly with the victim repeatedly and unusual behavioural patterns on the part of the boy aroused suspicions by family members who after engaging the youth he explained his situation, investigations were launched and hence the matter in court.

Sadly anti gay groups seem numb or muted when it comes to these matters even when one of their own in terms of pastors or police or other persons who are in a position of trust sexually abusing persons in their care, reach or charge. The chrry picking is sad and only when it gets really bad as it has in recent weeks where children are murdered then we hear some hiccupped response late in the day.

Such cases once public sadly serve to be used as cannon fodder by said antigay voices mostly from religiosity to resist LGBT advocacy goals for protection and recognition claiming that changes in laws will allow unchecked paedophilia and abuse and that men will target boys as this case hints to. Paedophilia (worth repeating) is the designated disorder not homosexuality as deemed so by the Diagnostic Statistical Manual, DSM the Bible for the psychiatric and psychological communities, also is the corresponding ICD (now in version 10) that defines the differences clearly.

There are various courses that can be employed to address such issues and challenges such as pharmacological interventions to reduce libido and sexual interest in pre-pubescent individuals which is the challenge here, the orientation of the perpetrator or victim is not important as we get caught up in who is who more so than addressing the deviant interest in kids.

Then there is isolation intervention as is practiced in Florida where a sex offenders residency exists and they are monitored via ankle bracelets linked to the global GPRS systems and restriction via court order does not allow said accused to be or go near schools, parks where children socialize or even the victim’s home within a designated number of feet or yards relative to them.

The numbers of abuse cases though is of deep concern only this morning a series of Ananda alerts were read out on radio with 6 girls and 1 boy making the list which suggests something is horribly wrong out there islandwide as it is not restricted to parish capitals or capital city Kingston.

Once again I want to recommend a book that has helped me an untrained layman in this department to understand the mind of offenders albeit it is an overseas publication but the circumstances are very much similar.

In light of the upsurge of the hysteria and uninformed commentary from certain anti gay voices mostly said to be Christians but most fundamentalist, the attempt to protest Obama's visit that fizzled, see more on that HERE I have to agree in most part to this letter that appeared in the Observer April 9th as to the selectivity and deceptive cherry picking by said groups namely Jamaica CAUSE, The Jamaica Coalition for a Healthy Society aided and abetted by the Lawyers' Christian Fellowship the veterans in the field stoking fear-mongering and falsehoods in the name of religion and by extension God I might add.

Problem is they make the rest of the church look bad hence persons just blast the church collectively.

Blog posts by chief cook and bottle washer Dr Wayne West supposedly in the name of morality and God centered beliefs are disturbing to say the least and reflects the kid of mind we are dealing with here: PM rejects moral nihilism and sexual anarchy : No to LGBTTTIQ….PZism ! No to fisting, felching, farming, scat, chariot racing etc ! as if to suggest demand law change willl also allow more far out practices than just anal sex but it also shows his ignorance on sexual orientation, a challenge the lobby has nationally as well as fear also causes our education systems over many years to address sex and sexuality. Remember the HFLE fiasco anyone?


First the letter then my follow up two cents:

Dear Editor,

After reading comments by the Jamaica Coalition for a Healthy Society (JCHS) all over the media, I am forced to respond to what is obviously mass propaganda and hysteria. We never hear of this group when gruesome child abuse cases are reported, but mention the word 'gay' and everyone jumps. Who are they to attempt to define the rights of any human being based on their sexuality?

These people like to rebuke the suggestion that Jamaica is indeed homophobic and they commend PM Simpson Miller for her defiant response to gay activists who heckled and interrupted her recent speech in New York on what is still a very serious issue.

JCHS suggests that gays tell lies on Jamaica and attempts to embarrass the PM who said, "No one ever hears the Government of Jamaica beating up gays". This was a simplistic response, if not absurd. What should be said is that the Government has not done enough to denounce gay discrimination and related hate crimes, they are silent on these issues and refuse to proceed with the promise made to review the antiquated buggery law which criminalises gay acts between consenting adults. This law feeds into a culture of hate and prejudice which is mostly perpetuated by the uneducated and uninformed.

If Jamaica is not homophobic, as some suggest, why did former PM Bruce Golding tell the BBC that gays cannot serve in his Cabinet? And why did Opposition Leader Andrew Holness avoid answering the question during the last electoral debate? Have they forgotten about the cross-dressing teen, Dwayne Jones, who was viciously murdered by a mob? J-FLAG reports hundreds of incidents in recent years. We also see and hear of incidents reported on the news. Isn't this homophobia? A government must be custodian for its citizens and cannot turn a blind eye to discrimination. Any government that creates, endorses and enforces laws which criminalise gay acts between consenting adults in privacy is not serious about defending human rights. This is not an issue to be put to the people, it's an issue to teach the people.

So, yes, Obama is very likely to raise human rights concerns with PM Simpson Miller, as he does everywhere he goes. She promised to review the buggery laws. No other PM to my knowledge has ever done this. Yes, we agree some progress has been made, but if the PM now believes Jamaica is no longer homophobic and that gays are spreading lies, I urge her not to delay any further the buggery law review which she promised years ago. And she can still do so defiantly with "the blood of Nanny of the Maroons and the spirit of Marcus Mosiah Garvey", as both were great heroes who fought defiantly to defend human rights.

Problem is though the letter writer misses the boat when it comes to who is actually liable for buggery when proven as the perpetrator or penetrator is the one who is charged whether he penetrated anally (gay sex or not) or with a device (also maybe reduced to grievous sexual assault or gross indecency) not the passive partner or the recipient of such penile entry (although both are tested by a doctor on behalf of the arresting officer(s) or the state.


Let me remind persons of the dancehall DJ Zebra's case for example where he raped a female and also buggered her because the matter was tried at the home circuit court he got the full brunt of the sentences rape and buggery (in the RM the accused when found guilty can get up to ten years) see: DJ Zebra gets 30 years for rape

Problem is that the twinning of atheism, secularism with law change for decriminalization and or repeal of old laws such as buggery has clouded the aims of the struggle originally and as all kinds of unqualified and inexperienced self appointed advocates come forth not understanding strategy and too headstrong those costly errors have derailed and indeed paralysed some of the incremental gains.

Why are we devaluing our children so much?

As Sexual Assault Awareness Month continues I was again deeply disturbed by recent revelations of some serious infractions and abuse of children by of all people their own parents. I have known that the problem exists having worked with other child agencies and nongovernmental organizations in the past but it seems a lot has changed and for the worst.

Trouble is that such paedophile and abuse matters are often used a fodder for anti gay groups to obfuscate the debate around the buggery law’s decriminalization or removal as the suggestion is sexual grooming by adults, more buggery cases with boys as victims and other sexually based crimes involving children. Paedophilia is whole different issue and in fact designated a disorder by the Diagnostic Statistical Manual, DSM the bible for psychologists by the American Psychiatric Association and other related bodies.

The ICD 10 also speaks to the deviance (homosexuality is not seen as such) and frankly it is common sense once one is an adult and is sexually aroused by a prepubescent individual then that cannot be seen as regular behaviour; that is worlds apart however from innate same sex attraction to other adults but groups such as Jamaica Coalition for a Healthy Society, Jamaica CAUSE, Love March Movement, Betty Ann Blaine (of Hear The Children’s Cry), Rev Al Miller (now in court for 2 matters) and the Lawyers’ Christian Fellowship would have Jamaicans believe otherwise to the effect that homosexuals have predatory paedophile intent to catch little boys before their time or when their bodies are ready for sex.

The Deliberate Misuse of the “Sexual Grooming” Term by Antigay Fanatics to Promote Their Hysteria

One can remember a famous remark often quoted:

“Some of you think that homosexuality is a greater sin than malice keeping.

No way in the sight of God.”



(Bishop Herro Blair, sermon on Television Jamaica (TVJ), 3 March 2003).

The proven brutality and physical and psychological violence of homophobia shows the clear link towards homo-negative messaging from sections of the religious movement, these groups/individuals have been almost mute on other societal ills including horrific murders or when one their own also allegedly commits the very sexual crimes on boys that they use as justification to deny supposed “gay rights.” It is the overt virulence of the homophobia at the expressive level within both secular and religious popular culture. The declaration by Bishop Blair – who is a figure of some political and religious influence – that there is no substantive theological basis for the selective highlighting of homosexuality as the ‘sin of sins,’ and which is our epigraph here, is not one that is often publicly made in Jamaica. The overtly virulent expressive homophobia arguably encourages the documented tendency towards and the practice of physical brutality and violence against homosexuals.

It is reinforced, even operationalized, by three other specific features of the Jamaican situation.

The religious fundamentalist anti-homosexuality imperative has primacy within African-Jamaican popular culture, dramatically manifesting in both the religious and the musical popular. Duality is immediately evident in the medium called ‘street gospel’, a form of Christian dancehall (‘Street gospel’) of which the work of artist Radikal Prodigal (Prodigal Son) is a striking example. The culturally African-Jamaican nature of the form is affirmed and given theological sanction when he declares that God has called out to him and personally anointed him to worldwide missionary discipleship. God has told him not to try to preach like an American, but to be bold in being a ‘radikal yardie’ instead – and to be known as Radikal Prodigal

Thus divinely anointed, Radikal Prodigal then offers a diet of fundamentalist

Christian-based homophobia. The artist attests to the power of the God he serves, drawing specific attention to the anti-homosexual story of the destruction of Sodom and Gomorrah. A few tracks later, he has warmed to the task. As a ‘radikal’ Christian, he can and will ‘trample’ a whole list of God’s enemies including ‘b’man’ (presumable homosexuals) and demons, and the less immediately identifiable entities ‘pokeyman(from the word poke suggesting anal sex) and he-man’. This misplaced use of spiritual power is another problematic blockade for reaching understanding and tolerance.

He directly quotes Luke 10: 19, which says:

Behold I give unto you power to tread on serpents and scorpions, and over all the power of the enemy: and nothing shall by any means hurt you.”

On this basis, he offers ringing condemnation of those who are mixed-up in ‘buggery’, as well as in vanity and idolatry

The revelation of the pimping, child sex slave ring that was revealed at the back of a market in St Ann found almost by accident or a buck up coincidence is one such matter that has rocked me big time and then the recent near back to back murders of those four boys in Clarendon, the incest case in St Thomas of that nine year old girl by her father and also the numerous allegations of persons in position of trust breaching such trust, namely pastors, police officers (three cases since this year I am aware of but three too many) and so on. Claudette Pious Executive Director of Childrens’ First speaking on a radio interview yesterday April 21 on Newstalk 93FM Freshstart during their counterpoint section made some more disturbing revelations for example:

The pimping of kids as young as 9 years old by parent(s) for money and not seeing them again, she mentioned one case of a boy was pimped as his mother acceded to the wishes of a man who wanted him, the boy was around 15 at the time and the mother got some $30k from which she bought a refrigerator. Other community members upon hearing of the episode have since ostracised her and named her the fridge woman as she gave away her son for one. The boy has not been seen since and this was some three years ago.

The court cases or the creaking legal systems, corruption in such places for such privileged types also in the end allow perpetrators to literally go free, cases languish, all kinds of character references (manufactured backgrounds or even real ones where there was alleged abuse when they were young) are used to protect the accused, arresting officers (even after being subpoenaed after absences from hearings) stop coming to court, an alleged faulty evidentiary material, witness refuse to come to court or lie or change their testimony than that appearing in their statement.

The Reverend Paul Lewis case proved the challenges, conclusive DNA evidence was present but he was set free and is one of the few matters I have heard other clergy men or anti gay religious voices spoke to; maybe because the media kept up with it which also shows up the lack of follow up by media as well, cases die in the minds of the public as other matters compete for our attention of the newer cases are so gruesome they simply outshine the older ones.

Death threats issued to witnesses and families of victims is another matter in and of itself. The sentences for those that go to full conviction are almost a joke.

The finding of a foetus in Seaview Gardens only yesterday, the other matter where a baby was found in a barrel (upright) chopped into pieces earlier this week and stuffed alongside food items contained therein are just two of the more horrible outcomes of our young yet the veracity and intensity of concern that is to come from the religious corner notably the Council of Churches is so low or missing. Yet on homosexuality they are at their loudest. Yes I agree that we must be outraged on ills but the selectivity and deceptive cherry picking by some is even more egregious in the name of morality.

The missing active Christianity that is to highlight God centred principles could not be more highlighted than a story in today’s newspaper where an elderly man was assisted by an entertainer who was moved by his story of poverty where he was living in a fowl coup. Yet no churches or religious groups upon checks and rechecks have moved or joined the assistance save and except for Food for the Poor and other newspaper readers, so church groups again missing their mark and in action that are supposed to be meaningful.

Have we as a nation become so numb to the atrocities?

One can even get more perplexed or disturbed at the numerous missing teenage girls that appear nightly on our TV screens during prime time and a growing number of boys as well which makes it more worrying despite the somewhat calming news in my previous post on CISOCA’s latest report that reported cases of buggery of boys is falling. Old excuses of survival or it’s only some sex it won’t hurt came up as well on the radio program which strongly suggest Jamaicans in some quarters do not see this kind of pimping of children a crime.

In fact the other side to this is that the missing teens listed on the aforementioned nightly TV Ananda Alerts (named after a girl of 11 Ananda Dean who was savagely killed many years ago and to date the murder has not been solved there were also 3 more cases in St Thomas, 4 others in Kingston in one week) are actually relocated deliberately by parents/guardians so as to avoid older men coming after them, there is a cultural belief that once a young girl ‘burst breasts’ literally then she is ripe for sex; so gang leaders (dons) and other men with often misplaced bravado (more imagined than real and centred in the supposed power of the penis) influenced by generational sexualized messaging feel they can legitimately makes such demands on girls and now boys as of late by sending a message to parents to send them to the demanding party.

The old Negril beach boy problem that was first studied in 2001 was highlighted by Miss Pious as well (also linked is the rent-a-dread concept though not discussed in the radio show) but the changes are that the boys are younger and or are also involved in cross dressing or maybe pre-operative transgender as the market diversifies itself more openly these days. I can remember one of my last visits to the hip strip in Portmore St Catherine prior to the citizenry backlash and the police stepped up intervention there were some MSM/transgender youth there; a spill over from the population in Kingston and others from the parish capital Spanish Town.

It is going to be very difficult as said by Miss Pious and I agree to break down those cultural blocks and to think in a modern day society one would have thought such ideas would have died, the old lingering one that directly impacts HIV/STI prevention is the sex with a very young virgin as outlined in my previous post of a present case by CISOCA of a young girl who now has an STI by a 20 year old man (age is important given that education and information are readily at hand).

Stories like those again influence the homo-paedophile construct that anti gay groups latch on too easily and then use same to justify their arguments sadly.

I will once again recommend a book I have found helpful to me to understand the psychology of sexual predators.



The recent gender based attacks on the University of the West Indies and same gender loving women who are also attacked or verbally abused have also received very little response for or against by religious groups but mainly from secular entities/LGBT groups which once again fires the conflation or false dichotomies of godless LGBT rights proponents versus Christians and the perception of stifling freedoms of speech.

Working solutions (not aspirational announcements as usual) must be found not just the trial and incarceration or even suggested chemical castration made by some (mostly anti gay voices) we can probably use the Florida model of a residency that addresses paedophiles by various means in including

Pharmacological treatment to reduce libido and subsequent interest in children tempered with self releasing activity such as masturbation but adult materials as the catalyst, not sure how that works.

State monitoring via GPRS typed ankle bracelets hence restriction of movement towards places where children socialize a lot

Supportive legislation so that while freedoms are curtailed the desired effect of treatment of interventions are effected present legislation such as the Child Care & Protection Act, Human Trafficking Acts and aspects of the Sexual Offences bill cannot be effective by themselves such as touching and so on but the people also need awareness programs and so on. They have not quenched the problem. Judicial decree cannot change the heart and like many other laws we have them on the books and they are not enforced.

Psycho sexual counselling and interventions on an ongoing basis

Help victims avoid also becoming predators in later life

Education programs for children (as early as primary school as suggested by Miss Pious) to know how to spot and differentiate play from inappropriate touching

I am one of those gay activists who believe we cannot be narrow minded or wearing visors limited only LGBT advocacy we must also pay attention to other issues though not directly linked to the struggle. A late in the day response when the rest of the country has come from Betty Ann Blaine (Hear The Childrens’ Cry from linked to the aforementioned Ananda Dean case) in a press release seems to be just catching up but Miss Betty was quite fiery and never needed a press release during the anti gay march in Half Way Tree last year and the energy placed in that regard pales in comparison to the sexual abuse or murder of our young.

Dub Poet DYCR Reiterates his anti gay themed ‘Gash a Fyah’ Stance on radio from an old poem “Dem Man Deh”

Speaking on Newstalk 93FM on the morning of Thursday April 16th on the current affairs show Freshstart (didn’t get to record it as I was getting ready to go out – sorry podcast listeners) dub poet DYCR was asked about his work and how he started. He went on to explain to host Sharon Hay Webster (of the present JLP impasse) in answering that despite his Rastafarian faith subscription he actually started in a Penticostal church as a child with a poem called “She Seh She a Come but She Can’t Come Yet” which he performed in full right on the spot. He then went on to relate his attempts at singing where he was discouraged as his timing on riddims (rhythms) was heavily criticized by producers/studios/sound systems who he approached at the time, so he switched to doing dub plates (special sometimes pre-recorded exclusive tracks promoting the particular sound or party) in rhythmic speech styles for sound systems which helped to refine his dub poetry style he now uses.

When pressed about which of his pieces was the most popular in his repertoire he named ‘Dem Man Deh’ (those men over there) which is a subtly layered piece emphasis the supposed abhorrence of male homosexuality and by extension anal penetration. The religious/biblical fundamentalist anti-homosexuality imperative is twinned here with the Christian Leviticus initiative in anti gay advocacy; a rare combination given Rastafari’s opposition to a European construct of God and the bitterly opposed Catholicism by rastas as well. But for purposes of opposing homosexuality the lines are deliberately blurred to effect same. Old beliefs that the Catholic church having same gender sex in its midst also has many Rastafarians very caustic towards the papacy. DYCR was obviously beaming after the DJ working with the show’s host played the track in full as he then proceeded to explain the reason for writing the track, the usual twinning of homosexuality and unclean living/sex was emphasized showing up the usual blind fury of opposition to something he is and others are yet to comprehend.

Here is the piece called "A Fire" firstly, listen to the emphasis placed on the line ‘Gash a Fyah where he hits out at oral sex, the actual Dem Man Deh Track is hard to find online nowadays but it is played on radio still especially IRIE FM:



Homosexuality is constituted straightforwardly as a sin in the eyes of God (Jesus or Haile Sellasie dependent on who or which group) and therefore also in the view of self-perceived good and/or godly persons. It is agreed that omniscient Jehovah repeatedly declares homosexuality to be a sin in both the Old and New Testaments and that the Almighty would neither misrecognize nor misname a physical and/or emotional illness as a condition of sin. The idea that homosexuality is an illness (whether congenital or otherwise) represents the negative reading of the claim that lesbian and gay persons generally had their sexuality determined at birth, and did not therefore usually exercise unfettered choice. Its positive version holds that a certain proportion, a minority, of God’s human creatures are indeed born lesbian/gay and that their sexuality is to be seen as being as much God-ordained/created as that of the heterosexual majority. However, it also holds that homosexuality must still be repressed or at least treated. Reggae artistes are different from the deejays to the extent that fewer singers have composed songs directed against homosexuals/homosexuality and it is perhaps more difficult for the singer to address this issue by improvising in performance. Even so, the earliest directly homophobic reggae song known to me is the 1978 King Sounds and the Israelites’ ‘Spend One Night Inna Babylon’.

This song makes explicit mention of Sodom and Gomorrah and of the fact that these two ancient cities, along with Babylon and Rome, are anathematized in the Bible. King Sounds, then, is simply transferring onto modern ‘Babylon’ – as constituted in what Pollard (1994) has termed Rastafari ‘dread-talk’– the characteristic sin of Sodom. In the song King Sounds embellishes his catalogue of Babylonian abominations by adding to it bestiality. For those advancing the Christian fundamentalist imperative, the essential sin of homosexual behaviour (sodomy) is said to be forbidden by God, and is recognized as a sin so serious as to be punishable by death. A not untypical rendering of this imperative by a successful secular deejay is in Beenie Man’s ‘Bomb and Dynamite’. Like the work of Radikal Prodigal, it contains direct condemnation of designated homosexual behaviour as wrong in the sight of ‘di Almighty’, repeatedly referring to Sodom and Gomorrah, to bombing sodomy-generated social ‘confusion’ and also to AIDS as somehow divine punishment fully deserved as a result of this sin.

The ideological imperative of the unnaturalness of homosexuality and the naturalness of heterosexuality also is emphasized in the “Dem Man Deh’ track though dated still has some effect as evidenced in the call back segment of the show, then again all kinds of persons have crawled out of the woodwork since the visit of President Obama and his hail of LGBT work in Jamaica. Long time reggae acts such as King Sounds and the Israelites’ song, ‘Spend One Night Inna Babylon’. King Sounds holds that to the extent that a human being is a person of wisdom and understanding, s/he is bound to know that the people of Rastafari-designated Babylon are not examples of the ‘natural man’; rather, they are the ‘evil one[s]’, and the righteous cannot and must not emulate or imitate their actions (1978). Nor is a newer artistes like Turbulence far behind. He places on view in parts of his work seamlessly stitched together elements from the deejay-created tradition of righteousness, Selassie-laudation, homophobia and hetero/sexism, with a brocade of God approved and divinely required violence that culminates in the deadly couplet identifying man and woman as the ‘perfect pair’ followed by an invocation of ‘pure gun’ the shots from which will ‘tear . . . skulls’ (2003).

Many songs that are not centrally about homosexuality nonetheless encode its censure. For example Warrior King’s ‘Virtuous Woman’ (2002), which no doubt sounds like a welcome paean of praise to the black woman, manifests patriarchy and hetero/sexism in the loudest of traditional hues. Here, not only is ‘real’ manhood inscribed exclusively within the heterosexual relationship, but woman abjures social and individual ‘power’, while silently discharging her natural-historical task of making her ‘real man’ a ‘better man’. This state of affairs is presented as ‘natural’, as confirming ‘Jah plan’, divinely ordained, and modelled by the Empress Menim in her relationship to the Emperor Haile Selassie. If Warrior King’s definition of real wo/manhood only silently excludes those involved in lesbian and gay relationships, this exclusion is made explicit in The Wickerman’s nearly contemporaneous Jamaican hit ‘Girls Gungo Walk’ (2001), a reworking of a mento song performed over Steelie and Clevie’s ‘nine night’ riddim, which mobilizes a number of other Jamaican folk-cultural forms. The song opens with the declaration that he does not want any other man to stare into his face [while making love], nor any ‘funny bway’ in his valued communal space.

The Wickerman further mobilizes folk ‘knowledge’ with the device of invoking allegedly widespread anger in order to sanction violence against gay men for menacing society with their ‘unnatural’ behaviours. He claims that homosexuals flooded Jamaica during the 1970s and that the youths had not then quite realized they would have multiplied so fast such that they are now said to ‘full up’ the island. The Wickerman introduces the images of hen and cockerel to enable a word/ sound-playing line in which the cockerel’s ‘doodle doodle do’ sound represents heterosexual sex which generates ‘wi children’ on which basis he rejects men who desire other men sexually. Here the naturalness of the procreative function of heterosex contrasts markedly with the perceived purposelessness of homosexual sex, which is said to lead to perdition. That God is being angered is the implication of the nicely understated line saying that these ‘likkle ting’ are so enormous as to be causing the Almighty to ‘ben’. Indeed, the function of this imperative in justifying homophobic and/or heterosexist violence, including rape, is unmistakable in some popular material.

Chuckleberry’s ‘No Gay Man’ (1991) advises girls internationally to avoid gay or bisexual men, who are not real lovers of natural heterosex and should rightly be given ‘a gun shot’. Another Chuckleberry song, ‘Madley [Madly?] in Love’ has a refrain acknowledging his love of women and that he does not ‘rub a dub’ with men (ibid.). Simpleton’s ‘See it deh’ (1993) is another song foregrounding the naturalness of heterosexual sex while inveighing violently against homosexuality on the grounds of its unnaturalness. Is it in the sentiment in lines that stress the ‘good’ and ‘sweet’ look of the women which – while walking on the street – makes him want sexual ‘release’ (Simpleton 1993) that the interpenetration of anti-female and the anti-homosexual ideas find a disturbing expression? Is the deejay not here admitting to using the ‘sweet’ appearance of Jamaican women on the public thoroughfare as the occasion for declaring his extreme sexual arousal and is the underlying attitude not precisely that of the self-justifying rapist more than a short step away from this?

The protection of vulnerable youth imperative is not so pronounced in DYCR’s piece though but more on the emphasis on separation of gay men from the supposed holy group, the onomatopoeic pronouncement of “Gash” in the track is deliberate although not calling by lyric the execution of gays the message is clearly implied as set by other Rastafarian acts such as Capleton and Sizzla who also employ similar tactics in lyric delivery to make their point of supposed abhorrence.

I guess we may have to endure the old “more fire” push back for now but although on the face of it the call for execution is not openly promulgated the message is implied if one listens deeply.

Where there is fire there is also cooling I say let us cool it by just living and be who we are.

The entitlement problem from hypermasculine MSM & negative outcomes

So I like many other gay and bisexual men in Jamaica ran into one of these hyper-masculine types (that I really like) in early 2014 in my community and we have had a couple quick sessions mostly as partnered masturbation as preferred by him as he has a minor erectile dysfunction challenge (I swear it is a overuse of ganja caused). These fellas usually unemployed or unemployable heavy marijuana users, expensive clothes wearing types to project affluence in some respects while displaying a public homophobic stance, misplaced bravado to project strength are sometimes on the downlow (the louder they ‘bun fire’ the more likely I say) and usually tie in secrecy, expected payment of some sort (mostly financial) such as access to a more or unexposed better quality of life one may enjoy and a feeling of someone owing them some obligation or the entitlement phenomenon due to their masculinity or bravado real or imagined that they use to stamp their identity on those who they engage and also themselves as a form of self validation of manhood.

They usually use their endowment, naturally well defined bodies and even nonexistent effeminate traits (fear of the feminine) as bait or bragging chips for engagement with other more affluent yet less masculine men which right away implies hetero-normative role play in such non romantic male sexual liaisons.

In previous posts I had looked at the ‘Battyman Entitlement Phenomenon” from a different perspective that of where is crosses with advocacy and HIV prevention work as evidenced in disruptive behaviour by sub groups under the MSM umbrella hence given justification by some non state actors to refuse or hesitate to engage such groups and individuals. Take a look at the ongoing homeless MSM challenges between JFLAG, Jamaica AIDS Support and others and it is clear that version of entitlement as it comes with an public effeminacy component to embarrass such agencies seeing such displays are frowned upon by not only general society but by more privileged or elitist MSM who often sadly are the managers of such programs or NGOs. Here the class divide also presents itself as problematic.

Earlier this month the dude I had mentioned came by my house as he occasionally would but this time unannounced (maybe he feels prior successful visits now qualifies him to turn up freely) as he would call prior to arriving and make his requests usually precursory by a money request in an Anancyist type or roundabout way (not that we were in a commercial arrangement officially) “bossy mi a ask fi a 5 bills” (my friend I am asking for $500) (“bossy” is a colloquial style of flattery suggesting a boss like or elevated position of the persons who is so named) or words to that effect. He like others would not out rightly ask for sexual favours directly unless he like others felt or have a dominant role in the liaison but when in person would hint to same or as in this case go as far as displaying his penis not erect to suggest what he came for, bearing in mind his reasons for most visits is for assistance in getting a release due to his performance challenges. Such masculine types (sometimes operating on a social construct of compromise in non romantic same gender liaisons) do not ask for sex that easily unless it is context in a position of dominance as passiveness is seen abhorrently in the quest of protectionism of their ego. We did eventually satisfied each other orally as successfully achieved before, an unusual arrangement again from my understanding of how these types operate as passiveness as hinted above is not the norm in such sometimes mechanical sexual contact as defined by them, sometimes one gets a list of don’ts prior to sex action that are too sensitive for their comfort the sex is very mechanical and must also reflect masculine ideals in a few instances in my experiences; for example no kissing, no tonguing of the ears or there erogenous zones or even touching of the buttocks as that implies passive positioning or feminine role play. He was quite comfortable and willing from the onset to return the oral favour to me which makes our sessions interesting devoid of cautiousness on what I do or want to request.

Some hyper types insist on demanding sometimes to be in the ‘top’ or dominant position in whatever sexual arrangement be they penetrative or not. After our fun he then asked (at 10pm at night) to sleep over as he claims he could not enter his community at that hour which I knew to be untrue to which I responded no as he turned up unannounced (used more simpler language) and he was lucky I had no guests or family coming by or over-nighting so he was accommodated; to this he reacted angrily. Our exchange of words lasted a while then he decided to play the soften up card where he offered more sex as a way to cool tempers but I knew where he was going; cannot fool me. Such demands or insistence of dominant role play is very important for some and they will defend it to the ground if needed with sometimes very violent reactions, my short experience in prison both as an incarcerated gay man charges for buggery and as HIV Prevention officer for a certain NGO has exposed me to those demands in more ways than one. The man don’t bow ideology is as real as the air we breathe and any suggestion otherwise gay, downlow, prison wife phenomenoned or behaviourally bisexual may elicit a violent response if he fees dissed or reduced or belittled,

Even after acceding to my bredren’s request for the $500 and the second suck-session he still asked for $300 more afterwards and said he would link me some other day soon, I cautioned him however to call as he often did before prior to turning up ad that not all of his visits would result in sex. I was a bit annoyed by the occurrence although I am used to it with others before like him in similar circumstances, friends refer to the same problem of entitlement occasionally too. I have other male buddies who jack off or get into oral sex from time to time and the pattern of entitlement is clear in most cases of masculine men who hail from mostly lower socio-economic classes who come with already pre-conceived notions of class victim-hood by virtue of their social standing and less affluence, long held or cultivated views of gay men in the middle class having more affluence and real disposable income (partially true given lesser obligations as opposed to heterosexual men in common law unions or marriages).

I do not get that type of demand or response from white collared, middle class or more affluent men who I bed as their goals and imperatives are different.

It is such hypermasculine versus other type man on man setups that sometimes lead to awful outcomes, murders included of some of our brothers (often describe as crimes of passion by anti gay voices) I as addressed it in a podcast recently as the issues of power differentials between men involved in sex with each other playing out in the complex mix of:

Class, identity,

Misplaced bravado heavily relied upon

Masculinity,

Sexuality, sexual orientation,

Fears (especially of the feminine)

Loss of power (real or imagined) psychologically

Imperative of maintaining the sex secrets and blackmail in some cases

A recent lecture at Kingston College’s 90 anniversary celebration activities and Founders week (wherever April 16th falls) as presented by Reverend Dr Marjorie Lewis (formerly involved in interfaith/LGBT talks I was apart of in 2009 – 2010 at JFLAG) of the United Theological Seminary spoke to some of the aforementioned challenges (excluding homosexuality directly) in masculinities. Ironically KC the goodly previously all male North Street school (now allows girls into sixth form) has been labelled ‘Ketch Man College’ (Catch a man college) by some including former students who are gay or bisexual as a joke suggesting gay intent and connections there jokes aside, even our young seem to buy into it as if homosexuality is contagious in part and then situational homosexuality in another via prolonged daily socialization of the males.

Remember the uproar after UWI Lecturer Dr Carolyn Cooper’s poorly written satire of the past student advertised all male only dinner?

Reverend Dr Lewis addressed manhood via a lecture entitled Who a di real man? (Who is the real man?) ‘Reflections on Reformative Masculinities.’ It dealt with how ‘real men’ can find ways to reinvent themselves in society in positive ways supposedly. Present deputy head boy of KC Jaevon Brooks in a radio interview said that redemptive masculinity is when try to see themselves as superior one should know when to dress back or correct oneself after doing something wrong, suggesting the over reliance of bravado to stamp identity. The issue of soft men came up and that men who were ordered were assumed to be gay and non conforming to which Mr Brooks replied that men should be confident in themselves and that labels should not bother one.

The Brian Williamson case for example brings that out clearly, often described as a homophobic motive murder by LGBT advocates when the accused (now serving life in prison) ‘Wingee’ was one of the very fellas who the deceased was assisting financially as he was aided in starting his newspaper sales but the entitlement phenomenon shows up. Unannounced visits despite Brian’s insistence of not doing so, unusual security features on the property including electrifying the perimeter fence to stop persons from scaling it to attend the then Club Entourage (I was one of the resident DJs); the membership only policy to supposedly get rid of the riff raffs but it did not stop them.

It is these internal sub group challenges in socialization under the MSM umbrella that has clouded advocacy in as far as crisis reporting or communication in justifying gay on gay (or downlow) violence versus genuine homophobic cases. Thankfully my party involved in the outlined matter was not one of those (thus far) that seem to lapse into the guilt and shame contemplation activity that sometimes present itself every now and again. Sometimes there are expressions of regret after sex suggesting they were forced or overcome by the urge in the moment as they supposedly do not subscribe to gay sex or want to stop practicing altogether but fall into it yet still. Hence the attachment of money requests I suspect, of course this outside of substitutional sex as well as many of this men are either naturally gay, bisexual or at least behaviourally so. Sometimes I swear if one could open the minds of these hypermasculne types while involved in man on man action the fantasy would be about a woman in a type of psychological switch hitting fantasy whilst feeding a desire for a quick release through whatever male who is available at the time, seeing that sexual demands from women can have some hurdles to overcome some natural (menstruation), convenience (space not available or children in the way) and others refusal or sudden dislike by the woman.

Nationally the entitlement problem or idea is endorsed somewhat via dancehall music, one could argue whether it is a chicken or egg scenario as art imitates life. Songs such as the now rare Buju Banton’s ‘Oman a mine me’ (A woman is supporting him financially) is one such track that emphasizes such entitlement of men suggesting subservience of women and indirectly a similar idea in same gender non romantic liaison seeing that there is some rubbing off or burrowing of those ideals. In today's Jamaica this idealistic stance is almost so real in the majority as more women evidenced by university attendance and living single are the bread winners in heterosexual relations and are delaying having children or even a male partner more a boy toy in some sense.


It also reinforced indirectly in criminal activity through extortion in certain geographical pockets of the country, young hyper masculine men who feel they will never make the formal education and employment systems feel justified in open reliance of collecting money using duress and intimidation for flashy lifestyles, multiple partnering (female and a few instances male) and according their version power unto themselves to match affluence of mainstream successes. The MSM populations like all other sub groups are a microcosm of society and will reflect those national practices uniquely modified in said subgroups.

A look at the fear of the feminine (Effemophobia) by Jamaican standards & how it drives the homo-negative perceptions/homophobia in Jamaican culture/national psyche.



After catching midway a radio discussion on the subject of Jamaica being labelled as homophobic I did a quick look at the long held belief in Jamaica by anti gay advocates, sections of media and homophobes that several murders of alleged gay victims are in fact 'crimes of passion' or have jealousy as their motives but it is not as simple or generalized as that.

The Hypocrisy of Jamaican Anti Gay Groups & Selective Actions of Societal Ills


The selectivity of the anti gay religious voices on so called societal ills is examined in this podcast as other major issues that require the "church" to have spoken up including sexual abuse by pastors in recent times yet mere silence on those matters is highlighted.

Why are these groups and so called child rights activists creating mass hysteria and have so much strength for HOMOSEXUALITY but are quiet on corruption in government, missing children, crime in the country and so much more but want to stop same gender loving persons from enjoying peace of mind and PRIVACY?

Also is the disturbing tactic of deliberately conflating paedophilia with same gender sex as if to suggest reforming the buggery law will cause an influx of buggered children when we know that is NOT TRUE.

MSM/Trans homeless - From gully to graveyard



When are lives interrupted be allowed a real honest chance to move from interruption to independence and stability? I just cannot tell you friends.

An article appeared in the gleaner today that just sent me into sadness mode again with this ugly business of LGBTQI homelessness. The author of the piece needs an intervention too as he (Ryon Jones) uses terms such as cross dressers and or homeless men which if transgender persons are present they cannot be described or seen as such, sigh another clear display of the lack of impact and reach of so called advocacies and advocates who are more interested in parading as working but really aint having much impact as they ought to or claim.

We are told of houses being put together from time in memorial; the Dwayne’s House project seems dead in the water, the Larry Chang (named after a JFLAG cofounder) seems stuck in the mud and Colour Pink’s so called Rainbow House seems insignificant in relation to the size and scope of the national problem. JFLAG as presented on this blog is obviously not interested in getting their hands dirty really on homelessness save and except for using the populations as cannon fodder and delegating same; as far as I am concerned presenting them as victims of homophobia which is true but where are the programs and the perceived millions donated or granted since President Obama’s visit to address LGBTQ matters?

Former host of Dr Sexy Live on Nationwide radio and Sexologist tackles in a simplistic but to the point style homophobia and asks the poignant question of the age, What really are we as a nation afraid of?


It seems like homosexuality is on everyone's tongue. From articles in the newspapers to countless news stories and commentaries, it seems like everyone is talking about the gays. Since Jamaica identifies as a Christian nation, the obvious thought about homosexuality is that it is wrong but only male homosexuality seems to influence the more passionate responses. It seems we are more open to accepting lesbianism but gay men are greeted with much disapproval.

Dancehall has certainly been very clear where it stands when it comes to this issue with various songs voicing clear condemnation of this lifestyle. Currently, quite a few artistes are facing continuous protests because of their anti-gay lyrics. Even the law makers are involved in the gayness as there have been several calls for the repeal of the buggery law. Recently Parliament announced plans to review the Sexual Offences Act which, I am sure, will no doubt address homosexuality.

Jamaica has been described as a homophobic nation. The question I want to ask is: What are we afraid of? There are usually many reasons why homosexuality is such a pain in the a@. Here are some of the more popular arguments MORE HERE

The Deliberate Misuse of the “Sexual Grooming” Term by Antigay Fanatics to Promote Their Hysteria



Just as I researched on-line in NOT EVEN five minutes and found a plethora of information and FACTS on Sexual Grooming (and thanks to Dr Karen Carpenter for some valuable insight I found out what Sexual Grooming was) so too must these fanatics go and do the same and stop creating panic in the country.

The hysteria continues from the Professor Bain so called protests to protect freedom of speech and bites at the credibility of the LGBT lobby collectively continues via Duppies Dupe UWI articles when the bigger principle of the conflict of interest in regards to the greater imperative of removing/preserving archaic buggery laws in the Caribbean dependent on which side one sits is of greater import when the professor’s court testimony in Belize went against the imperative of CHART/PANCAP goals is the more germane matter of which he was former head now temporarily reinstated via a court ex-parte injunction. JFLAG Excludes Homeless MSM from IDAHOT Symposium on Homelessness



Reminder

In a shocking move JFLAG decided not to invite or include homeless MSM in their IDAHO activity for 2013 thus leaving many in wonderment as to the reason for their existence or if the symposium was for "experts" only while offering mere tokenism to homeless persons in the reported feeding program. LISTEN TO THE AUDIO ENTRY HERE sad that the activity was also named in honour of one of JFLAG's founders who joined the event via Skype only to realize the issue he held so dear in his time was treated with such disrespect and dishonor. Have LGBT NGOs lost their way and are so mainstream they have forgotten their true calling?

Steps to take when confronted by the police & your rights compromised:


a) Ask to see a lawyer or Duty Council

b) Only give name and address and no other information until a lawyer is present to assist

c) Try to be polite even if the scenario is tense

d) Don’t do anything to aggravate the situation

e) Every complaint lodged at a police station should be filed and a receipt produced, this is not a legal requirement but an administrative one for the police to track reports

f) Never sign to a statement other than the one produced by you in the presence of the officer(s)

g) Try to capture a recording of the exchange or incident or call someone so they can hear what occurs, place on speed dial important numbers or text someone as soon as possible

h) File a civil suit if you feel your rights have been violated

i) When making a statement to the police have all or most of the facts and details together for e.g. "a car" vs. "the car" represents two different descriptions

j) Avoid having the police writing the statement on your behalf except incases of injuries, make sure what you want to say is recorded carefully, ask for a copy if it means that you have to return for it

Vacant at Last! ShoemakerGully: Displaced MSM/Trans Persons were is cleared December 2014





CVM TV carried a raid and subsequent temporary blockade exercise of the Shoemaker Gully in the New Kingston district as the authorities respond to the bad eggs in the group of homeless/displaced or idling MSM/Trans persons who loiter there for years.

Question is what will happen to the population now as they struggle for a roof over their heads and food etc. The Superintendent who proposed a shelter idea (that seemingly has been ignored by JFLAG et al) was the one who led the raid/eviction.

New Kingston Cop Proposes Shelter for Shoemaker Gully LGBT Homeless Population

The same cop who has factored in so many run-ins with the youngsters in the Shoemaker Gully (often described as a sewer by some activists) has delivered on a promise of his powerpoint presentation on a solution to the issue in New Kingston, problem is it is the same folks who abandoned the men (their predecessors) from the powerful cogs of LGBT/HIV that are in earshot of his plan.

This ugly business of LGBTQ homelessness and displacements or self imposed exile by persons has had several solutions put forth, problem is the non state actors in particular do not want to get their hands dirty as the more combative and political issues to do with buggery's decriminalization or repeal have risen to the level of importance more so than this. Let us also remember this is like the umpteenth meeting with the cops, some of the LGBT homeless persons and the advocacy structure.

BUSINESS DOWNTURN FOR THE WEED-WHACKING PROJECT FOR FORMER DISPLACED ST CATHERINE MSM



As promised here is another periodical update on an income generating/diligence building project now in effect for some now seven former homeless and displaced MSM in St Catherine, it originally had twelve persons but some have gotten jobs elsewhere, others have simply walked away and one has relocated to another parish, to date their weed whacking earning business capacity has been struggling as previous posts on the subject has brought to bear.

Although some LGBT persons residing in the parish have been approached by yours truly and others to increase client count for the men costs such as gas and maintenance of the four machines that are rotated between the enrolled men are rising weekly literally while the demand is instead decreasing due to various reasons.

What to Do .....




a. Make a phone call: to a lawyer or relative or anyone

b. Ask to see a lawyer immediately: if you don’t have the money ask for a Duty Council

c. A Duty Council is a lawyer provided by the state

d. Talk to a lawyer before you talk to the police

e. Tell your lawyer if anyone hits you and identify who did so by name and number

f. Give no explanations excuses or stories: you can make your defense later in court based on what you and your lawyer decided

g. Ask the sub officer in charge of the station to grant bail once you are charged with an offence

h. Ask to be taken before a justice of The Peace immediately if the sub officer refuses you bail

i. Demand to be brought before a Resident Magistrate and have your lawyer ask the judge for bail

j. Ask that any property taken from you be listed and sealed in your presence

Cases of Assault:An assault is an apprehension that someone is about to hit you

The following may apply:

1) Call 119 or go to the station or the police arrives depending on the severity of the injuries

2) The report must be about the incident as it happened, once the report is admitted as evidence it becomes the basis for the trial

3) Critical evidence must be gathered as to the injuries received which may include a Doctor’s report of the injuries.

4) The description must be clearly stated; describing injuries directly and identifying them clearly, show the doctor the injuries clearly upon the visit it must be able to stand up under cross examination in court.

5) Misguided evidence threatens the credibility of the witness during a trial; avoid the questioning of the witnesses credibility, the tribunal of fact must be able to rely on the witness’s word in presenting evidence

6) The court is guided by credible evidence on which it will make it’s finding of facts

7) Bolster the credibility of a case by a report from an independent disinterested party.

Notes on Bail & Court Appearance issues


If in doubt speak to your attorney

Bail and its importance -

If one is locked up then the following may apply:
Locked up over a weekend - Arrested pursuant to being charged or detained There must be reasonable suspicion i.e. about to commit a crime, committing a crime or have committed a crime.

There are two standards that must be met:

1). Subjective standard: what the officer(s) believed to have happened

2). Objective standard: proper and diligent collection of evidence that implicates the accused To remove or restrain a citizen’s liberty it cannot be done on mere suspicion and must have the above two standards

 Police officers can offer bail with exceptions for murder, treason and alleged gun offences, under the Justice of the Peace Act a JP can also come to the police station and bail a person, this provision as incorporated into the bail act in the late nineties

 Once a citizen is arrested bail must be considered within twelve hours of entering the station – the agents of the state must give consideration as to whether or not the circumstances of the case requires that bail be given

 The accused can ask that a Justice of the Peace be brought to the station any time of the day. By virtue of taking the office excluding health and age they are obliged to assist in securing bail

"Bail is not a matter for daylight

Locked up and appearing in court

 Bail is offered at the courts office provided it was extended by the court; it is the court that has the jurisdiction over the police with persons in custody is concerned.

 Bail can still be offered if you were arrested and charged without being taken to court a JP can still intervene and assist with the bail process.

Other Points of Interest

 The accused has a right to know of the exact allegation

 The detainee could protect himself, he must be careful not to be exposed to any potential witness

 Avoid being viewed as police may deliberately expose detainees

 Bail is not offered to persons allegedly with gun charges

 Persons who allegedly interfere with minors do not get bail

 If over a long period without charge a writ of habeas corpus however be careful of the police doing last minute charges so as to avoid an error

 Every instance that a matter is brought before the court and bail was refused before the accused can apply for bail as it is set out in the bail act as every court appearance is a chance to ask for bail

 Each case is determined by its own merit – questions to be considered for bail:

a) Is the accused a flight risk?

b) Are there any other charges that the police may place against the accused?

c) Is the accused likely to interfere with any witnesses?

d) What is the strength of the crown’s/prosecution’s case?

 Poor performing judges can be dealt with at the Judicial Review Court level or a letter to the Chief Justice can start the process

Battle Lines Javed Jaghai versus the state & the Jamaica Buggery Law

The feature seems destined for persons who are just catching up to the issues and repositioning JFLAG in particular in the public domain as their image has taken a beating in some respects especially on the matter of the homeless MSM front. They need to be careful that an elitist perception is not held after this after some comments above simplistic discourse, the use of public agitation as beneath some folks and the obvious overlooking of the ordinary citizen who are realy the ones who need convincing to effect the mindset change needed and the national psyche's responses to homosexuality in general.
